B. BOA 2012 - 003 75 Maslte Road
Hold a public hearing, consider and act upon a variance to Article 10, Section 21,10.4 Schedule of
Qf#=Street Parking requirements to allow a reduction from the required parking of 1,808 to 654 spaces
at 75 Maskc Road for the City of Scher•tz, Maskc Soccer Fields.
Ms. Sanchez explained that the public hearing requirements far this variance request had been satisfied at the
March 26, 2012 Board of Adjustment meeting and the Board's decision was to postpone the action to allow
the applicant to analyze the proposed parking count and consider the concerns expressed by the Board. The
Design team met and reviewed the information and added additional parking spaces by omitting one playing
field. The City is proposing to provide 663 parking spaces at the facility to expand, renovate and develop
additional facilities on the property witlt funds provided by the 2010 bond proposition. The community benefit

is to provide aesthetically pleasing and beautifully landscaped parking lots that da not provide an over-
abundance of unnecessary parking spaces and to provide safe and effectively functional parking lots catered to
the type of operation or development on the property.
Mr. Logan restated the request to provide 663 parking spaces at the Maske Soccer Facility and thanked the
Board for their consideration.
Mr. Montgomery moved to approve the variance request to allow the facility to provide 663 spaces. Mr.
Dziewit seconded the motion. Vote was unanimous. Motion can-ied.
A. B®A 2012 - 004 3460 F1VI 3009
Hold a public hearing, consider and act upon a. request for the Schertz United Methodist Church, far a
twenty nine foot {29') variance from the maximum allowable building height of thirty-five feet (35'},
which is required by the Unified Development Code, Article 5, Section 21.5.7 Dimensional and
Developmental Standards, in order to allow the installation of a steeple on the sanctuary at 3460 FM
3009.
Public hearing opened at 6:04 pm.
Ms. Sanchez explained the p~upose of the hearing was to consider a variance to Article 5, Section 21.5.7
Dimensional and Developmental Standards for 3460 FM 3009 which is approximately 6.987 acres of land
currently owned by the Schertz United Methodist Church. The request is for a variance from the maximum
building height in the Neighborhood Services District to allow the relocation of the steeple from the existing
sanctuary to the new sanctuary building currently under construction; which will measure approximately
sixty-four feet (64'} in height. The maximum building height standard serves several purposes including
safety, aesthetics and impact to surrounding properties. After review of the current conditions at the property,
the site as it exists today contains an existing steeple that exceeds the maximum building height. Ms. Sanchez
explained the public hearing process and commented on the reasons staff was recommending approval
including: the Unified Development Code (UDC) does not address steeples with regard to height restrictions.
The proposed location of the new steeple will be further away from the adjacent reside~rtial zoned property
and Staff will be considering criteria for the UDC update as it related to steeples in anticipation for future
developments.
Mr. Mcl/lroy recognized the following to speak:
• Reverend Linda Montgomery commented that the Church has been in the Community over 100 years
and moved to tl~e current location in 1995. She gave some background on the church and its service
to the community. She expressed her support of the variance request and requested approval.
• Nancy Jolu7son, 301 Maple Dr., commented that she has lived in Schertz since the late 1960's and
supported the variance request.
® Ryan Roseborough, AGICIVI, lnc., gave a brief description of the project and explained tl~a# the
steeple would not be lighted at night.
• Joan. Ridings, 2813 Valencia, supported the variance request for the steeple but has concerns with the
removal of trees for parking spaces.
• Ross Hoover, 412 Lori Lynn, supports variance request.
Those being no one else to speak, the public hearing closed at 6:29 ptn.
Discussion followed between the Board, Staff and the Applicant.
Mr. Dziewit comments that he drove the area and looked at the construction. He observed that the steeple
would not be noticed by the adjacent Residential properties.
Mr. Montgoine~y requested clat•ification of the requested height variance and the UDC update.
Ms. Sanchez clarified the height and comtented that t•esearch has been performed as it relates to the height of
steeples; however, the exact language for the proposal has not been decided at this time.
Ms. Agee asked for M. s. Ridings question related to the parking area and trees be addressed.
Mr. Roseborough explained that all tree planned for removal have been removed.
Mr. Montgomery asked how the height of the steeple was determined.

Mr. Dziewit moved to approve the variance request. Ms. Agee seconded the motion. Vote was unanimous.

The Board of Adjustment previously considered and approved this request by unanimous decision on
December 19, 2011. However, in accordance with the UDC a variance is effective for a period of 180 days
after the date of approval, During the 180 day period the owner was unable to file for a building permit because
of the time period necessary to negotiate an encroachment agreement with Enterprise Texas Pipeline, LLC.

1. The purpose of a variance is so that the spirit of this UDC is observed and substantial justice is done.
In this case the primary and secondary sign combined square foo#age is significantly less than the
maximum allowed for one {1) wall sign by the UDC and does meet the spirit and intent of the Code.
2. The proposed second sign will be non-lit and face FM 3009 which will mitigate any potential negative
impacts to the surrounding residential uses,
