On this, the 18th day of November, 1975, at 7:00 o'clock P.M.,
the City Council of the City of Schertz, Texas, convened at a regular meet-
ing at the regular meeting place in the Municipal Building in the City of
Schertz, Texas, pursuant to due call and notice to all of the members of
said City Council, which meeting was at all times open to the public, and
at which meeting the following members were present, to-wit:

There being a quorum present, the meeting was called to order by
the Mayor, and, among other proceedings had were the following:
The Mayor introduced the hereinafter set forth ordinance, which
has been read and considered at the last regular meeting of the City Council
on the 4th day of November, 1975. It was determined that the City Secretary
had caused a short synopsis of said proposed ordinance to be published in
the official City Newspaper after its consideration at the last regular
meeting of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by
the Council.
Thereupon it was moved by Councilme~ber ~~~.~
and seconded by Councilmember ;;Z~~~ that/said ordinance
be finally passed and adopted. The Mayor put the motion to a vote of the
members of the City Council and the ordinance was finally passed and adopted
by the following vote:

AN ORDINANCE
AUTHORIZING THE USE OF PARKS AND RECREATIONAL AREAS, OWNED
AND CONTROLLED BY THE CITY OF SCHERTZ, TEXAS; NAMING THE
TRACTS OF LAND DESIGNED AS CITY PARKS; REGULATING THE
POSSESSION AND CONSUMPTION OF ALCOHOLIC BEVERAGES IN SUCH
PARKS; STATING THE POLICIES AND REGULATIONS GOVERNING THE
USE OF SUCH AREAS; AND REGULATING BALLFIELD USES AND FEES;
AND PROVIDING FOR A PENALTY.
WHEREAS, the City Council of the City of Schertz, Texas finds a
need for guidelines concerning the use of public and recreational areas within
the City limits of Schertz, and
WHEREAS, no resolution or ordinance exists regulating the reserva-
tion of certain areas of parks and recreational areas, nor fees for their use,
and
WHEREAS, no alcoholic beverages are permitted to be transported to or
consumed in City parks and recreational areas (according to City Ordinance
No. 129), NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION I - That the following tracts of land will be named as
foll ows:
1. The 16.825 acre tract bounded by Oak Street, F.M. 1518
and Aero Avenue to be named G. W. Pickrell Park, and
2. The 10.023 and .559 acre tracts along Cibolo Creek to be
named Cut Off Park, and
3. The neighborhood park in Lone Oak Subdivision to be
named Lone Oak Park, and
4. The 12 acre tract bounded by the LoVaca Gathering Company
Right-of-way, Oak Street, F.M. 1518 and Aero Avenue to be
named H.P.Thulemeyer Park.
SECTION II - That alcoholic beverages will be allowed in all parks
and recreation areas except Thulemeyer Park (ballfield areas that includes
picnic area next to and including the scout house), Lone Oak Park in Lone
Oak Subdivision and the swimming pool area.
SECTION III - That the following guidelines should be followed in
the utilization of City parks and recreational areas:
1. Reservation Policies:
a. No reservation is required for picnic areas except in
certain cases for large groups. A group reserving a
picnic area will be charged a fee of $10.00. This also
includes the reservation of either the large or small
pavilion.
b. Reservation of large pavilion for special use will be
handled by the City Council. The use of such area and
the fee will be determined by the City Council ~.
c. In all cases the following procedures should be followed
in making reservations:
(1) Reservations will be made in person only with the
City Secretary.
(2) Group making reservation will be responsible for
posting IIreservedll signs at designated area by
8:00 A.M. the day of reservation.
(3) IIReservedll signs must include name of party, time,
and date of reservation.
d. City Secretary will notify the Police Department and Parks
Department of time, date and type of group making reserva-
tion. Police Department will provide adequate security
to the area for duration of picnic or function.
e. No musical groups will be allowed to perform in any City
Park without prior written permission of the City Manager.
SECTION IV - That the use of ballfield parks will be open to the
public, except as follows:
1. Use of ballfields within one (1) month prior to start of league
play will be limited to league use for practice with no charge
for reservation, except for a fee of $4.50 per hour if lights
are used. No reservation will be made for ball fields on week-
ends for duration of season (including playoffs).
2. Reservations for other than the above will be limited to special
group requests, with a fee of $5.00 for day use and $10.00 for
night use, excluding tournaments.
3. Any organized league will be assessed a fee on a formula consis-
ting of 100% of electricity and 50% of maintenance costs to the
City. This formula will be based on the ballfield expenses
incurred during the past fiscal year or projected expenses,
whichever the City deems the more feasible and fair. (The
City Manager will be responsible for applying the formula
to establish fees at a fair and reasonable rate.)
4. Any special or invitational tournament will be assessed a fee
based on a formula consisting of 100% of both electricity and
maintenance costs of the City. This formula will be based on
the ballfield expenses incurred during the past fiscal year or
projected expenses, whichever the City deems the more feasible
and fair. (The City Manager will be responsible for applying
the formula to establish fees at a fair and reasonable rate.)

SECTION V - No motorized vehicles, except maintenance or
emergency vehicles, will be allowed in any part of the parks except desig-
nated parking areas without special permission of the City.
SECTION VI - Any portion or portions, Sections, clauses or
phrases of Ordinance No. 129 of the City of Schertz, Texas, in conflict
herewith are hereby repealed.
SECTION VII - Any person, organization, firm or corporation
violating Sections II through V of this ordinance shall be guilty of a
misdemeanor, and upon conviction thereof shall be,fined a sum of not more
than two hundred dollars ($200.00).
