82-H-9 ANIMAL LICENSE

AN ORDINANCE
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF
~ SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTIONS
4~35 AND 4~37; PROVIDING A CHARGE FOR DOMESTIC
ANIMAL LICENSES; REPEALING ORDINANCE 79-H-l;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION I.
Section 4-35 of the Code of Ordinances of the City of Schertz, Texas
be amended so that such section shall read as follows:
"Section 4-35.
Issuance
There is hereby fixed and assessed as a police regulation for
the protection of the public health a license fee of $2.00
per annum against the owner or keeper of each and every dog
or cat kept in the City of Schertz. The license shall run
from January 1 of each year to December 31 of the !same year,
and any license purchased after September 30 of said license
year shall have a license fe~of $1.00 for each license issued,
said prorata license to expire at the end of the current license
year."
SECTION I I.
Section 4-37 of the Code of Ordinances of the City of Schertz, Texas
be amended so that such section shall read as follows:
"Section 4-37. License Tags .
a. It shall be the duty of the Animal Control Officer to
provide suitable numbered tags for dogs and cats.
b. Upon presentation of the rabies vaccination certificate
as required in Section 4-35~ the Animal Control Officer
shall supply to each applicant a tag which shall be
affixed to a collar around the dog's or cat's neck and
\ i worn at all times during the currency of such license.
It shall be unlawful for any person to keep any dog or
cat within the city, unless the license tag is fastened
to such animal at all times, as required by this section.
c. It shall be unlawful for any person to use any license
tag upon a dog or cat, except the tag adopted and issued
by the city pursuant to this section.
d. It shall be the duty of the owner or keeper of any dog
or cat to procure a duplicate tag(from the Animal Control
Officer in the event that the original tag issued under
this section is lost or destroyed. The Animal Control
Officer shall issue a duplicate tag upon application of
any person who has complied with the provisions of this
section."
SECTION III,
All ordinances or parts of ordinances, specifically No. 79-H-l
referring to license fees, are hereby repealed.
SECTION IV.
The public importance of this measure constitutes and creates
an urgent public necessity requiring that this ordinance be passed
and take effect as an emergency measure, and shall take effect and
be in force immediately upon and after its passage.
