The Schertz Planning and Zoning Commission convened on June 11, 2014 at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building 44, Schertz, Texas.

CONSENT AGENDA
A. Minutes for May 14, 2014 and May 28, 2014 Regular Meeting
Mr. Braud asked to consider 4B separately, and Mr. Richmond has a question on 4C. These items
were pulled out of the consent agenda.
Mr. Brand moved to approve both set of minutes as presented. Mr. Crawford seconded the motion.
Vote was 4 -0. Motion carried.
B. PC2014 -021
Consider and act upon a request for approval of a final plat of the Riata Subdivision Units
5A & 5B, an approximately 14 acre tract of land situated in the Rafael Garza Survey,
Abstract No. 138, City of Schertz, Guadalupe County, Texas, generally located on Fairlawn
Avenue approximately 1,300 feet south of the intersection of Fairlawn Avenue and IH -35
Frontage Road.
Mr. Cox presented this item by stating that the applicant is proposing to final plat approximately 14
acres of land establishing 66 residential lots with a minimum lot size of 6,600 square feet. The

property is zoned Single Family Residential District — 7 (R -7). This application was reviewed
under UDC, Ordinance 96 -5 -28, as amended. Staff recommends approval of the final plat.
Mr. Brand asked to see the Preliminary Plat. Ms. Wood showed Mr. Brand the Preliminary Plat.
Mr. Brand stated that the Preliminary Plat was approved in 2006 and he wasn't on the Commission
and wanted to review it before voting and had no further questions.
Mr. Greenwald moved to approve this item as presented. Mr. Brand seconded the motion. Vote
was 4 -0. Motion carried.
C. PC2014 -029
Consider and act upon a request for approval of a final plat of Cypress Point Subdivision
Unit 3, an approximately 23 acre tract of land situated in the C.M. Gahagan Jr. Survey No.
258, Abstract No. 142 and Abstract No. 182, City of Schertz, Guadalupe County and Comal
County, Texas and located southwest of the intersection of Eckhardt Road and Froboese
Lane.
Mr. Cox presented this item by stating that the applicant is proposing to final plat approximately 23
acres of land establishing 83 single family residential lots, two (2) drainage lots, and one (1)
landscape lot. The zoning for Unit 3 is Single Family Residential District -6 (R -6) with a minimum
lot size of 7,200 square feet. Staff recommends approval of the final plat.
The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9
Tree Preservation and Mitigation. A tree survey with a tree mitigation and preservation plan was
submitted and reviewed by the Parks and Community Services department. The tree survey
identifies a total of thirty one (3 1 ) protected and five (5) heritage size trees on the site totaling five
hundred and forty eight inches (548 "). Twenty one (21) protected and three (3) heritage size trees
totaling three hundred and thirty three inches (333 ") will be removed. All trees being removed are
tree species that are exempt from mitigation. No mitigation fees are due with this final plat
application.
Mr. Richmond stated that the Commission seldom sees something under Tree Mitigation, and he is
concerned about the size of trees we are exempting in this agenda item. It appears the exemption is
due to specified tree species. Mr. Cox showed on the overhead the list of trees which would be
removed and would remain. Mr. Richmond asked for a review by the Planning and Parks and
Community Services Departments to ensure suitable trees are being mitigated.
Mr. Crawford moved to approve this item as presented. Mr. Brand seconded the motion. Vote
was 4 -0. Motion carried.

Mr. Richmond stated that he attended a meeting with the City Manager, the Cite
Attorney, and the Mayor regarding alternates on the Commission; and he suggested no
alternates are required at this time.
Mr. Greenwald asked whether taking the Open Meetings. Act training because of
reappointment is required. Mr. James stated that he will advise at the next meeting.
