AN ORDINANCE
PROVIDING STANDBY AUTHORITY TO THE MAYOR UPON AUTHROIZATION
BY THE CITY COUNCIL TO DECLARE THAT A NEED FOR ~~NDATORY
WATER CONSERVATION EXISTS OR THAT A WATER EMERGENCY EXISTS;
PROHIBITING OUTDOOR USE OF WATER DURING MANDATORY CONSERVATION
AND EMERGENCY PERIODS; PROVIDING FOR DRAUGHT WATER SURCHARGES;
PROVIDING FOR A PENALTY; PROVIDING FOR A SAVINGS CLAUSE AND
REPEALING CONFLICTING ORDINANCES.
BE IT ORDAINDED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS;
ARTICLE I - GENERAL PROVISIONS
SECTION I WATER USAGE AND RATES DURING PERIODS OF DRAUGHT.
When the water level in the City's water storage tanks is at such
level as to activate the low water warning system due to excessive
water usage, the Mayor, with the advice and recommendation of the City
Manager and Public Works Director, shall declare that a need for manda-
tory water conservation exists. A Special Meeting of the City Council
shall be called. Upon the City Council's determination that mandatory
water conservation is required, the following provisions shall be
placed into effect;
A. It shall be unlawful for the owner or occupant of any
residence or business to use water for any outdoor
purpose, including but not limited to lawn sprinkling
and vehicle washing; provided, however, that the water-
ing of outdoor vegetation from a hand held hose will be
permitted.
B. In addition to the standard rates for water use in
existence at the time of the declared emergency, there
will be an additional draught surcharge of two dollars
($2.00) per thousand gallons used per month in excess
of ten thousand (10,000) gallons for all residentail
users.
C. The foregoing provisions of this section shall remain
in effect from the day the Mayor declares a need for
mandatory water conservation exists or that a water
emergency exists and shall continue in effect from day
to day until such time that a resolution is adopted by
the City Council at a regular or special called meeting
declaring that the need for mandatory water conservation
or a water emergency no longer exists.
D. An appropriate and fair pro-rata formula will be used
to determine billing rates based on number of days the
mandatory water conservation declaration remains in
effect.
ARTICLE II - SPECIAL PROVISIONS
SECTION I - SAVING CLAUSE
If any section, part or provision of this ordinance is declared
unconstitutional or invalid, then it is expressly provided that all
other parts of this ordinance shall not be affected thereby and shall
remain in full force and effect.

SECTION II - NOTICE OF DECLARATION.
Notice of the declaration placing mandatory water conservation
in effect will be publicised to insure all water users are aware of
the emergency measure being instituted. Each person not complying
shall first be issued a written warning advising of the declaration,
the consequencies of not coming into compliance.
SECTION III - PENALTY
Any person, firm, or corporation who shall violate any of the
provisions of this ordinance shall be guilty of a misdemeanor; and
upon conviction, shall be fined in any sum not exceeding two hundred
dollars ($200), and each and every day the violation continues shall
constitute a separate and distinct offense.
SECTION IV - REPEALING CLAUSE
All ordinances and parts of ordinances in conflict with the terms
of this ordinance are hereby repealed.
