Minutes for April 9, 2014 Regular Meeting Mr. Greenwald moved to approve the minutes as presented. Mr. Crawford seconded the motion. Vote was 6 -0 -1 with Mr. Dahle abstaining. Motion carried. Mr. Richmond moved to Item 6A. A. ZC2013 -014 Hold a public hearing, consider and act upon a request to rezone approximately 0.468 acres of land from General Business (GB) to Residential /Agriculture (RA). The property is more specifically described as a portion of the Stacy B. Lewis Survey No. 317, Abstract No. 443, Minutes Planning and Zoning Commission May 14, 2014 Page I of 5 and the Antonio Zamora Survey No. 36, Abstract No. 82, City of Schertz, Bexar County, Texas, generally located on Boenig Drive approximately 170 feet west of the street Laura Heights. Ms. Wood presented this item by stating the applicant is proposing to rezone approximately 0.468 acres of land in The Reserve at Schertz II Subdivision from General Business District (GB) to Residential Agriculture District (RA). The subject property is currently undeveloped and is located on Boenig Drive approximate 165 feet west of the street Laura Heights. Additionally, the property is located in the Air Installation Compatibility Zone (AICUZ) — Accidental Potential Zone I (APZI). The primary reason for the proposed rezoning is to include the 0.468 acre tract of land into the adjacent residential lot to the south located in The Reserve at Schertz II Subdivision. Staff recommends approval of the zoning request based on its compatibility with the adjacent land uses, and compliance with the Comprehensive Land Plan and the AICUZ study. David Earl, Applicant's representative, stated that they had discussed this at the last meeting and this is a follow through to rezone. Mr. Richmond opened the Public Hearing at 6:14 P.M. There being no one to speak, Mr. Richmond closed the Public Hearing at 6:16 P.M. Mr. Evans asked if we have an agreement that the house will stay where it is because it's in the APZI. Ms. Wood stated that the exhibit shows that this is where they plan to put the house. Mr. Earl agreed that they are agreeing to that placement of the house. Mr. Crawford moved to forward this item to City Council with a recommendation to approve. Mr. Glombik seconded the motion. Vote was 7 -0. Motion carried. Mr. Cox presented this item by stating that the applicant is proposing to rezone approximately 458 acres of land generally located on IH -35 Frontage Road approximately 350 ft. east of the intersection of IH -35 Frontage Road and Covets Cove. The applicant is requesting to rezone all 458 acres from General Business (GB) to a Planned Development District (PDD), which will consist of commercial, multi - family residential, townhome, and single family residential uses along with a school site and public parkland. On May 2, 2014 one- hundred and thirty four (134) public hearing notices were mailed to surrounding property owners and as of tonight's meeting, Staff has received 18 responses, 14 opposed, 1 in favor, and 3 opposed from an adjacent community who do not live within 200 feet of Minutes Planning and Zoning Commission May 14, 2014 Page 2 of 5 the subject property which required notice. The proposed density is consistent with the Comprehensive Land Plan designation use of highway commercial, commercial campus, and single family residential. Highway commercial and commercial campus land uses focus on areas of large format retail, restaurants, entertainment uses, office space and multi- family apartments. The proposed zoning allows for these commercial uses along the IH -35 frontage. The proposed zoning identifies four (4) different minimum lot sizes for single family residential: 6,600 square feet, 7,200 square feet, 7,800 square feet and 9,000 square feet as shown in table two: dimensional requirements chart in the PDD. Additionally there are approximately 57 acres of open space and parkland proposed. The PDD also provides for some specific development standards. Staff recommends approval of the zoning request based on the compliance with the Comprehensive Land Use Plan and the improved design and layout of the subdivision. Mr. Kossel, the Applicant, presented a slide show from Mr. Dixie Watkins, absent from the meeting, the Project Consultant for the application, with information on the development and concepts. Mr. Kossel, as the Developer on this project, gave a Powerpoint presentation on the land plans and details of the project. Mr. Richmond opened the Public Hearing at 7:05 P.M. • Sandra Scott, 5333 Storm King, spoke on view, transportation and water concerns. • Adrienne Kindt, 5737 Bill Hass, spoke on view, and traffic. • Steven Smart, 6086 Covers Cove, spoke on construction equipment and traffic. • Jennifer Alvior, 5741 Bill Hass, spoke on home town feel and the view. • Faye Touve, 5213 Brookline, spoke on school concerns. • Bob McMahon, 6100 Covets Cove, spoke on traffic concerns. • Jon Long, 6073 Covers Cove, spoke on zoned commercial concerns. • Steve Clark, 5269 Brookline, spoke on not receiving notification and decreasing value. • Chad Hamilton, 6206 Fred Couples, spoke on small town feel, HOA and park concerns. • Armando Cruz, 6070 Covers Cove, spoke on Schwab Road and postponing item. • Marvin Miller, 5732 Columbia Drive, spoke on multi- family and townhomes. Mr. Richmond closed the Public Hearing at 7:32 P.M. Ms. Wood stated that there was a question about water concerns, and she reminded everyone that the City of Schertz relies on the Carrizo Wilcox Aquifer and does not have use restrictions like the Edwards Aquifer. Mr. Kossel stated that depending on the market, the build out will be in phases with roads being built as they are phased, and they will take care of the portion of Schwab Road that is in their property. Mr. Cox stated the Nortex spine road will be built to the school site with Phase 1. Mr. James stated that as they bring in their plats, the City requires 2 points of access. Discussion followed between Applicant, Staff and the Commission. Mr. Greenwald moved to forward this request to City Council with a recommendation to approve Minutes Planning and Zoning Commission May 14, 2014 Page 3 o r 5 as submitted. Mr. Glombik seconded the motion. Mr. Brand questioned if they need to remove the school property from the rezoning. Mr. Greenwald concurred to remove the school district from the motion and Mr. Glombik agreed. Vote was 6 -0 -1 with Mr. Evans voting nay. Motion carried. A. PC 2014 -022 Consider and act upon a request for approval of a preliminary plat of Cypress Point Subdivision Unit 4, an approximately 19 acre tract of land situated in the C.M. Gahagan Jr. Survey No. 258, Abstract No. 142, City of Schertz, Guadalupe County and Abstract No. 182, City of Schertz, Comal County, Texas and located off Eckhardt Road approximately 1000 feet south of the Froboese Lane. Mr. Cox presented this item by stating that the applicant is proposing to preliminary plat approximately 19 acres of land establishing 73 single family residential lots, one (1) drainage lot, and one (1) landscape lot. The zoning for Unit 4 is Single Family Residential District -6 (R -6) with a minimum lot size of 7,200 square feet. Side yard setbacks are established at seven and one half feet (7.5'). The Master Plan was amended and approved by the Planning and Zoning Commission on February 12, 2014. Staff recommends approval of the preliminary plat. The Applicant's representative, Mark Hill, had no comment. Mr. Brand asked what Lot #30 is for on the map. Mr. Cox stated that this will be a paved turnaround and eventually stubbed out. Mr. Braud asked if it will be maintained by the HOA. Mr. Cox answered yes. Mr. Dahle moved to approve this item as presented. Mr. Greenwald seconded the motion. Vote was 7 -0. Motion carried.
