Speed Hump Application for Laura Heights ) ORDINANCE NO. 06- D-11 AN ORDINANCE. BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS, BE AMENDED TO AUTHORIZE THE INSTALLATION OF SPEED HUMPS ON STREETS IN THE CITY OF SCHERTZ, TEXAS AND PROVIDING AN EFFECTIVE DATE WHEREAS, the governing body of the City of Schertz (the "City") has .determined that traffic safety in the City may be enhanced in certain instances by the installation of speed humps on City streets. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS; 1. Chapter 18 of the Code of Ordinances of the City of Schertz, Texas is hereby amended by the addition of the following Article IX as follows: "Article IX SPEED HUMPS Sec. 18~132. Speed Hump Dermed A speed hump is a gentle rise and fall of pavement surface placed across a roadway intended to reduce the speed of vehicles. See Attachment I for basic design of speed humps. . Sec. 18-133. Eligible Streets and Location of Speed Hump (a) In order to qualify for consideration as a location for a speed hump, a street segment must meet criteria set from time to time by the Public Works Deparhnent, including at least the following criteria: (i) The street segment must be primarily a residential street or provide access to abutting residential properties. (ii) The street segment must have no more than one lane for moving traffic in each direction. ) 20119007.2 1 ." ) (iii) The street segment may not be designated as an arterial street on the City's Major Thoroughfare PIan. (iv) The street must have a posted speed limit of only 20 mph. (v) Traffic volumes on the street segment must be 500 vehicles per day or greater within a 24-hour period. (vi) The 85th percentile vehicle speed on the street segment must be at least 5 miles per hour over the posted 20 miles per hour speed limit. (vii) The street segment must not be so close to a Fire Department or Emergency Services facility as to significantly interfere with emergency vehicle operations. (viii) The street segment must be at least 750 feet long without interruption by a traffic control device. It is the responsibility of the Public Warks Department to conduct the necessary studies to determine if the street segment meets the required criteria. (b) The Department of Public Works shall determine the final location of all speed humps in accordance with safe engineering principles, considering at least the following criteria. ) (i) Speed humps will usually be placed no closer than 300 feet apart. (ii) A speed hump shall not be located in front of a driveway or within 50 feet of an intersection. (Hi) Speed humps should not be located within 250 feet of a traffic control device. (iv) A speed hump will normally be placed at the property line between the two properties when possible. (v) "No Parking" signs may be placed within 50 feet of the approaching side of the speed hump if deemed necessary by engineering site conditions. Other factors such as curves and grade changes on the street, emergency access, and safe sight distances will also be considered by the Public Works Department. [ (c) [Once installed, the speed hump shall be the property of the City, and the City shall be responsible for appropriate maintenance.] l~ 20119007.2 2 Sec. 18-134 Application (a) A request for installation of a speed hump begins with a "Request for Speed Hump Investigation" in the form attached hereto as Exhibit A being filed with the Department of Public Warks. A group of residents of at least ten (10) properties abutting on the street segment proposed for a speed hump can make a request. (b) The Director of Public Works, or his designee, will evaluate all requests and reconnnend approval or denial to the City Manager, taking into account the requirements. of this Chapter. Requests will be evaluated on .an annual basis. (c) The City may at any time install speed humps when and where it deems necessary, upon the advice of the Director of Public Works. Sec. 18w135 Appeal Process If the City determines that a speed hump is not warranted in a particular sub-division or on a certain street within the City, a group of residents of at least ten (10) properties abutting on the street segment proposed for a speed hump, may appeal the decision to the City Council. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. Should any portion or part of this Ordinance be held for any reason invalid, unconstitutional, or unenforceable, the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect.
