79-H-16 ORDINANCE NO. 79-/l-/b AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 4-11 OF SAID CODE; PROVIDING FOR CONTROLLING ANIMALS INVOLVED IN BITE INCIDENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I. That Section 4.11 of the Code of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as follows: "Section 4.11 Controlling animal involved in bite incidents. (a) The Animal Control Officer or any police officer shall direct the owner of the suspect animal involved in a biting incident to have it examined for rabies by a licensed veterinarian within twenty-four (24) hours of the incident and submit proof of examination to the Animal Control Officer. (b) Animals involved in a biting incident for which an owner cannot be readily identified and/or contacted expeditiously, will be impounded. The Animal Control Officer will insure that the animal is examined within twenty-four (24) hours by a veterinarian. The animal shall be confined under positive control for a period of ten (10) days. The animal will be isolated from other animals or possible victims. (c) The Animal Control Officer shall cause all uninnoculated and unlicensed animals involved in a biting incident to be impounded in a suitable facility for a period of ten (10) days at the owners expense. (d) Innoculated animals involved in biting incidents, upon the owners request in writing and the Animal Control Officer's and/or veterinarian's approval, may be con- fined under positive control on the owner's premises isolated from other animals or possible victims. (e) A final examination by the veterinarian at the termina- tion of the ten (10) day quarantine is required and proof of the examination and release shall be furnished the Animal Control Officer.'" , SECTION II. 1 Thatc all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION III. The public importance of this measure constitutes and creates an urgent public necessity requiring that this ordinance be passed and take effect as an emergency measure, and shall take effect and be in force immediately upon and after its passage.
