The Planning and Zoning Commission will hold a public hearing related to zone change requests and replats within this agenda. The public

other interested persons. Upon completion, the public hearing will be closed. The Commission will discuss and consider the application, and
may request additional information from staff or the applicant, if required. After deliberation, the Commission is asked to consider and act

Consider and act upon a request for approval of a waiver regarding an on -site sewage facility
for Block 1, Lot 15, of Randolph Commercial Park Subdivision, an approximately one (1)
acre tract of land generally located on Lower Seguin Road approximately 1800 feet northeast

Mr. Cox presented this item by stating that the Applicant is proposing to final plat approximately
one (1) acre of land establishing one (1) commercial lot. The subject property is zoned
Manufacturing -Light (M -1). The applicant is seeking approval of a waiver to install an on -site

Commercial Park Subdivision, an approximately one (1) acre tract of land generally located
on Lower Seguin Road approximately 1800 feet northeast of the intersection of Lower Seguin
and Loop 1604.

one (1) acre of land establishing one (1) commercial lot. The subject property is zoned
Manufacturing -Light (M -1). The Planning and Zoning Commission approved the master plan on
April 27, 2011 and subsequently approved an amended master plan on October 26, 2011. A
preliminary plat for the entire 23 lot subdivision was approved on March 14, 2012 by the Planning
and Zoning Commission. A six month extension for the preliminary plat was granted on March
12, 2014 by the Planning and Zoning Commission and expires on September 14, 2014.
The subject property has frontage on Lower Seguin Road and has an existing 50 -foot egress and
ingress easement which will provide future cross access and circulation to adjacent lots. The
applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9
Tree Preservation and Mitigation. The tree affidavit submitted indicates that no protected or
heritage trees will be removed from this site. This site will be serviced through an 8" water line
that will be extended down Lower Seguin Road. This site is not currently serviced by a public
wastewater system and the applicant has requested a waiver to allow the lot to be served by an On-
site sewage facility (OSSF). The applicant will construct all improvements along Lower Seguin
Road including curbs, gutters and sidewalks designed to meet the City of Schertz specifications.
Staff recommends approval of the final plat.
Mr. Greenwald moved to approve this item as presented. Mr. Crawford seconded the motion. Mr.
Braud questioned if there is water now, , Mr. Cox stated that the applicant will extend water. Ms.
Sanchez stated that Schertz water comes from the adjacent property known as the Tates property.
Mr. Brand asked what is Canyon Regional Water. Mr. Greenwald stated that it was an entity that
Schertz belonged to many years ago along with many other cities. There was no further discussion
and Mr. Richmond called for a vote. Vote was 6 -0. Motion carried.
C. PC2014- 027'Bindseil Farms — Preliminary Plat
Consider and act upon a request for approval of a preliminary plat of the Bindseil Farms
Subdivision, an approximately 34 acre tract of land situated in the Toreiba Herrera Survey
No. 68, 'Abstract No. 153; G. Malpez Survey! No. 67, Abstract No. 221, City of Schertz,
Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road
and Schertz Parkway.
Mr. Cox stated that Staff realized after posting the agenda that an additional waiver needs to be
processed in order for this plat to meet the City requirements for subdivisions, and Staff is asking
the Commission to table this item until the next meeting.
Mr. Dahle moved to table this item until the next meeting. Mr. Brand seconded the motion. Vote
was 6 -0. Motion carried.''

• Mr. Greenwald stated that he attended the Cibolo City Council meeting with a
workshop session that explained the size of development and the status of water. He
thinks they will coming to the SSLGC for water and that shouldn't be a problem.
• Mr. Crawford stated that he attended a three day Texas Floodplain seminar in San
Antonio this past week with all four of our Floodplain Managers.
C. Announcements by City Staff.
• Ms. Sanchez stated that septic with lot sizes discussion will be at the next meeting.
• Ms. Sanchez stated that SchertzFest will be September 19a' and 20' and that they need
judges for the BBQ. If you want to volunteer, please let her know.
• Ms. Sanchez stated that Staff is still looking into the TxDot billboard question.
• Ms. White stated that the APA Conference information has been distributed to those
Commissioners who are attending.
• Ms. Sanchez stated that there were 3 site plans received during August 25, 2014 through
September 5, 2014.

BACKGROUND: A final plat for this subdivision establishing 138 lots was approved by the Planning and
Zoning Commission on November 21, 2013. The public infrastructure for this site is currently under
construction.
ITEM SUMMARY: The applicant is proposing to final plat approximately 59 acres of land establishing 125
single family residential lots of three (3) different minimum sizes: 5,400 square feet, 6,000 square feet, and
7,200 square feet as dictated by the Rhine Valley PDD (Ordinance 13- S -37).

The site is zoned Planned Development District (PDD). This final plat was reviewed using the Rhine Valley
PDD (Ordinance 13 -S -37) and the UDC, Ordinance 11 -S -15, as amended.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and located
generally 2,200 ± feet east of the intersection of FM 1518 and Lower Seguin Road.
ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum
of two (2) locations accessing existing public streets. This development is designed to have two (2) points of
access via Lower Seguin Road and Ray Corbett Drive.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. According to the tree survey the
site contained twenty two (22) protected trees and six (6) heritage trees. Twenty (20) protected trees and two
(2) heritage trees have been removed requiring one hundred and fifty seven inches (157 ") of mitigation or a fee
in lieu mitigation in the amount of $15,700. Mitigation fees in the amount of $15,700 were paid in association
with site clearing and grading permit in February 2014.
PARKS: A five (5) acre public park is being dedicated for this subdivision. This parkland dedication and the
proposed improvements have been recommended for acceptance by the Director of Community Services and
the Parks Advisory Board. The Planning and Zoning Commission recommended acceptance of this park with
the approval of the Rhine Valley PDD, Master Plan and Preliminary Plat. Parkland improvements must be
completed prior to recording the final plat per UDC section 21.9.10.G Park Development.
PUBLIC SERVICES: The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement. The civil construction plans have been reviewed and approved by Public Works and
Engineering.
Water and Sewer: This site will be serviced through 8" water lines and 8" sewer lines that will be extended
throughout the subdivision and stubbed for future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. Drainage report has been reviewed and approved by the City Engineer. The
subdivision will provide onsite detention.
Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the
subdivision and along Ray Corbett Drive and Lower Seguin Road. A meandering, all weather, hike and bike trail
will be constructed within the parkland area. All sidewalks are designed to meet the City of Schertz
specifications.
Road Improvements: All streets will be developed to City of Schertz specifications. Unit 1 is located adjacent
to Ray Corbett Drive. The applicant is extending Ray Corbett Drive (60' ROW) approximately 443 linear feet to
provide an access point to the subdivision. Improvements to Lower Seguin Road will be constructed in
accordance with City standards, along the length of the proposed plat. Construction plans for all public
improvements have been submitted and approved by Public Works and Engineering.

The purpose of this new final plat is to remove 13 lots from Unit 1 that have frontage on streets that stub out to
the future phases of the Rhine Valley Subdivision and create the need for a temporary turnaround. The removal
of these lots will eliminate the need for 5 temporary turnarounds. These 13 lots will be included with the future
adjacent phases of this subdivision.

The final plat is consistent with applicable requirements for the property, ordinances and regulations. It has
been reviewed by the City Engineer, Public Works, Parks, Inspections, and Fire with no objections. Staff
recommends approval.

SUBJECT: Hold a public hearing, consider and make a recommendation on an
amendment to Part III, Schertz Code of Ordinances, Unified
Development Code (UDC), Article 5 and 10 of the City of Schertz
Unified Development Code (UDC) to create the Main Street Mixed Use
Zoning District.
GENERAL INFORMATION:
The recent Gateway Plan amendments to the City of Schertz Comprehensive Plan discuss
ways to promote redevelopment within the Historic Downtown area of Schertz. One of the
recommendations is to focus on adaptive reuse of structures. Three of the
recommendations for zoning in the Plan deal with the issue of use standards, site
development standards, and parking standards.
As part of implementing the Comprehensive Plan, staff recommends creating a new zoning
district, the Main Street Mixed -Use District, for properties along Main Street that provides
for modified uses, site, and parking standards. By amending the UDC property owners
could request rezoning to this district to allow greater opportunity to redevelop these
properties.
Uses
The proposed district allows single family residences and low intensity commercial uses.
Please review the proposed list of uses in the Use Chart. This would allow owners of a
structure to lease the property to someone for an office use, but if the tenant moved out
after the lease expired they could then lease it as a single family home again.
Dimensional Requirements
In general the minimum lot size, width, depth and setbacks have been reduced to allow
existing structures to not be considered non - conforming, which restricts and hinders
redevelopment.

One of the greatest challenges in redeveloping these properties, many of which were
constructed as single family residential homes, is the placement of the house on the
existing lots limits the ability to add parking. In light -of the width of Main Street the Gateway
Study recommended reducing on -site parking requirements. As proposed, properties zoned
MSMU would only be required to provide 2 on- site parking spaces but must meet the
requirement for on -site handicapped spaces.
STAFF ANALYSIS AND RECOMMENDATION:
Staff requests the Planning and Zoning Commission to recommend approval to City
Council of the proposed amendments to Articles 5 and 10 of the Unified Development Code
as presented.
COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering action on these items, the Commission should consider the criteria within
UDC, Section 21.4.7D.

See. 21.5.1 Purpose and Applicability
The zoning regulations and districts contained in this Article are established in accordance with
the adopted Comprehensive Land Plan and as authorized by LGC Chapter 211, for the purpose
of promoting the public health, safety, morals and general welfare, and protecting and preserving
places and areas of historical, cultural and/or architectural importance and significance within the
City limits. They have been designed to lessen the congestion in the streets, to secure safety
from fire, panic and other dangers, to ensure adequate light and air, to prevent the overcrowding
of land and thus avoid undue concentration of population, and to facilitate the adequate provision
of transportation, water supply, wastewater treatment, schools, parks and other public
requirements. They are established with reasonable consideration for, among other things, the
character of each zoning district and its peculiar suitability for the particular uses specified,
conserving the value of buildings and environmentally sensitive features, and encouraging the
most appropriate use of land throughout the City.

The City is hereby geographically divided into zoning districts and the boundaries of those
districts herein are delineated upon the Official Zoning Map of the City. The use and
dimensional regulations as set out in this Article are uniform in each district. Zoning districts are
established in compliance with adopted Comprehensive Land Plan and Master Thoroughfare

Unified Development Code
A. As soon as practical following annexation, but in no event more than 183 calendar
days thereafter, the City Council shall, on its own motion or by request of the
property owners of the annexed area, initiate proceedings to establish the initial
zoning on the newly annexed territory. Unless otherwise requested by application
of the property owner, the initial zoning of newly annexed territory shall be
Predevelopment (PRE).
B. The initial zoning of a land parcel, whether by motion of the City Council or by
request of the property owner shall be processed in the same mariner as a request
for a zoning change in accordance with section 21.5:4. Notification requirements
and the responsibility of the Planning and Zoning Commission and City Council
shall be in accordance with a request for a zoning change.
C. The owner of land to be annexed may submit an application for zoning the
property concurrently with submission of the request for annexation, but no such
annexation application may be made conditioned upon the approval of any
particular zoning classification. The Planning and Zoning Commission inay
consider the request for zoning and make a recommendation the City Council
prior to final adoption of the annexation ordinance. Any recommendation by the
Planning and Zoning Commission shall be conditioned upon approval of the
annexation of the property by the City Council. The City Council may act of an
ordinance to establish the initial zoning of the property being annexed at the same
meeting as the action on the annexation ordinance so long as final approval of the
annexation ordinance occurs prior to final approval of the ordinance to establish
the zoning.

M. Agricultural District (AD)
Intended to provide as a base zoning district in areas designated as Agricultural
Conservation on the North and South Schertz Framework Plans. Residences in
this District are intended to be on a minimum lot size of 217,800 square feet (five
acres). Clustering of up to 2 homes may be allowed on the same lot subject to
setback requirements. This District is suitable for areas where development is
premature due to lack of utilities, capacity or service, and for areas that are
unsuitable for development because of physical restraints or potential health or
safety hazards.

Sec. 21.5.6 Statement of Purpose and intent for Nonresidential Districts
A. Office and Professional District (OP)
Intended to provide suitable areas for the development of office structures as well
as office park developments on appropriately designed and attractively
landscaped sites. It is also intended to provide ancillary retail service (restaurants,
coffee shops, newsstands, etc) for such office developments. Due to the intensity
of these developments, this District should be generally located along major
transportation corridors, and be properly buffered from less intensive residential
uses.
B. Neighborhood Services District (NS)
Intended to provide suitable areas for the development of certain limited service
and retail uses in proximity to residential neighborhoods in order to more
conveniently accommodate the basic everyday retail and service needs of nearby
residents. Such uses occur most often on the periphery of established
neighborhoods at the intersection of collectors and minor arterials, and are
generally on sites of approximately one (1) to three (3) acres in size. These
developments are to have generous landscaping and contain non - residential uses,
which do not attract long distance traffic trips. This District should be properly
buffered from residential uses and protected from pollution and/or environmental
hazards.

When a proposed land use is not classified in this section, the parking
requirements will be based on the minimum standard which applies to a. specified

C. Mixed Uses
hi the event that several users occupy a single structure, or parcels of land, the
total requirements for off street parking shall be the sum of the requirements for
the several uses computed separately unless it can be shown that the peak parking
demands are offset, for example with retail and residential, or theater and office
uses. In such case the City Manager or his/her designee may reduce the total
requirements accordingly, but not more than twenty -five percent (25%).
D. Joint Use of Facilities
Required panting facilities of two (2) or more uses, structures, or parcels of land

be shown by the owners or operators that the need for the facilities does not
