On this, the 5th day of November, 1974, at 7:00 o'clock
P.M., the City Council of the City of Schertz, Texas, convened
at a regular meeting at the regular meeting place in the Munici-
pal Building in the City of Schertz, Texas, pursuant to due call
and notice to all of the members of said City Council, which
meeting was at all times open to the public, and at which meet-
ing the following members were present, to-wit:

There being a quorum present, the meeting was called to
order by the Mayor, and, among other proceedings had were the
following:
The Mayor introduced the hereinafter set forth ordinance,
which has been read and considered at the last regular meeting
of the City Council on the 15th day of October, 1974. It was
determined that the City Secretary had caused a short synopsis
of said proposed ordinance to be published in the official City
newspaper after its consideration at the last regular meeting
of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further cons i-
dered by the Council.
Thereupon it was moved by Councilmember
and seconded by Councilmember

adopted. The Mayor put the motion to a vote of the members of
the City Council and the ordinance was finally passed and adopted
by the following vote:

AN ORDINANCE
ADOPTING THE 1974 NATIONAL ELECTRICAL CODE AS
THE OFFICIAL ELECTRICAL STANDARDS OF THE CITY
OF SCHERTZ, TEXAS; CONTAINING A SAVING CLAUSE;
REGULATING LICENSING OF ELECTRICIANS; SETTING
INSPECTION RATES; PROVIDING FOR A PENALTY;
AND DECLARING AN EMERGENCY.
WHEREAS: the City of Schertz (hereinafter called the
City) and the Guadalupe Valley Electrical Cooperative (herein-
after called GVEC) are both concerned with the quality and safety
of electrical systems in and around the City, and
WHEREAS: the minimum standards of quality in electrical
work are recognized by the City as being in conformance with the
National Electrical Code of 1974, and
WHEREAS: the present ordinance (#43, as amended by #161
and 264) does not meet the needs of the City in certain areas,
such as the adoption of the 1974 code or the licensing of elec-
tricians, and the needs could be met by a revision of the elec-
trical code of the City, NOW, THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
SECTION 1. The City shall adopt as minimum standards of
electrical work the standards imposed by the National Electrical
Code of 1974,
SECTION 2. The City shall be the sole licensing authority
of installers (also called electricians).
a. Except as otherwise provided herein, no person, firm,
or corporation shall install, repair, or remove
electrical wiring unless licensed as a Master Elec-
trician by the City, or unless directly supervised
by a Master Electrician licensed by the City.
b. There are two classifications of electrical installers
licenses: Journeyman and Master Electrician.
1. Written applications for licenses shall be filed
with the City Secretary. The application shall
show the name and address of the applicant, and
should state his experience and qualifications
in electrical wiring and installing.
2. For each classification, if no current City
license is held, GVEC shall administer an open
book test to determine the applicant's familiarity
with the code book.
3. A Master's license from any other City will be
accepted as evidence of qualification, but each
license will have a six month conditional basis.
4. A Journeyman must have held such license for two
consecutive years to become eligible to take a
Master's license test.

5. The City Manager, upon due consideration of the
qualifications of the applicant, and the re-
commendations of GVEC, may approve or disapprove
such application for an installer's license.
c. An initial license fee for a master's license shall
be forty dollars ($40.00), and an initial fee of
twenty dollars ($20.00) shall be charged for a
Journeyman's license. Each year thereafter on or
before the tenth (10th) day of January, each licensee
shall pay to the City Secretary an annual license
renewal fee in the amount of twenty dollars ($20.00)
for a Master's, and ten dollars ($10.00) for a
Journeyman's license. Failure to pay the annual
license renewal fee before the due date shall auto-
matically result in loss of license, and re-application
for license at the initial fee will be required for
future work.
d. An applicant for a license approved by the City
Manager shall submit to the City Secretary a
corporate surety bond, acceptable to the City
Attorney in the principal amount of one thousand
dollars i$l,OOO.OO). Said bond shall indemnify
the City or any person, firm, or corporation within
the City, for damages caused by the licensee, his
agent, and his employees, in connection with the
exercise of privileges extended to the licensee
by reason of having been licensed by the City.
The surety bond shall run for a term concurrent
with the annual license period, and evidence of the
renewal of the bond, satisfactory to the City Attor-
ney, shall be submitted each year when the annual
license fee is paid.
e. A person will be permitted to do electrical work in
his own house without going through the testing
procedure for installers only if he completes the
proper procedure for application of permits, makes
the proper payment of fees, and completes the proper
inspection procedure to insure the quality of his
work.
SECTION 3. Any person, firm, or corporation violating
this Ordinance shall be guilty of a misdemeanor, and upon con-
viction thereof shall be fined a sum of not more than two hundred
dollars ($200.00). Each and every day or fraction of a day during
which this ordinance is violated shall be considered a separate
offense and punishable as such.
SECTION 4. After violation of this Ordinance by the in-
staller, or after unsatisfactory work, the City Manager, with
GVEC's recommendation, has the authority to revoke the license
of the installer. The Personnel Board would be the agency for
the licensee to seek recourse if he feels the action of the City
Manager is unwarranted. If properly assured as to the willingness
of the installer to cooperate with this ordinance in the future,
the City Manager may, not less than ten days after such revocation,
restore the license.
SECTION 5. At the time any permit is issued for a job
which will be inspected by the City's Electrical Inspector, the
City Secretary shall first be paid an inspection fee, according
to Appendix "A" attached.

SECTION 6. All other ordinances not in conflict with
this, and all sections of the Electrical Code of the City of
Schertz, Texas not in conflict herewith, shall remain in effect.
All ordinances or part of ordinances in conflict herewith are
hereby repealed.
SECTION 7. The public importance of this measure
constitutes and creates an urgent public necessity requiring
that this ordinance be passed and take effect as an emergency
measure, and shall take effect and be in force immediately
upon and after its passage.
