The Schertz Planning and Zoning Commission convened on January 23, 2013 at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #~l, Schertz, Texas.

IIEARING OF RESIDENTS
® Steve Layton, 12231 Lost Meadows, spoke on the Reserve at Schertz, Unit 4 dam and
reservoir.
DISCUSSION:
A. Discussion and Public hearing on Ordinances related to drainage, floodplain and storm
water.
Mr. James presented the item by stating the draft drainage, floodplain and storm water Ordinances
given to the Commission are a clean version, whereas ared-lined version would be difficult because
there are so many changes. Haweve3•, when the Commission is ready to act, commissioners will be
given ared-lined version. Staff would like to have focus groups and thou input in the next twa to three
weeks, and then brief the Commission on recommended changes.
Mr. James mentioned in reference to Mr. Layton's presentation on the Reserve at Schertz, Unit 4 dam
that this item was not included on the plat for the first phase. Staff will have a look at the UDC section
on dams, and consider changes.
Mr. James highlighted substantial changes to the Flood Damage Prevention Ordinance:
® Article 1V, Section 2(i), states, "when a regulator floodway has not been designated, the

Floodplain Administrator must require that no new construction, sLtbstantial improvements, or
other development (including fill) shall be permitted within zones Ai-3Q and AE on the
community's FIRM, unless it is demonstrated that the cumulative effect of the proposed
development, when combined with all other existing and anticipated development, will not
increase the water surface elevation of the base flood at any point within the community unless
said increase is completely contained within the property of the development." Essentially the
City is limiting the one foot rule, and you can't impact another property owner.
® Under Section 3{c), Mr. James noted that older parts of Schertz already developed are in the
floodplain, and present a problem for redevelopment. A provision is inserted where a map will
designate the area, and rules will be slightly easier far development. This will save some
engineering study costs, notwithstanding that you still have to raise and flood-proof the
structure. Staff will check with FEMA that it is in compliance.
Mr. James stated that the Commission has already reviewed the Illicit Discharge and Connection Storm
Water Ordinance which is a water quality issue.
Next, Mr. James stated. that the Construction Storm Water Management Ordinance requires approval of
a Grading Plan when a development is under construction which prevents erosion and ensures approved
vegetation covers all disturbed areas.
Mr. James then presented Article 13 Land Disturbing Activities and Drainage, referencing Sec.
21.13.2,B.2, which states that "in floodplain areas where ongoing maintenance is required or the
floodplain will be reserved for use by the public, the drainage easements shall be maintained 6y a
public entity and the property will be dedicated to the City as a multi-use drainage easement." This
means that the City will be charging more for development to handle the costs. Also, Mr. James
referenced Sec. 21.13.2.B.4, which prohibits drainage easements crossing lots and property lines in
single family residential subdivisions.

Discussion followed between the Staff and the Commission.
Mr. Richmond opened the Public Hearing at 7:17 P.M. and recognized the following to speak:
• Steve Layton, 12231 Lost Meadows, spoke on culverts and a no rise policy.
Public Hearing was closed at 7:22 P.M.
5. REQUESTS AND ANNOiJNCE1VIENTS:
A. Requests by Couramissioners to place items on a future Planning and Zoning Agenda.
• Mr. Crawford asked if the Reserve at Schertz, Unit 4 dam can be added to an agenda.
® Mr. Crawford would like the Commission educated on fills, permits and monitoring of
dumping, and mentioned a particular area of concern along Friesenhahn Road and I-35 on
the Sysco side.
