A. Discussion and public hearing on improvements to the HOA process, drainage
responsibilities, division master plan requirements and the basis for approving and denying
plats.
Mr. James presented this item by stating this workshop item is a result of the discussion at the last
P &Z meeting. Regarding the HOA process, the City's interest is to make sure that an entity is
responsible for maintaining common lots, emergency access and drainage easements. The City has
made some modifications to storm water improvements dealing with situations for the
improvement beyond the scope of the HOA and the City has to step in to maintain it, because it
impacts the larger drainage system. Right now the City does not review HOA documents presently
and we may need to make an ordinance change to review HOA documents to make sure that they

meet our minimum criteria and to ensure that someone is responsible for maintaining the
easements shown on a plat. Mr. James also stated that there are 2 issues with drainage
responsibilities; first being that the developer controls the lots until a certain number of lots are
sold and once the HOA is set up, then the HOA takes control of regulation. Also a developer can
add property into the HOA. The City needs to look at a modification to clarify the purpose of the
Subdivision Master Plan process and requirements for platting. The basis for approving and
denying plats and master plans are non - discretionary items.

ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum
of two (2) locations accessing existing public streets. This development is designed to have two (2) points of
access via the IH35 frontage road and Eckhardt Road.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation.
PARKS: 10.503 acres of public parkland has been dedicated with Unit 1 of this subdivision. The Developer has
indicated a desire to construct improvements to the parkland and is working with the Parks, Recreation and
Community Services Director on the design of the parkland improvements, However, the developer may elect
to make a cash payment -in -lieu of development in the amount of $650 per dwelling unit prior to recording of the
final plat for each Unit. This application was reviewed under UDC, Ordinance 11 -S -15.
PUBLIC SERVICES: The site is serviced by Schertz water and sewer, NBU, AT &T, and Time Warner Cable.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat of each Unit per UDC, Section 21.4.15., unless otherwise specified in an
approved development agreement. The civil construction plans for each Unit must be reviewed and approved
by the Public Works and Engineering Departments prior to approval of the final plat.
Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended
throughout the subdivision and stubbed for future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The
subdivision will provide onsite detention.
Sidewalks, Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the
subdivision and along Eckhardt Road. All sidewalks are designed to meet the City of Schertz specifications.
Road Improvements:
There are two cul -de -sacs within this subdivision located in Unit 1 and based on UDC, Sec. 21.14.1 the size of
a cul -de -sac street may be modified upon approval by the Fire Chief and City Engineer, The cul -de -sacs in Unit
1 located on Devonwood Street and Starwood Street have a ROW diameter of 100' (50' radius) and a
pavement diameter of 90' which was approved and constructed prior to the adoption of the larger cul -de -sacs.
This master plan amendment identifies that the cul -de -sac ROW diameter in Units 2, 3, and 4 as ROW
diameter of 120' (60' radius) which provides 100' diameter of pavement as approved by the Public Works and
Fire Department to accommodate for public utilities and fire truck maneuverability. The allowance of the ROW
diameter of 100' (50' radius) in Unit 1 was approved prior to the adoption of the current UDC requirements.
STAFF ANALYSIS AND RECOMMENDATION:
With this master plan amendment the applicant has updated the following:

Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended
throughout the subdivision.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. Drainage report has been reviewed and approved by the City Engineer. The
subdivision will provide onsite detention.
Sidewalks, Hike and Bike Trails; Sidewalks will be constructed along both sides of the street throughout the
subdivision. All sidewalks are designed to meet the City of Schertz specifications.
Road Improvements; All streets will be developed to City of Schertz specifications. Construction plans for all
public improvements will be submitted and approved by Public Works and Engineering prior to approval of the
final plat,
STAFF ANALYSIS AND RECOMMENDATION:
The plat identifies a pipeline easement exists at the rear of Lots 1 thru 8, Block 2 on the southeast corner of the
property, The applicant has indicated that the pipeline easement has been vacated and documents are filed by
separate instrument with the Guadalupe County Clerk's office. Staff has requested a copy of the recorded
documents be submitted with the final plat application.
The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and
regulations. Staff recommends approval of the preliminary plat.
