ORDINANCE NO. '79-E-1.
AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
CALLING AN ELECTION TO BE HELD ON APRIL 7, 1979,
FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEMBERS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
That an election be held in and throughout the City of
Schertz, Texas, on April 7, 1974, for the purpose of electing three (3)
councilmembers for said City to serve for a term of two (2) years. The
councilmembers are to be elected for positions No.3, 4 and 5.
II
That at said election, the candidates recelvlng the highest
number of votes for positions No.3, 4 and 5, respectively, shall be de-
clared elected. Any candidate desiring to have his or her name on the
official ballot of said election shall, at least thirty (30) days prior
to said election day, file with the Mayor an application in writing in
the form prescribed by the Texas Education Code, requesting that his or
her name be placed on the official ballot, and declaring as a candidate
for position No.3, 4, or 5. That any person failing to file said written
application for candidacy by the time aforesaid, shall not be entitled
to have his or her name printed on the official ballot. That the names
of all eligible candidates whose applications have been duly and timely
filed shall be placed on the ballot pursuant to a drawing as provided
by 1 aw.

That all qualified voters of said City shall be entitled
to vote in said election.
IV
That the polling place for the holding of said election shall
be at the Schertz Community Center, 1400 Live Oak Road, Schertz, Texas;
and the entire City of Schertz, Texas, for the purpose of holding said
election shall be and constitute one municipal election precinct.
Mrs. Janestine Kvapil is hereby appointed Presiding
Judge of said election, and Adolph Aguilar
is hereby appointed Alternate Presiding Judge of said election.
V
That the Presiding Judge of said election shall appoint as
many resident qualified electors of said City to serve as clerks in said
election as shall be reasonably necessary to conduct said election, with
the appointment of such clerks to include the Alternate Presiding Judge
if he/she be present for the holding of said election. The Presiding
Judge shall appoint a person fluent in the Spanish language to serve as a
clerk of said election to render oral aid in the Spanish language to any
voter desiring such aid at the poll on the day of the election. In the
absence of the Presiding Judge above named, the Alternate Presiding Judge
shall perform the duties of the Presiding Judge of said election.
VI
That absentee voting in said election shall be conducted
at the Municipal Office, 1400 Live Oak Road, Schertz, Texas, and the
City Secretary is hereby charged with the duty of conducting absentee
voting in said election as required by law. The City Secretary shall
appoint a Deputy Absentee Voting Clerk who is fluent in the Spanish
language to render oral aid to any voter desiring to vote absentee in
said election who requests such aid.
That with the exception of Saturdays, Sundays, and offi-
cial State holidays, the Municipal Office shall remain open from 8:30
o'clock a.m. to 4:30 p.m. for the purpose of conducting absentee voting
for said election.
VII
That the polls of said election on the day of said election
shall be open from 7:00 o'clock a.m. to 7:00 o'clock p.m.
VIII
That the ballots to be used in said election shall be prepared
in conformity with VATCS Election Code, as amended. That in the holding
and conducting of said election, voter forms, instructions, and other
materials required therefor, including the ballots, shall be in both
the English and Spanish languages~
IX
Notice of said election shall be given in accordance with
the provisions of Article 4.05, Texas Election Code.

That the City Secretary is hereby authorized and directed
to post notice of said election, on both the English and Spanish languages,
on a bulletin board at the Schertz Community Center (the polling place
for the holding of said election) and at two (2) other public places
within said City, all of which notices shall be posted at least twenty
(20) days prior to the date set for the election.
XI
That the City Secretary is further authorized and directed
to cause notice of said election to be published, in both the English and
Spanish languages, one time not more than twenty-five (25) nor less than
ten (10) days prior to the date set for the election, in a newspaper of
general circulation in the City of Schertz, Texas.
