ORDINANCE If 267
AN ORDINANCE ORDERING AN ELECTION TO DETERMINE THE QUESTION:
"SHALL A COMMISSION BE CHOSEN TO FRAME A NEW CHARTER?" AND IF
A MAJORITY OF THE VOTERS AT THE SAID ELECTION SHALL HAVE VOTED
IN THE AFFIRMATIVE, PROVIDING FOR A CHARTER COMMISSION TO PREPARE
A NEW CHARTER AND FOR A SECOND ELECTION TO DETERMINE WHETHER THE
CHARTER SO DRAWN SHALL BE ADOPTED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, GUADALUPE
COUNTY, TEXAS:
That an election be held on the 9th day of September, 1972, within
said City, submitting to the qualified voters of the city of Schertz,
Guadalupe County, Texas, the question "Shall a Commission be Chosen to
frame a New Charter?" and that shmld the majority of the qualified
voters voting on said question have voted in the affirmative that a
Charter Commission of Fifteen members be elected from the City at large.
The date of said election is the same as the special election for
one councilman for the City of Schertz, Guadalupe County, Texas. Said
election shall be held by the same officers heretofore appointed to hold
said special election for city Councilman at the following place:
FIRE STATION
That said election shall be held under the provisions of the Consti-
tution and laws of the State of Texas, governing General elections and all
persons qualified to vote in said city under the laws of this state regulat-
ing general elections shall be allowed to vote.
The manner of holding said election shall be governed by the laws of
the state of Texas, governing general elections. That the form of Ballot
to be used in said election shall be substantially as follows:

INSTRUCTIONS: Provided that a majority of the
qualified voters, voting on the above question, shall
have voted in the affirmative, there shall be elected
a Charter Commission composed of fifteen (15) mem-
bers. Regardless of whether you have voted "FOR",
or "AGAINST", or have not voted at all on the above
question, you are entitled to vote for not to exceed
fifteen (15) candidates for the Charter Commission.

Vote for the candidates of your choice by placing
an "X" in the square beside the candidate's name.
If the name of the person of whom the voter wishes
to vote is not printed on the ballot, the voter shall
write in the name of the person for whom he wishes
to vote in the space indicated. THE TOTAL NUMBER
OF CANDIDATES YOU HAVE VOTED FOR MUST NOT EXCEED
FIFTEEN (15) CANDIDATES. RE-CHECK YOUR BALLOT TO
MAKE SURE THAT YOU HAVE NOT VOTED FOR MORE THAN

Those desiring to vote for the proposition:
"Shall a Commission
be chosen to frame a new Charter?" shall place an "X" in the square
beside the statement FOR: and those desiring to vote against the
proposition:
"Shall a Commission be chosen to frame a new Charter?"
shall place an "X" in the square beside the statement AGAINST.
In either event the voter will then vote for a Charter Commission
of Fifteen (15) members to serve in case a majority of the voters voting
at this election have voted in the affirmative. Any person desiring his
name to appear on such ballot may do so by presenting his application
to the Mayor within the time and in the manner provided by the statutes
of this state and ordinances of said city and upon his compliance with
the applicable statutes of this state and ordinances of this city.
Should the voter desire to vote against any or all of the above named
persons, he may do so by writing opposite such name the name of the
person for whom he desires to vote, provided that a failure to so name
a Charter Commission shall not invalidate the vote as to the question
"Shall a Commission be chosen to frame a new Charter."
That should a majority of the qualified voters voting at said
election vote in the affirmative as to the question "Shall a Commission
be chosen to frame a new Charter?" then, after the Charter commission has
completed its work and submitted the new Charter that a second election
be held at the date designated by the Charter Commission,in conformity
with law, to determine whether the new Charter shall be adopted.
A copy of this ordinance signed by the Mayor of the City of Schertz,
Guadalupe county, Texas, and attested by the Secretary of the City shall
serve as a proper notice of the election to be held as herein ordered
on the 9th day of September, 1972. The Police Chief
is directed to cause
notice of said election to be posted at the City Hall and at the other
voting places in the said City of Schertz, Texas, for at least thirty (30)

and directed to have said notice of election published in some newspaper
of general circulation published in said city.
