2002M07-AMEND CHAP 13 ST & WALK ORDINANCE NO. (~2_ - ~2~ - 7 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 16, STREETS AND SIDEWALKS, ARTICLE 1, IN GENERAL, SECTION 16-5 (a) and (b)AND SECTION 166; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEALING CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION 1 "THAT, Section 16-5 (a) and (b) of the Code of Ordinances, City of Schertz, Texas be amended as follows: Section 16-5 Painting or placing signs, poles, posts, etc. on streets and sidewalks. (a) It shall be unlawful for any person to place or cause to be placed or paint or cause to be painted, upon any sidewalk, street, or in any public right- of-way within the corporate limits of the City, any sign, notice, pole, post or any other obstruction. (b) It shall be the duty of the City Manager or designated representative to remove any signs, poles, posts or other obstructions found in violation of this Section. SECTION 2 THAT, Section 16-6 of the Code of Ordinances, City of Schertz, Texas be amended as follows: Section 16-6 Penalties Any violation of this ordinance by any person, firm or corporation is declared to be unlawful and a misdemeanor, and any violation thereof shall be punishable by a fine of not less than forty ($40.00) dollars or not more than two hundred ($200.00) dollars. Any person in violation of this ordinance and having paid a fine assessed for such violation, shall not be relieved of the expense incurred by the City in removing or remedying the condition prescribed in Section 16-5." SECTION 3 THAT, this Ordinance shall be in force and effect from and after its final passage and shall be published and be effective as provided in the City Charter, and it is so ordained. SECTION 4 THAT, all ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. Approved on first reading the ~ day of April, 2002. the _~. day May, 2002..
