A. Discussion and public hearing on improvements to the HOA process, drainage
responsibilities, subdivision master plan requirements and the basis for approving and denying
plats.
Mr. James presented this item by stating this workshop item is a result of the discussion at the last
P&Z #neeting. Regarding the HOA process, the City's interest is to make sure that an entity is
responsible for maintaining common lots, emergency access and drainage easements. The City has
made some modifications to storm water improvements dealing with situations for the
improvement beyond the scope of the H0~1 and the City has to step in to maintain it, because it
impacts the larger drainage system. Right now the City does not review HOA documents presently
and we may need to make an ordinance change to review IIOA documents to make sure that they

meet our minimum criteria and to ensure that someone is responsible for maintaining the
easements shown on a plat. Mr. James also stated that there ace 2 issues with drainage
responsibilities; first being that the developer controls the lots until a certain number of lots at°e
sold and once the HOA is set up, then the HOA takes control of regulation. Also a developer can
add property into the HOA. The City needs to look at a modification to clarify the purpose of tl~e
Subdivision Master Plan process and requirements for platting. The basis for approving and
denying plats and master plans are non-discretionary items.
Mr. Greenwald opened the public hearing at 6:25 P.M.

an HOA.
• Maggie Titterington, 9923 Autumn Arbor, spoke on the concern regarding stock tarrlcs.
• Robert Brockman, 1000 Elbel Road, spoke on a drainage easement ordinance in Savannah
Square recently passed by City Council.
• David Beales, Briones Engineering, is working with the applicant and stated that he went back
to the developer after the last meeting and was assured by the developer that he is not going to
turn over the pond to the HOA and he wants to sell the pond as a single tract to a single
homeowner and keep it as Agricultural.
• Lance McCallie, 6945 IIallie Heights, spoke on using the UDC and holding the developer
accountable.
Tammy Williams, 7013 Hallie Heights, spoke on trust being an issue between developers and
homeowners.
Mr. Greenwald closed the public hearing at b:36 P.M.
Mr. Dahle asked if we are removing the pond from the development, would it change the master
plan? Mr. James answered no. Discussion followed between the Staff and the Commission.

Mr. Dahle requested that rho minutes be pulled out and voted on individually in the Consent
Agenda as he was not at the last P&7 meeting. Mr. Braud requested to pull Item C and vote an it
individually.

8.348+ acre tract of land situated in the Rafael Garza Survey, Abstract No. 138, City of Schertz,
Guadalupe County, Texas and located on Fairlawn Avenue approxitnately 600 + feet north of Old
Wiederstein Road.

22.541± acre tract of land out of 93.452 acre tract and situated in the Stacy B. Lewis Survey No.
317 and the Antonia Zamora Survey No. 36, City of Schertz, Bexar County, Texas and located on
N. Graytown Road approxi-nately 1100 + feet north of the IH I0.
Ms. Woad presented this item by stating the applicant is proposing to final plat 22.541± acres of
land establishing 31 single family residential lots with a minimum lot size of 21,780 square feet.
The site is zoned Residential Agriculture (RA).
The subject property is currently undeveloped and is located north of IH 10 off of N. Graytown
Road and adjacent to the Hunter Estates and lvy Estates subdivisions. This property is located
adjacent to the 100-year floodplain (Unit 4) but Unit 2 is not located within the floodplain.
The development is designed to have two (2j points of access through Unit 1 via N. Graytown
Road and through the adjacent Ivy Estates Subdivision/Lazar Parkway. The City's Master
Thoroughfare Plan (MTP} designates a proposed north/south collector identified on the plat as
Lazar Parkway (86' ROW) which right-of--way was dedicated with Hunter Estates and ivy Estates.
Furthermore, the MTP proposes an expansion of the existing Graytown Road (60' ROW) to an 86'
ROW. The applicant is providing the 13' dedication for Graytown Road. Prior to recording the
final plat for this subdivision the final plat for the Unit 1 must be filed with the County Clerks
office.
On March 13, 2013 the Planning and Zoning Commission granted a waiver regarding construction
of Lazar Parkway and Graytown Road; based on dle calculations provided by the applicant, using
the City of San Antonio's methodology. Staff is suppo--tive utilizing San Antonio's methodology
to determine rough proportionality. Based on the analysis, while the developer will be dedicating
the necessary right-of--way, to require improvements to either Lazar Parkway, beyond what the
developer is proposing to provide access, or Graytown Road, creates a rough proportionality issue.
The Commission also granted a waiver to allow the developer to install an on site sewage facility
an each residential Iot because a public wastewater system is currently not installed in the area.
The final plat has been reviewed under Ordinance No. i 1-5-15 with no objections by the City
Engineer, Public Works, Parks, Inspections, Tire and Police. The plat is consistent with all
applicable zoning requirements, ordinances, and regulations of the City with the waiver approval.
Discussion followed between the Staff and the Commission.
Mr. Braud moved to accept this item as presented which included the 2 waivers regarding onsite
sewage and rough proportionality on the construction of Lazar Parkway. Mr. Glombilc seconded
tl~e motion. Vote was 5-0. Motion carried.

® Mr. Dahle asked about looking at rough proportionality in the UDC. Ms. Sanchez
stated that rough proportionality would be reviewed along with transportation.
