CALL TO ORDER/ROLL CALL Mr. Evans called the meeting to order at 6:00 P.M. HEARING OF RESIDENTS • No one spoke. CONSENT AGENDA A. Minutes for July 23, 2014 Regular Meetings. B. PC2014 -035 Consider and act upon a request for approval of a final plat of Cypress Point Subdivision, Unit 4. The property is approximately a 19 acre tract of land situated in the C.M. Gahagan Jr. Survey No. 258, Abstract No. 142, Guadalupe County and Abstract No. 182, Comal County, City of Schertz, Texas and located on Eckhardt Road approximately 1000 feet south of the Froboese Lane. Mr. Crawford moved to approve the consent agenda. Mr. Greenwald seconded the motion. Vote was 4 -0 -1 with Mr. Dahle abstaining. Motion carried. PUBLIC HEARING A. PC2014 -019 Hold a public hearing, consider and act upon a request for approva Kensington Ranch Estates Subdivision, Unit 1. The property consists of acres of land and is more specifically described as being situated in the Survey No.68, Abstract No. 153, City of Schertz, Guadalupe County, Texas. Minutes Planning and Zoning Commission August 13, 2014 Page I of 5 I of a replat of approximately 8 Toribio Herrera Mr. Cox presented this item by stating that the Applicant is proposing to replat Block 18, Lot 1 of Kensington Ranch Estates Subdivision Unit 1 into seventeen (17) buildable lots and seven (7) common open space /drainage lots. The property is located in the Kensington Ranch Estates Planned Development District zoning. A public hearing notice was published in "The Daily Commercial Recorder" on July 28, 2014 and in the "Herald" on July 30, 2014. There were twenty nine (29) notices mailed to surrounding property owners on July 25, 2014. At the time of this meeting fourteen (14) responses from property owners within the 200 foot notification boundary were received, twelve (12) responses were opposed to the request, two (2) responses were in favor of the request, and no responses were neutral to the request. Additionally twenty -eight (28) responses were received from neighborhood residents outside of the notification area, and all twenty -eight (28) were opposed to the request. The Kensington Ranch Estates Planned Development District (PDD) zoning was approved by City Council on September 16, 2005. The master development plan was amended on February 10, 2010 to allow drainage channel right -of -way dedication and the addition of seventeen (17) lots to Unit 1. The master development plan was amended a second time on August 10, 2011 to adjust the road alignment and phasing for Unit 3. The final plat for Unit 1 was approved by the Planning and Zoning Commission on March 14, 2006. The Unit 1 plat was amended on January 12, 2012 to provide a variable width drainage right -of -way. The subject property is generally located on the west side of the intersection of Savannah Drive and Round Creek. The lot is currently undeveloped. The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. A tree survey with a tree mitigation and preservation plan was submitted and reviewed by the Parks, Recreation and Community Services department. Fourteen (14) protected size trees will be removed requiring one hundred and fifty nine inches (159 ") of mitigation or a fee in lieu in the amount of $15,900. Mitigation or payment will be required prior to recording the replat. No public parkland has been dedicated with this subdivision. The Parks, Recreation and Community Services Department has determined that a fee in lieu of parkland dedication in the amount of $1000 per dwelling unit, $17,000 total, will be paid by the Developer prior to recording of the final replat. The site is serviced by Schertz water and sewer, GVEC, AT &T, and Time Warner Cable. The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. The City Engineer has reviewed and approved a storm water plan for this replat. Sidewalks will be constructed along both sides of the street along Sunset Ridge and Willows Ranch. Savannah Drive is built to its ultimate design and no improvements are required. Additionally, in accordance with the approved master development plan, the stub out section of Irish Creek Road is being dedicated as Right -of -Way but will not be constructed. The subject lot was located in the 100 year floodplain when the original Kensington Ranch Estates PDD was approved. Through CLOMAR/LOMAR studies and drainage channel improvements a large portion of Block 18, Lot 1 was brought out of the 100 year floodplain. In 2010 the Master Development Plan was amended to include seventeen (17) additional lots where Block 18, Lot 1 currently exists. The Unit 1 plat was amended in 2012 to provide right -of -way dedication for the Minutes Planning and "Zoning Commission August 13, 2014 Page 2 of 5 drainage channel that runs along the east side of Unit 1 The replat is consistent with applicable requirements for the property, ordinances and regulations. This application was reviewed under UDC 11 -S -15. Staff recommends approval. Mr. Greenwald asked Mr. Cox to explain CLOMAR/LOMAR. Mr. Cox stated that these are extensive studies that show proof that the areas have been removed from the floodplain so the FEMA maps can be revised. Mr. Guerrero, representing Pulte, stated that he was there to field any questions. Ms. Woods clarified that this is a replat, and not a discretionary item and as long as everything complies with state law and the UDC, the Commission has the obligation to review it and approve it. Mr. Evans opened the Public Hearing at 6:12 P.M The following made comments: • Jill Moore, 3534 Woodlawn Farms, spoke that she was told that this would be open land. • Amy Nickson, 3608 Woodlawn Farms, spoke that she was told by Centex that nothing would be there. • Freddie Nickson, 3608 Woodlawn Farms, asked a question if Pulte will buy their house back since they were told that there would be nothing there. • Tianda Sherrell, 3536 Woodlawn Farms, spoke on plans to include a new street. Mr. Guerrero stated that Pulte will put up the same quality product that they have been building, the original MDP was approved in 2010 showing these lots and not changing anything, and a park is planned in 2015 in another section of the neighborhood. Mr. Dice, with Cude Engineering representing Pulte, stated that the HOA covers a much larger area in Selma and Schertz and all residents will have the benefit of common improvements, which will include a kid's play area, playscape, and soccer field. Mr. Evans asked if the park will be in the Selma City limits, but belong to the subdivision. • Jill Moore, 3534 Woodlawn Farms, asked who is building the park. Mr. Guerrero stated that the park is currently being developed to deliver in 2015 complying with all open space requirements of the City. Mr. James stated that we want to give an opportunity to everyone to speak. • Judy Tsai, 3528 Irish Creek, spoke on the flood zone and FEMA map. • Amanda Micklos, 3512 Irish Creek, spoke on this area being a common land area. • Stephanie Westbrook, 3500 Enchanted Farm, spoke on the need to come out on Savannah to make your way to the park. • Lawrence Armstrong, 3529 Irish Circle, spoke on why he and his wife like the Schertz area. • Inez Eisazadeh, 3512 Woodlawn Farms, spoke on their lot based on questions to Centex. • James Price, 3509 Big Horn Trail, spoke on statements from Benchmark and residents in Minutes Planning and Zoning Commission August 13, 2014 Page 3 of 5 Savannah Bluff. • Pamela Richmond, 3522 Woodlawn Farms, spoke of living in a Pulte home at Scenic Hills. • Mike Carrillo, 4444 Fawn Pass, spoke on being misled by Benchmark. Mr. Evans closed the Public Hearing at 7:00 P.M. Mr. Crawford asked Ms. Moore to show the pictures of the 2009 flooding. Mr. Evans stated that the photos show where the culvert water drains to Schertz Parkway, and that the entry into the creek had been blocked and has been corrected. Mr. Brand asked Mr. Dice if the area proposed for the park is in Selma or Schertz. Mr. Dice answered that it is in the City of Selma and will be an HOA park. Mr. Brand asked about access to the HOA park. Mr. Dice answered that access would be through a public right -of -way and sidewalks. Discussion followed between Staff, the Applicant and the Commission. Mr. Greenwald moved to approve this item as presented. Mr. Braud seconded the motion. Vote was 5 -0. Motion carried. B. PC2014 -044 Hold a public hearing, consider and act upon a request for approval of a replat of Enterprise Industrial Park Subdivision. The property consists of approximately 110 acres of land and is more specifically described as being a portion of the Vicente Micheli Survey No. 114, Abstract No. 383, and a portion of the G.M. Dolsou Survey No. 96, Abstract No. 20, City of Schertz, Comal County, Texas. Mr. Cox presented this item by stating that the Applicant is proposing to replat Block 1, Lot 1 of Enterprise Industrial Park Subdivision Unit 1 into two (2) buildable commercial lots. The new lots being created are Lots 3 (18.67 acres) & 4 (90.402 acres). The property is zoned Manufacturing Light (M -1). A public hearing notice was published in "The Daily Commercial Recorder" on July 28, 2014 and in the "Herald" on July 30, 2014. There were thirteen (13) notices mailed to surrounding property owners on July 25, 2014. At the time of this staff report four (4) responses from property owners within the 200 foot notification boundary were received, all four (4) responses were in favor of the request. The final plat of Enterprise Industrial Park Subdivision was approved on May 28, 2008 by the Planning and Zoning Commission. The plat was amended on August 30, 2013 to adjust the lot line between Lots 1 & 2, add a fourteen foot (14') CPS easement and correct the FEMA floodplain. The subject property is generally located on the north side of the intersection of Schertz Parkway and Lookout Road. The subject property is currently undeveloped. This development is designed to have two (2) points of access off of Lookout Road through variable width ingress - egress easements. The tree affidavit submitted indicates that there are no protected or heritage trees on the site. The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. The City Engineer has reviewed and approved a storm water plan for the subject tract. No roadway improvements or ROW dedications are required. There was no comment by the Applicant. Mr. Evans opened the Public Hearing at 7:26 P.M. There being no one to comment, Mr. Evans closed the Public Hearing at 7 :26 P.M. Mr. Evans asked for clarification on the plats, and does not see lot 2. Mr, Cox stated that 2 lots were originally platted. Lot- 2 as it is today, and lot I will not exist any longer. Lot 3 will be approximately the same size as existing lot 2, and the remaining area will be lot 4. Mr. Crawford asked why this is being done this way. Mr. Gerber stated that the first lot was sold to Weeks Robinson who is developing a 350,000 square foot industrial building. The second lot also is being sold to Weeks Robinson who is developing a similar building. In the long term, they are not sure how the remaining property will be built out so they decided that the best solution was to replat when a buyer is known. Discussion followed between Staff and the Commission. Mr. Dahle moved to approve this item as presented. Mr. Crawford seconded the motion. Vote was 5 -0. Motion carried. k.
