ORDINANCE NO. 9tJ-H-:;"'0
AN ORDINANCE ESTABLISHING AND REGULATING A RABIES - CONTROL
AND ERADICATION PROGRAM WITHIN THE LIMITS OF SCHERTZ; PRE-
SCRIBING THAT THE ANIMAL CONTROL OFFICER WILL PERFORM AS THE
HEALTH AUTHORITY FOR THE PURPOSE OF THIS ORDINANCE; PROVID-
ING FOR REPORTING EXPOSURE TO RABIES; PROVIDING FOR THE
QUARANTINE OF ANIMALS; PROVIDING A SAVING CLAUSE; PROVIDING
A PENALTY; AND PROVIDING A REPEALING CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
ARTICLE I - GENERAL PROVISIONS
SECTION I - HEALTH AUTHORITY. That the Animal Control Officer is design-
ated the Health Authority for the purpose of this Ordinance whose duty
it will be to enforce all provisions of this Ordinance.
SECTION 2 - REPORTS. It shall be the duty of the Animal Control Officer
to report in writing to the City Manager once each month, the total num-
ber of animals impounded, the total number of animals redeemed or sold
to private parties, and the total number of animals humanely disposed of
under the provisions of this ordinance, which report shall be approved
and filed with the City Manager as a monthly report.
SECTION 3 - FEE DEPOSITS. It shall be the duty of the Animal Control
Officer to pay all monies collected by him under the terms of this
Ordinance to the City Tax Assessor/Collector.

"DOG" means any live or dead dog (Canis
"CAT" means any live or dead cat (Felis
"ANIMAL" means any 1 ive or dead mammal,
or wlld.
"WILD STATE" means living in its original, natural
conditlOn; not domesticated. "Wild life" refers to
animals 1 iving in such conditions. "Wild Arlimal" re-
fers to any mammal except the common domesticated
species (dogs, cats, horses, cattle, swine. sheep,
and goats) regardless of state Or duration of cap-
tivity.

ARTICLE II - DOGS, CATS, AND OTHER ANIMALS
SECTION I - REPORTS'OF EXPOSURE'TO'RABIES
(a) A person having knowledge of an animal bite or scratch
or other attack on an individual that the perSon could
reasonably foresee as capable of transmitting rabies,
or of an animal that the person suspects is rabid, shall
report the incident or animal to the Animal Control
Officer of the City of Schertz. This report shall in-
clude the name and address of any victim and @f the
owner of the animal, if known.
(b) The owner of an animal that is reported to be rabid or
to have attacked an individual, or that the owner knows
or suspects to be rabid or to ~ave attacked an individual
shall submit the animal for quarantine to the Animal
Control Officer of the City of Schertz.
(c) The Animal Control Officer shall investigate all reports
filed under this section.

SECTION 2 - QUARANTINE OF ANIMALS. The Animal Control Officer will cause
to have quarantine for at least 10 days any animal that the Officer has pro-
babl~ cause to believe is rabid or has attacked an individual.
(a) If a quarantined animal is found to be rabid, the
Animal Control Officer will cause to have the animal
humanely destroyed. If an animal dies or is destroyed
while in quarantine, the Animal Control Officer shall
remove the head or brain of the animal and submit it
to the nearest Taxas Department of Health laboratory
for testing.
(b) If a quarantined animal is found to be free from
rabies, the Animal Control Officer shall release it
to the owner following the quarantine period if:
(l) the owner has an unexpi red rabi es vacci-
nation certificate for the animal, or
(2) the animal is vaccinated against rabies
by a licensed veterinarian at the owners
expense.
(e) The owner of an animal that is quari;lntined under this
1\ct shall pay the City of Schertz the reasonable costs
of the quarantine and disposition of the animal, and
the City Health Authority may bring suit to collect
those costs, The Animal Control Officer may sell and
retain the proceeds, keep, grant, or destroy an '1nil11al
that the owner or custodian does not take possession
of on or before the 15th day fo 11 owi ng the fo 11 owi ng
day or quarantine. '
ARTICLE III - SPECIAL PROVISIONS
SECTION I - SAVING CLAUSE, Th1\t if any section, part, or provision of
this ordinance 1S declared unconstitutional, or'invalid, then, in that
event, it is expressly provided, and it is the intention of the City
Council in passing this ordinance, that all other parts of this ordi-
nance shall not be affected thereby and shall remain in full force
and effect,
SECTION 2 - PENALTY, That any person who shall violate any of the
provisions of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction therof shall be fined not exceeding $200;00, and
each and every di:\y of such violation shall be deemed a'separate'i\nd
complete offense, '
SECTION 3 - REPEALING CLAUSE. That all ordinances and parts of ordi-
nances in conflict with the terms of this ordinance are hereby repealed,
