PLANNING AND ZONING MINUTES .Tune 12, 2013 The Schertz Planning and Zoning Commission convened on June 12, 2013 at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building 44, Schertz, Texas. CALL TO ORDER/ROLL CALLANTRODUCTION OF NEWLY APPOINTED MEMBERS Mr. Richmond called the meeting to order at 6:00 P.M. 2. CONSENT AGENDA There was nothing on Consent Agenda. 3. INTRODUCTION OF NEWLY APPOINTED MEMBERS Mr. Richmond recognized City Secretary, Brenda Dennis, who administered the Oath of Office to David Richmond, Richard Braud, William Rumfelt and Yolanda Suarez. Mr. Richmond offered congratulations to Commissioners, who were appointed and re- appointed. Mr. Richmond stated that in Mr. Glombik's absence, he recognized Mr. Rumfelt to be seated as a voting member. 4, HEARING OF RESIDEN'T'S v Both Maggie Titterington and Jeff Bailey had signed up to speak at Hearing of Residents, but stated they would speak at the public hearings later. Therefore, no one spoke. S. PUBLIC HEARING A. ZC2013 -006 Minutes Planning and Zoning Commission June 12, 2013 Page I of 8 Hold a public hearing, consider and act upon a request to rezone approximately 2.668± acres of land from General Business District (GB) to Planned Development District (PDD). The property is more specifically described as Lot 6, Block 1, of the Hubertus Retail Subdivision as recorded in Document #200806006465, plat records, Comal County, Schertz, Texas generally located at the southwest corner of FM -1103 and IH 35. Mr. Dahle stated that he has a conflict of interest with this item and would recuse himself. Mr. Richmond recognized Ms. Suarez to be seated as a voting member for Item 5A. Ms. Sanchez presented the item by stating that the applicant is proposing to rezone approximately 2.668+ acres of land generally located at the southwest corner of FM 1103 and IH 35 from General Business District (GB) to Planned Development District (PDD). Ten (l 0) public hearing notices were mailed to surrounding property owners on May 31, 2013 with a public bearing notice to be published in "The Daily Commercial Recorder" and the "Herald" prior to the City Council public hearing. Staff received two (2) responses in favor and one (1) response in opposition of the proposed request. The subject property is currently vacant and the applicant has indicated the desire to construct a Mini- Storage/Public Warehouse facility with no less than 3.8% of the net leasable area of the primary structure as leasable office spaces with entrances facing the exterior. The proposed PDD will include a base zoning district of the current General Business District (GB) and in addition will allow a mixed use Mini - Warehouse /Public Storage and Office Space to develop on the site. The property will be developed in accordance with the UDC as amended, except as outlined in the PDD. The PDD has outlined several standards that will waiver from the UDC as they relate to Mini - Warehouse /Public Storage. The subject property is currently platted. The Future Land Use Plan (FLUP) designates the subject property for Industrial /Business Park which is defined in the Comprehensive Land Plan as areas for industrial uses; clusters of technology and research and development campus; and educational institutions. Impact of Infrastructure: The proposed zoning would have a minimal impact on the existing and planned water and wastewater systems. In reviewing the Institute of Transportation Engineers Trip Generation rate table Mini - Warehouse use will have a minimal impact on the surrounding roadways because it generates far less trips per unit than other retail uses permitted within the current GB zoning district. ® Impact of Public Facilities /Services: The proposed rezoning request should have a minimal impact on public services, such as schools, fire, police, parks and sanitation services. The rezoning request appears to have a minimal impact on the public infrastructure, facilities or services. The proposed North Schertz Sector Plan (Gateway Plan) identifies the area as Highway Commercial which provides for a mix of retail and commercial uses to take advantage of the highway frontage. The PDD has allowed for variations from the UDC standards but many of those changes will Minutes Planning and Zoning Commission June 12, 2013 Page 2 of 8 exceed the current standards as follows: • The site will provide 100% masonry building excluding windows and doors. The UDC standard is 100% masonry on the front fagade and 75% on all other sides. • The proposed Mini - Storage will provide additional landscaping at the rear of the site adjacent to the residential use to buffer any negative impacts. • The project will incorporate a rainwater capture system. • The site will meet or exceed the City's lighting and glare standards. Staff recommends approval based on a changed condition to the Comprehensive Land Use Plan reflected in the North Schertz Sector Plan (Gateway Plan) currently in process. Mr. Richmond opened the Public Hearing at 6:35 P.M. Maggie Titterington, President Schertz Chamber, 1730 Schertz Parkway, spoke on the addition of another business that is needed. ® Steve Layton, 12231 Lost Meadows Drive, spoke on drainage for this location. ® Robert Brockman, 1000 Elbel Road, spoke on access being 2417 and if there is minimum acreage on a PDD. Mr. Bailey answered that this facility is not 24/7. Ms. Sanchez stated that the minimum acreage is 2 acres. Mr. Richmond closed the Public Hearing at 6:40 P.M. Minutes Planning and Zoning Commission June 12, 2013 Page 3 of 8 Mr. Braud asked about the future site for a street. Ms. Sanchez answered that it's a reservation for a future roadway and if the street goes in, it will not affect this development. Mr. Braud asked about the strip of pavement in front of the structure. Mr. Bailey answered that there is a private driveway off the frontage road and his development will extend it along their frontage. Mr. Rumfelt asked about access from FM 1103. Mr. Bailey answered that this property will have primary access coming off FM 1103. Discussion followed between the Staff, the Applicant and the Commission. Mr. Braud moved to approve this agenda item and recommend approval to City Council. Mr. Crawford seconded the motion. Vote was 7 -0. Motion carried. Mr. Dahle returned to the dais as a voting member and Commissioner Suarez returned to the alternate position. B. ZC2013 -008 Hold a public hearing, consider and act upon a request for a proposed street name change of Enterprise Avenue to Schertz Parkway from the intersection of 111 35 frontage road extending north to the intersection of Lookout Road. Ms. Sanchez presented this item by stating that there was a policy establishment for street name change guidelines adopted in May 1989 which established the requirement for Planning and Zoning Commission to consider street name changes and recommend to City Council. The City of Schertz is the Applicant. Twelve (12) public hearing notices were mailed to surrounding property owners on May 31, 2013 advising them of the proposed street name change. Staff received three responses of support for the proposed request. No other comments or phone calls in support of or in opposition to this request have been received. Enterprise Avenue is located on the north side of IH 35 and begins at the intersection of the IH 35 frontage road and extends north to the intersection of Lookout Road. The street bisects the city limit boundaries of Schertz and the City of Selma and provides access to several businesses. This thoroughfare is designed as a sixty foot (60') collector that carries traffic from Schertz Parkway and the 1H 35 frontage road to both the City of Selma residents and businesses and to various businesses in the City of Schertz. Currently, there is one existing business that has an Enterprise Avenue address and is located in the City of Selma. As part of those guidelines City staff has consulted with the Police Department, Fire Department, EMS and Bexar Metro 911 concerning the street name change and all comments and recommendations are attached for your review in your packet. The City of Schertz has been working with the City of Selma to coordinate this street name change and an interlocal agreement has been drafted regarding the road name change. Staff recommends approval of the street name change Mr. Richmond opened the public hearing at 7:02 P.M Minutes Planning and Zoning Commission June 12, 2013 Page 4 of 8 Robert Brockman, 1000 Elbel Road, asked in which county is this located. Ms. Sanchez answered Guadalupe County. Mr. Richmond closed the public hearing at 7:05 P.M. Mr. Evans commented that he dislikes streets that go all the way through and have more than one name. Mr. Dahle agreed. Mr. Greenwald moved to accept the item as presented and recommend approval to City Council. Mr. Dahle seconded the motion. Vote was 7 -0. Motion carried. C. ZC2013 -009 Hold a public hearing, consider and act upon a request for a proposed street name change of Lookout Road to Old Selma Road from the intersection of Enterprise Avenue extending east to the intersection of Tri- County Parkway. Mr. Richmond stated that this item is correctly numbered on the agenda, but has an incorrect number in the packet and to make a note of the correction. Ms. Sanchez presented this item by stating that the City of Schertz is the Applicant on this item. Ten (10) public hearing notices were mailed to surrounding property owners on May 31, 2013 advising them of the proposed street name change. Staff received three responses opposed to the proposed request. No other comments or phone calls in support of or opposition to this request have been received. Lookout Road is located on the north side of 1H 35 and begins at the intersection of Lookout Road and Tri - County Parkway and extends west through four jurisdictional city limits; Schertz, Selma, Live Oak and San Antonio. In Schertz, Lookout Road is a sixty foot (60') collector that carries traffic from FM 3009 through the Tri - County Business Park to the intersection of Lookout Road and Enterprise Avenue, and serves as a thoroughfare to various businesses in Schertz. Currently, there are several Schertz properties that have addresses assigned along Lookout Road; however, those properties are undeveloped. The City of Schertz has been working with the City of Selma to coordinate this street name change, and an interlocal agreement has been drafted which will allow each City to change the name of the street. As a result, Lookout Road would become Old Selma Road from the intersection of Tri - County Parkway and extend west to the City limits of Selma. The City of Selma is presenting this same name change proposal to their Planning and Zoning Commission on June 24, 2013, and it will be presented to their City Council on July 11, 2013. As part of these guidelines City staff has consulted with the Police Department, Fire Department, EMS and Bexar Metro 911 concerning the street name change and all comments and recommendations are attached for your review in your packet. Staff recommends approval of the street name change Mr. Richmond opened the public hearing at 7:09 P.M Minutes Planning and Zoning Commission June 12, 2013 Page 5 of 8 No one spoke. Mr. Richmond closed the public hearing at 7:10 F.M. Mr. Crawford asked about the 3 opposing comments, and Ms. Sanchez read the 3 comments received. Mr. Evans asked about the motivation to change this street name. Ms. Sanchez stated that we are working in cooperation with the City of Selma, and they are requesting our support in changing the street name. Discussion followed between the Staff and the Commission. Mr. Dahle moved to table this item for future consideration. Mr. Greenwald seconded the motion. Discussion was tailed. Mr. Braud stated that unless Lookout Road is changed from Loop 1604 to Tri County Parkway as one name he would not vote for this item. Vote was 7 -0. Motion carried. D. Hold a public hearing, consider and make a recommendation to City Council to amend the Comprehensive Land Plan associated with the North and South Schertz Sector Plan; and the Historic Downtown Schertz Plan (Gateway Plan). Mr. James presented by stating that this item is to adopt the Gateway Plan as part of the Comprehensive Land Use Plan. The North/South and Downtown land use sections are included in the Future Land Use Plan in chapter 4 of the Comprehensive Plan. State law stipulates that the basis for making land use decisions should be the Comprehensive Land Use Plan. The Gateway Plan lays out drainage issues based on public input necessitating changes to the Unified Development Code. Mr. James also noted that there are some areas which are inconsistently designated and have been developed outside the Comprehensive Land Use Plan. Areas such as Old Wiederstein Road which still is designated industrial but has been developed as residential will need to be redesignated at a later date. Staff recommends approval to amend the Comprehensive Land Use Plan to include the North Schertz Sector Plan, South Schertz Sector Plan, and the Historic Downtown Schertz Plan by reference. The Planning and Zoning Commission is making a recommendation to City Council on the proposed amendment to the Comprehensive Land Use Plan. In considering action on an amendment, the Commission should consider the criteria within UDC, Section 21.4.6 D. Mr. Richmond opened the Public Hearing at 7:35 P.M. Steve Layton, 12231 Lost Meadows Drive, spoke on Crescent Bend Nature Park and the Comprehensive Land Use Plan. Mr. Richmond closed the Public Hearing at 7:39 P.M. Discussion followed between Staff and the Commission. Mr. Dahle moved to approve the item as presented with one revision that Crescent Bend Nature Park be included in the map as Parks / Open Space, and recommend approval to City Council. Hold a public hearing, consider, and make a recommendation to the City Council to amend the Unified Development Code (UDC) associated with the North and South Schertz Sector Plan; and the Historic Downtown Schertz Plan (Gateway Plan). Mr. James presented this item by stating that now that the Commission has made the recommendation to City Council to amend the Comprehensive Land Use Plan, the first step to implement the plan is to adopt the changes to the Unified Development Code zoning categories. Staff recommends approval of the amendments to the UDC to include the recommended proposed changes to reflect the updated character zone designations in the North and South Schertz Sector Plan. The Planning and Zoning Commission is making a recommendation to City Council on the proposed amendment to the Unified Development Code. In considering action on an amendment, the Commission should consider the criteria within UDC, Section 21.4.7 D. Mr. Evans asked if the Commission would see page by page on what will be done. Mr. James answered that Staff had not done that in the past. Chairman, Planning and Zoning Commission Recording Secretary, City of Schertz Minutes Planning and Zoning Commission June 12, 2613 Page 8 of 8 PARKS: A 2.61+ acre private park is being provided for this subdivision; however, because the private park does not meet the minimum development standards of the UDC the Parks, Recreation and Community Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per dwelling unit will be paid by the Developer prior to recording of the final plat. This application is reviewed under UDC Ord #11 -S -15. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4,15., unless otherwise specified in an approved development agreement. The civil construction plans have been reviewed by the Public Works and Engineering Departments. Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision and stubbed for future development. Drainage; The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. Drainage report has been reviewed and approved by the City Engineer. The subdivision will provide onsite detention. Sidewalks Dike and Bike Trails; Sidewalks will be constructed along both sides of the street throughout the subdivision and along Schaefer Road. All sidewalks are designed to meet the City of Schertz specifications. Road Im rovements: All streets will be developed to City of Schertz specifications. Unit 2 is located adjacent to Schaefer Road, A 7.5' street dedication has been provided for expansion along Schaefer Road, Construction plans for all public improvements will be submitted and approved by Public Works and Engineering prior to approval of the final plat. STAFF ANALYSIS AND RECOMMENDATION: The final plat is consistent with applicable requirements for the property, ordinances and regulations. All lots meet the minimum lot width, depth and area. It has been reviewed with no objects by the City Engineer, Public Works, Parks, Inspections, and Fire. Staff recommends approval. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision and are designed to meet the City of Schertz specifications. The development is located adjacent to Graytown Road. Graytown Road is an existing 60' ROW and the MTP designates it as a secondary arterial (86' ROW). 13' of ROW has been dedicated to the City of Schertz for the expansion. The developer requested a waiver to not construct the improvements to N. Graytown Road based on the rough proportionality analysis findings that the supply provided is roughly proportionate to the demand resulting from the development. The Planning and Zoning Commission granted a waiver on Unit 1 & 2 which allows the developer to provide the required dedication of land for public ROW without construction or improvement to the ROW's. Rough Proportionality is considered pursuant to UDC, Sec, 21.1.7 Apportionment of Municipal Infrastructure Costs. STAFF ANALYSIS AND RECOMMENDATION: The preliminary plat has been reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, Fire and Police. The plat is consistent with all applicable zoning requirements, ordinances, and regulations of the City with the waiver approval, The applicant has requested two waivers with this preliminary plat application to allow the Planning and Zoning Commission to consider the facts and conditions of the requests prior to granting the waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article 12 when undue hardship will result from requiring strict compliance. The preliminary plat indicates that all the residential lots proposed will have privately owned On -Site Sewage Facilities (OSSF). In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.8, Wastewater System, all lots, tracts and parcels on which the development is proposed shall be connected to a public wastewater system. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec, 21.12.15 Waivers. The developer is requesting the waiver to the UDC requirement because at this time SARA does not have public wastewater lines constructed to the property. The Commission granted a waiver for Unit 1 & 2 which allowed the OSSF for each privately owned lot. The plat indicates that the proposed tract of land is located adjacent to a secondary arterial (Graytown Road). In accordance with UDC, Article 4 Procedures and Applications, Sec, 21.4.15,EA Timing of Public Infrastructure Improvement Construction, requires the installation of all public improvements required to serve the subdivision before a final plat is recorded or the applicant can defer the obligation to install the public improvements conditioned on the execution of a subdivision improvement agreement and sufficient surety to secure the obligations defined in the agreement. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. Based on the requirements of the UDC any public improvement not installed requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15 Waivers. Pursuant to UDC, Sec. 21.1.7 Apportionment of Municipal Infrastructure Costs - If the City requires, as a condition of approval for a property development project, that the developer bear a portion of the costs of municipal infrastructure improvements by the making of dedications, the payment of fees, or the payment of construction costs, the developer's portion of the costs may not exceed the amount required for infrastructure improvements that are roughly proportionate to the proposed development as approved by a professional engineer who is licensed in the State of Texas, and is retained by the municipality, This provision must be considered when determining the approval of the waiver for installation public infrastructure for this project, The applicant is requesting approval of a waiver regarding construction of Lazar Parkway and Graytown Road; based on the calculations provided by the applicant, using the City of San Antonio's methodology. Staff is supportive utilizing San Antonio's methodology to determine rough proportionality. Based on the analysis, while the developer will be dedicating the necessary right -of -way, to require improvements to either Lazar Parkway, beyond what the developer is proposing to provide access, or Graytown Road creates a rough proportionality issue. As such, Staff is recommending the waiver. COMMISSIONERS CRITERIA FOR CONSIDERATION: In considering final action on a preliminary plat, the Commission should consider the criteria within UDC, Section 21.12.8.D. In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC; Section 21.12.15 Waivers A. General The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest. In making their findings, the Planning and Zoning Commission shall take into account the nature of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the Planning and Zoning Commission finds: 1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area; and 2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDC. Such findings of the Planning and Zoning Commission, together with the specified facts upon which such findings are based, shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such waiver is granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC so that the public health, safety, and welfare may be secured and justice done. B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver. C. Such findings together with the specific facts on which such findings are based shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such exception is granted. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law, ordinance, code or regulation of the City. D.
