BY LAWS
CITY OF SCHERTZ
TRANSPORTATION SAFETY ADVISORY COMMISSION
Section 1:
Purpose
The purposes of the Transportation Safety Advisory Commission for the City of Schertz
("the Commission") are as follows:
(a) Investigate safety issues and make reconunendations with respect to our city's
roadways.
(b) Improve our city's quality oflife through a citizen-government partnership.
(c) Promote safe and secure roads which provide convenience, recreational and
leisure activities and continued beautification of the City of Schertz.
Section 2:
Duties of the Commission
The defined duties of the Schertz Transportation Safety Advisory Commission are
outlined below. This listing is not intended to be limiting, however may be subject to
approved funding by the City Council. Additional duties may be added by the City
Council as needed.
(a) Coordinate and communicate with the Schertz Planning and Zoning Commission,
the Schertz Economic Development Corporation and similar bodies in the City of
Scheliz on matters related to transportation safety.
(b) Provide as needed safety materials i.e.: brochures, profiles, fact sheets, and similar
materials or information to be used for promotional activity and transportation
safety.
(c) Provide as needed a transportation safety plan for the City of Schertz.
(d) Review proposed traffic ordinances and maIce recommendations to City Council.
(e) May participate in fact-finding trips, conferences, or seminars related to
transportation safety.

Section 3:
Appointment, Eligibility, Membership; Alternate Members
(a) The Commission shall be composed of nine (9) regular members who are
residents or employees ofthe City and who shall be appointed by the City
Council. Each regular member of the Commission shall be appointed by the City
Council for a two-yem' telli commencing on the expiration ofthe prior term of a
regular member.
(b) In addition, the City Council may from time to time appoint up to two (2)
additional persons as alternate members of the Commission. Such persons shall
also be residents or employees of the City and may be appointed for terms not
exceeding two (2) years. Such persons shall be designated by the City Council as
Alternate No.1 or No.2. Alternate members shall be entitled to receive notice of
all Commission meetings. Alternate members may comment on matters coming
before the Commission in the same mmmer that regular members may comment
but, except as provided below, shall have no authority to vote and, unless serving
in place of an absent regulm' member as provided below, shall not be considered
in detelliining the presence of a quomm.
(c) The City Council may remove a regular member or alternate or member of the
Commission at any time, with or without cause.
(d). There shall be no limit on the number of telliS an individual may serve on the
Commission as a regular member or alternate.
(e) Upon the death, resignation, or removal of a regular or alternate member, the City
Council will appoint a replacement regular or alternate member to serve for the
remainder of such member's telli.
Section 4:
Term of Office, Organization and Removal from Office
(a) At the first meeting of each year the Commission will select a chairperson and
vice chairperson from among the regulm' members to preside over meetings. The
Commission may appoint other officers as deemed necessary by the Commission
or City Council.
(b) The terms of five (5) regular members and one (1) alternate member of the
Commission will expire on 31 st day of May for each even-numbered year and the
terms of four (4) regular members and one (1) alternate member of the
Commission will expire on 31 st day of May for each odd-number year.
(c) A regular member or alternate member may be removed from office by the City
Council at any time with or without cause.

(d) The City Council may remove members of the TSAC from office for
malfeasance, conviction of a crime involving moral turpitude, or failure to attend
seventy-five percent (75%) of the regular meetings of the commission per fiscal
year without good cause. Good cause shall include, but not be limited to, illness,
temporary disability, and absence from the City, or family emergency. All
members ofthe commission, including regular members and altemates, are
required to notify the TSAC Recording Secretary and Chairperson of any
proposed absences and shall provide the reason for absence. Failure to attend
three (3) or more consecutive regular meetings for any reason shall constitute
grounds for removal if approved by majority vote ofthe members ofthe TSAC.
Section 5:
Staff Support
Staff support will be provided by the Executive Director of Development, Executive
Director of Operations, City Engineer, Director of Public Works, Police Chief, Fire
Chief, Director of EMS, and City Planner or his/her designees. City representatives shall
serve as ad hoc members of the Commission. A recording secretary will be provided by
City Staff
Section 6:
Meetings and Quorums
(a) Meetings will be conducted on a regular basis. Special meetings will be at the call
ofthe chairperson or any two regular members of the commission.
(b) A quorum is required to conduct business. A quorum is a majority of the regular
members of the commission. In the absence of one or more regular members,
alternate members may serve and be counted as a quorum as set forth in Section 3
(3). For voting purposes, a majority ofthe members (five (5) including any
alternate member or members acting in the absence of a regular member or
members) present is required to have effect.
(c) When a regular member can not stay for the full length of a meeting for any
reason, then an altemate may be selected at the beginning of that meeting to serve
as the voting member for the entire meeting.
(d) Minutes will be recorded for each meeting by the Recording Secretmy. Such
minutes will be distributed to regular and alternate Commission members and
other interested parties.
(e) For the Hearing of Residents portion of every meeting each resident wishing to
speak will stand if able, give their full name, address and concerns, and shall be
limited to no more than five (5) minutes. Questions will be addressed to the entire
Commission. No questioning between individuals will be permitted except
relevant factual information when allowed by the presiding chairperson. During
this time no members shall discuss, debate or argue an issue with the resident, nor
indicate any probable vote.

(f) Whenever any agenda item or application is denied that item or application shall
not be accepted for filing for a period of six (6) months after the date of denial
unless the subsequent application involves a proposal that is substantially
different from the previously denied proposal. The Commission may, as its
option, waive the six (6) month waiting period if, after due consideration ofthe
matter at a schedule and posted meeting, it is determined that denial of the request
was based upon erroneous or omitted infonnation, 01' if substantial new
information pertaining to the request is discovered.
Section 7:
Disqualification from Voting
A regular 01' alternate member shall be disqualified from voting if he/she finds the
following conditions to exist:
(a) A personal or monetary interest exists on the project being discussed.
(b) The member will be directly affected, personally or monetarily, by the outcome of
the vote.
Section 8:
Motions
(a) A motion may be made by any seated member ofthe TSAC.
(b) Each member ofthe TSAC shall have one (1) vote and shall vote on each item
presented.
(c) The Chairperson, or in his/her absence, the Vice-Chairperson, is a voting member
and will vote on each motion presented.
(d) A motion to approve any matter before TSAC shall require the concurring vote of
at least a majority ofthe voting members of the TSAC (at least five (5) members).
If a motion is not approved by a majority of the voting members the motion shall
fail.
Section 9:
Public Record
The official records peltaining to the Commission's regular and/or special meetings shall
be on file in City Hall and shall be available in accordance with the Texas Open Meetings
Act.
Section 10: Compensation
The regular and alternate members ofthe Commission will serve without compensation,
except for previously budgeted reimbursement of authorized expenses attendant to the
performance of their duties as outlined in Section 6 above.

Section 11: Committees
The Chairperson may establish permanent committees and/or committees for a specific
task. Membership on committees may include individuals who are not regular or
alternate members on the Commission. Only a regular member ofthe Commission may
chair a committee.
Section 12: Amendments
These bylaws may be amended or changed by a majority vote of City Council or by a
majority vote of the Commission and approved by a majority vote of City Council.
