Schertz II which is approximately 103 acres and is zoned Residential Agriculture (RA). The
subdivision is proposed to develop in four (4) phases with 127 single family residential lots. A
master plan for this site was approved by the Planning and Zoning Commission on April 9, 2014.
According to UDC Sec. 21.12.6.F.2 major amendments require resubmittal and approval of a new
master plan application. The proposed master plan has increased the total number of lots from 121
to 127. The increase in density with the addition of these six (6) lots constitutes a major
amendment.
This development is designed to have three (3) points of access via Ivy Jet through the adjacent
subdivision The Reserve at Schertz via N. Graytown Road, and two points of access from Boenig
Drive. This site is serviced through 8" water lines and 8 "> sewer lines that will be extended
throughout the subdivision. Sewer service will be provided by the San Antonio River Authority
(SARA) who holds the certificate of Convenience and Necessity (CCN) for this site. Water service
will be provided by the City of Schertz. The applicant will be responsible for complying with
Unified Development Code (UDC), Section 21.99 Tree Preservation and Mitigation at the final
plat. The Developer has started discussion with Staff for an agreement for pump and haul.

James stated that we do not have an agreement with San Antonio, and will coordinate the
infrastructure with San Antonio. Mr. Crawford asked if the City has a liability with the pump and
haul. Mr. James stated that the developer will enter into an agreement with SARA and the City
and require them to put in monies in escrow in case something happens.

The City's Master Thoroughfare Plan (MTP) jdesignates a proposed north/south collector identified
as Lazar Parkway (86' ROW) that stretches from Lower Seguin Road to IH 10. A portion of the
proposed thoroughfare that is adjacent to the subject property is proposed to be dedicated at the
time of platting for each Unit of this subdivision. No portion of Lazar Parkway to the south has
been constructed due to rough proportionality, although the ROW has been dedicated. The MTP
also proposes an expansion of the existing Graytown Road (60' ROW) to an 86' ROW. The
applicant is providing the 13' dedication for Graytown Road which is proposed to be dedicated at
the time of platting for each Unit of this subdivision. Boenig Road is a City street not identified on
the MTP and would be considered a collector street. In accordance with the UDC, a collector
street in the City is a 60' ROW with 42 feet of pavement which includes curb and gutters. The
Boenig Road ROW is currently sub - standard. The applicant is proposing to provide variable width
ROW dedication along Boenig Drive adjacent to the subject property. The variable width
dedication includes 10' ROW dedication along the majority of Boenig Drive with the exception of
the curve areas along Boenig Drive where the dedication varies.
In order to determine if the required improvements are roughly proportional, Staff and the
applicant have agreed to utilize the City of San Antonio's methodology for evaluating rough
proportionality. Staff recommends approval of the waiver request for The Reserve at Schertz Il
subdivision, Unit 1 based on the calculations provided by the applicant for rough proportionality.
The developer will be dedicating the necessary right -of -way.
Mr. Dahle asked about the work sheet calculations, leaving $22,800 on the table. Mr. James stated
that we do not have an ordinance and this may come in over or under the amounts calculated. Mr.
Dahle stated that we do not have the proper ordinance in place to properly collect monies for the
citizens.

Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat
approximately 29 acres of land establishing 36 single family residential lots with a minimum lot
size of 21,780 square feet and 25' building setbacks 'on, all sides dictated by the zoning district.
This development is designed to have two (2) points of access off of Boenig Drive. While the
applicant is requesting a waiver to not improve Boenig Drive, it still provides a point of access in
its existing condition to the subdivision. The applicant has submitted a Tree Affidavit for this unit,
which indicates that there are no protected or heritage trees on the site. The tree mitigation and
preservation plan will be reviewed by Parks and Community Services department prior to approval
of the final plat.
There is no parkland being proposed with this subdivision. The Parks, Recreation and Community
Services Department has determined that a fee -in lieu of parkland dedication in the amount of
$1000 per dwelling unit will be paid by the Developer "prior to recording of the final plat. All
public improvements required for this subdivision are required to be installed prior to recording of
the final plat of each Unit. This site is serviced through 8" waterlines and 8" sewer lines that will
be extended throughout the subdivision. Sewer service will be provided by the San Antonio River
Authority (SARA) who holds the certificate of Convenience and Necessity (CCN) for this site.
Water service will be provided by the City of Schertz.
The applicant is responsible for all drainage associated with the subject property, and for
compliance with the Storm Water regulations. A drainage report has been reviewed and approved
by the City Engineer. The subdivision will be providing onsite detention. Sidewalks will be
constructed along both sides of the street throughout the subdivision and along Boenig Drive. All
sidewalks will be designed to meet the City of Schertz specifications. The subject property is
affected by the additional design requirements of the UDC, Section 21.14.3. along Lazar Parkway
to include landscaping buffers and screening. An 8' masonry screening wall will be constructed
along both sides of Lazar Parkway at the rear of each residential lot at the time of development.
Two landscape buffer lots (Lot 11, Block 19 and Lot 1, Block 18) adjacent to Lazar Parkway have
been provided with this plat.
Staff recommends approval of the preliminary plat.

office.

approved the issuance of obligation of bonds for the south Schertz sewer plant.

Waiver related to two (2) points of access.
The applicant is seeking a waiver to UDC, Article 14, Section 21.14.11. Public Accesses which states that all
residential subdivisions shall have a minimum of two (2) locations accessing existing public streets. Access
may be provided through the construction of a public street. The extent and location of all accesses is subject to
review and approval by the City. The Planning and Zoning Commission shall not permit "island" subdivisions,
lots or streets that would be surrounded by the flood water of a one hundred (100) year flood unless the area is
accessible to high ground by at least one dedicated street elevated above the one hundred (100) year flood
level.
The subject property has access to a Schertz Parkway through the dedication of ROW for the construction of
the extension of Live Oak Road. This development is designed to have two (2) points of access through the
extension of Live Oak Road and via the construction of a thirty (30) foot emergency access through the
Cottonwood 11 Subdivision to Schertz Parkway. The MTP identifies Live Oak Road being extended from the
intersection at Schertz Parkway northwest along the edge of the Dietz Creek and intersecting with Maske Road.
The applicant is seeking a waiver to the UDC, Section 21.12.1,E to the provision which requires a minimum of
two (2) points of access locations accessing existing public streets and allow the thirty (30) foot emergency
access easement to serve as a second access point until the extension of Live Oak Road from the limits of the
Bindseil Subdivision to Maske Road is constructed.
The request has been reviewed by Planning, Engineering, Public Works and Fire with no objections. Staff is
recommending approval of the waiver to the minimum two (2) points of access locations accessing existing
public streets based on the following:
The Fire Department has reviewed the request has indicated that the 60' Live Oak ROW, which has no
lots fronting the ROW, provides the necessary emergency access along with the construction on the
30' emergency access.
The only frontage this property has to an existing public street is through the dedication of ROW for the
Live Oak Road extension and existing Dietz Creek Channel.

which states that Dead -end streets shall be prohibited, except as short stubs projected to be continued in future
subdivisions in conformance with Paragraph C of this section when designed as cul -de -sacs. Temporary
turnarounds shall be provided on projected streets until such time as they are extended.
Paragraph C as referenced above states the following: Projection of Streets - When adjoining properties are
not yet subdivided, the arrangement of streets shall provide for the proper projection of streets into the adjoining

unsubdivided areas, and will be required to comply with the neighborhood pattern or conform to the
Comprehensive Land Plan.
The subject property is adjacent to the proposed extension of Live Oak Road and the Master Thoroughfare
Plan (MTP) identifies Live Oak Road being extended from the intersection at Schertz Parkway northwest along
the edge of the Dietz Creek and intersecting with Maske Road.
The applicant is proposing to dedicate and construct the extension of Live Oak Road from Schertz Parkway to
the limits of the Bindseil Farms Development. A projection is being provided to the adjacent property to the
west without the required temporary turnaround.
The request has been reviewed by Planning, Engineering, Public Works and Fire with no objections, Staff is
recommending approval of the waiver to allow a dead end street based on the following:
• Live Oak Road is being dedicated and constructed to the limits of the development and all lots are
proposed to have access /frontage to other constructed public streets throughout the subdivision.
• No lots front Live Oak Road and as such all public services such as postal service, garbage service
and emergency services will access properties through the constructed local streets throughout the
subdivision.
• The Fire Department has reviewed the request and has no objection to the proposed dead end street.

COMMISSIONERS CRITERIA FOR I TI
In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its
opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and
Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest.
In making their findings, the Planning and Zoning Commission shall take into account the nature of the
proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will
reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and
upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the
Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of
other land in the area in accordance with the provisions of this UDC. Such findings of the
Planning and Zoning Commission, together with the specified facts upon which such findings
are based, shall be incorporated into the official minutes of the Planning and Zoning
Commission meeting at which such waiver is granted. Waivers may be granted only when in
harmony with the general purpose and intent of this UDC so that the public health, safety, and
welfare may be secured and justice done.
b. The Planning and Zoning Commission may establish a time period for execution of each granted waiver.
C. Such findings together with the specific facts on which such findings are based shall be incorporated into the
official minutes of the Planning and Zoning Commission meeting at which such exception is granted.
Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law,
ordinance, code or regulation of the City.
D. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may
be appealed to the City Council. When considering an appeal, the City Council shall consider the same
standards as the Planning and Zoning Commission as outlined above.

BACKGROUND:
This preliminary plat was tabled at the September 10, 2014 Planning and Zoning Commission meeting
at the request of Planning Staff,
A master plan for the subject property was approved by the Planning and Zoning Commission on May 24,
2005. The Commission approved the preliminary plat for Unit 1 on April 25, 2007 and the final plat was
approved on July 25, 2007. The approved final plat expired ► July 25, 2009. A new master plan and
preliminary plat for this subdivision was approved by the Commission on October 12, 2011. The master pl

is Single Family Residential District-7 (R-7) with a minimum lot size of 6,600 square feet, Side yard setbacks
are established at ten feet (10'),
GEITERAL LOCATION AND SITE DESCRIPTION: The subject property is located generally southwest of tfTe
intersection of Live Oak Road and Schertz Parkway.
ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum
of two (2) locations accessing existing public streets. This development is designed to have two (2) points of
access through the extension of Live Oak Road and via a thirty (30) foot emergency access easement through
the Cottonwood II Subdivision to Schertz Parkway, The Master Thoroughfare Plan (MTP) identifies Live Oak
Road being extended from the intersection at Schertz Parkway northwest along the edge of the Dietz Creek
and intersecting with Masee Road. Until the remaining portion of the Live Oak Road extension is completed the
thirty (30) foot emergency access easement will serve as an emergency access point. The applicant is seeking
a waiver to the minimum two (2) point of access.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted
indicates that no protected or heritage trees will be removed from this site. The tree mitigation and preservation
plan will be reviewed by Parks and Community Services department prior to approval of the final plat.
PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community
Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per
dwelling unit will be paid by the Developer prior to recording of the final plat. This application was reviewed
under UDC, Ordinance 11 -S -15 with amendments.
PUBLIC SERVICES: The site is serviced by Schertz water and sewer, GVEC, CenterPoint Energy, AT &T, and
Time Warner Cable,
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement. The civil construction plans must be reviewed and approved by the Public Works and
Engineering Departments prior to approval of the final plat.
Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended
throughout the subdivision.
Drainage: The applicant is responsible for all drainage associated with the subject property and for compliance
with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer,
The City Engineer has granted a waiver to onsite detention based on storm water calculations proving that
there is no adverse effect created by releasing storm water into the Dietz Creek channel. Additionally,
approximately 10 acres of drainage ROW will be dedicated to the City for improvements to the channel.
Sidewalks, Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the
subdivision and along the Live Oak Road Extension. All sidewalks will be designed to meet the City of Schertz
specifications.
Road Improvements: All streets will be developed to City of Schertz specifications. A 60' ROW dedication has
been provided for the extension of Live Oak Road from Schertz Parkway to the limits of the proposed
subdivision. Construction plans for all public improvements will be submitted and approved by Public Works
and Engineering prior to approval of the final plat.

STAFF ANALYSIS AND RECOMMENDATION:
The preliminary plat is consistent with applicable requirements for the property, ordinances and regulations.
Staff recommends approval of the preliminary plat with the condition that the proposed 30' emergency access is
constructed prior to recording the final plat.
