ORDINANCE NO. 74-D-12
REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE
CITY OF SCHERTZ; PROVIDING A PENALTY FOR VIOLATION OF
THIS ORDINANCE; PROVIDING FOR PUBLICATION; AND CONTAIN-
ING OTHER MATTERS PERTINENT TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ
TEXAS:
SECTION I - DEFINITIONS
(a). "Traffic". Pedestrians, ridden or herded animals,
vehicles, street cars, and other conveyances either singly or
together while using any street or highway for purposes of traffic.
(b). "Vehicles". Every device in, upon or by which any
person or property is or may be transported or drawn upon a street
or highway.
(c). "Motor Vehicle". Every vehicle which is self-propelled
by any fonn of motive power.
(d). "Right of Way". The privilege of the innnediate use of
the roadway.
(e). "Traffic-Control Device". All signs, signals, markings
devices placed or erected by authority of the City of Schertz
the purpose of regulating, warning or guiding traffic.

(f). "Traffic-Control Signal". Any device, whether manually,
electrically, or mechanically operated, by which traffic is alter-
nately directed to stop and to proceed.
(g). "School Zone". Each and every street or highway and
public property or ways within one thousand (1,000) feet of
boundary of any school.

(h). "Person". Every natural person, finn, co-partnership,
association or corporation.
(i). "Pedestrians". Any person afoot.
(j) . "Driver" . Every person who drives or is in actual
physical control of a vehicle.
(k). "Owner". A person who owns the legal title of a vehicle
or in the event a vehicle is the subject of an agreement for the
conditional sale or lease thereof with the right of purchase upon
perfonnance of the conditions stated in the agreement and with an
innnediate right of possession vested in the conditional vendee or
lessee, or in the event a mortgagor of a vehicle is entitled to
possession, then such conditional vendee or lessee or mortgagor
shall be deemed the owner for the purpose of this ordinance.
(1). "Police Officer". Every officer authorized to direct
or regulate traffic or to make arrests for violations of traffic
regulations.
(m). "Street or Highway". The entire width between the
boundary lines of every way publicly maintained when any part
thereof is open to the use of the public for purposes of vehicular
traffic.
(n). "Roadway". That portion of a highway improved, de-
signed, or ordinarily used for vehicular travel. In the event a
highway includes two (2) or more separate roadways the tenn
"roadway" as used herein shall refer to any such roadway separately
but not to all such ro~dways collectively.
(0). "Intersection".
(1) The area embraced within the prolongation or
connection of the lateral curb lines, or if none, then the lateral
boundary lines of the roadways of two (2) highways which join one
another at, or approximately at, right angles, or the area within
which vehicles traveling upon different highways joining at any
other angle may come in conflict.
(2). Where a highway includes two (2) roadways
thirty (30) feet or more apart, then every crossing of each
roadway of such divided highway by an intersecting highway shall
be regarded as a separate intersection. In the event such inter-
secting highway also includes two (2) roadways thirty (30) feet
or more apart, then every crossing of two (2) roadways of such
highways shall be regarded as a separate intersection.
(p). "Business District". The territory conti~ous to
and including a roadway when within any six hundred (600) feet
along such roadway there are buildings in use for business or
industrial purposes which occupy three hundred (300) feet of
frontage on one side or three hundred (300) feet collectively on
both sides of the roadway.
(q). "Residence District". The territory contiguous to
and including a highway not comprising a business district when
the property on such highway for a distance of three hundred (300)
feet or more is in the main improved with residences or residences
and buildings in use for business.
SECTION 2 - It shall be unlawful for any person to do any act
forbidden or fail to perfonn any act required in this
ordinance. Penalty for violation shall be a fine not exceeding
two hundred dollars ($200.00). Each violation shall constitute
a separate offense.
SECTION 3 - TRAFFIC-CONTROL DEVICES
Traffic control devices shall be installed on the
streets and highways within the corporate limits of the City of
Schertz, Texas, in such places as may be designated by the City
Council.
SECTION 4 - FULL SIGNAL OPERATION LOCATIONS
All electrical traffic control signals within the
corporate limits of the City of Schertz, Texas, enumerated in
Schedule A, Section 13, attached hereto and made a part hereof,
are hereby established as official electrical traffic-control
signals in full signal operation at such street intersections.
SECTION 5 - STOP SIGN LOCATIONS
All street intersections enumerated in Schedule B,
Section 14, attached hereto and made a part hereof and at which
a stop sign is situated are hereby established as official stop
sign locations.
SECTION 6 - YIELD RIGHT OF WAY LOCATIONS
All street intersections enumerated in Schedule C,
Section IS, are hereby established as official yield right of way
locations.
SECTION 7 - SCHOOL ZONES
It shall be unlawful for any person to drive or operate
any motor vehicle at a rate of speed in excess of fifteen (IS) miles
per hour within a school crossing zone, (the limits of which shall
be designated by school speed limit signs), on any day of the regu-
lar or any special or sUtmner tenn between the hours of seven o'clock
a.m. to nine o'clock a.m. or between the hours of two p.m. to four
fifteen p.m. or any other designated and posted hours.
SECTION 8 - SCHOOL CROSSING ZONES
It shall be unlawful for any person to drive or operate
any motor or other vehicle into or through any school crossing zone
at a time when there is a child or children crossing or standing
therein, provided that the said school crossing zone has been indi-
cated by signs not less than one hundred (100) feet from said zone
and further provided that such zones have been established across
paved streets indicated by lines of white or yellow paint marking
its boundaries which said zones shall not be greater in width than
twenty (20) feet.
SECTION 9 - PARKING
When signs are erected g~v~ng notice thereof, no
person shall park a vehicle at any time, upon any of the streets
or portions thereof, designated in Schedule D, Section 16, attached
hereto and made a part hereof.
SECTION 10 - NEGLIGENT COLLISION
(a). If any person driving or operating or in charge of any
vehicle, animal, railroad engine, or railroad car, shall by neg-
ligence cause, suffer or pennit such vehicle, animal, railroad
engine or railroad car, to come into collision with any other
vehicle of any nature whatever or with any animal, person, street
sign, street post, fire hydrant, mailbox or any other obstacle
or object whatever in or on any public street or any public place
whatever, in the City, such person shall be detennined guilty of
the offense of negligent collision.
(b). Negligence, as used herein, shall be defined as the
failure to use the same degree of care as a person of ordinary
prudence would use under the same or similar circumstances.
SECTION II - SPEED REGULATIONS
(a). As a result of a traffic and engineering survey
conducted by the Traffic Engineer, the maximum, reasonable, safe
and prudent speed limit has been found and is hereby declared to
be twenty (20) miles per hour on any street in any residential
or business district except as may be designated in Schedule E,
Section 17, of this ordinance. No person shall drive a vehicle
on a street or highway at a speed greater than is reasonable
and prudent under the circumstances then existing in a residen-
tial or business district. The limits specified in this section
shall be lawful but any speed in excess of the limits specified
in this section or in Schedule E, Section 17, shall be prima
facie evidence that the speed is not reasonable or prudent and
that it is unlawful.
(b). As a result of a traffic and engineering survey
conducted by the Traffic Engineer, the maximum reasonable, safe,
and prudent speed limits have been found and are hereby declared
to be in force on all streets as designated in Schedule E, Section
17, attached hereto, and made a part thereof.
(c). Nothing in this section shall be construed to affect
the provisions of this ordinance relating to allowable speeds in
school zones.
(d). No person shall drive a motor vehicle at such a slow
speed as to impede the normal and reasonable movement of traffic
except when reduced speed is necessary for safe operation or in
compliance with law.
(e). The provisions of this section regulating speeds of
vehicles shall not apply to vehicles operated by the Fire Depart-
ment nor to police officers of the City of Schertz acting in
their official capacity nor to physicians and/or ambulances
responding to emergency calls.
SECTION 12 - PUBLICATION OF ORDINANCE
The City Secretary is hereby directed to give notice of
the passage of this ordinance by causing said ordinance to be
published in one (1) issue of the official newspaper of the
City.
