HEARING OF RESIDENTS • No one spoke Mr. Richmond recognized Ms. Sanchez who asked Mr. Richmond to step down to the podium so she could read a certificate from the APA Texas Chapter addressed to the Mayor which states: American Planning Association Texas Chapter presents to the City of Schertz, Texas the Certificate of Achievement for Planning Excellence for 2014, recognizing a commitment to professional planning by City Administration, Elected and Appointed Officials and exemplary professional standards demonstrated by the Planning Staff. Ms. Sanchez offered congratulations to Mr. Richmond and the Planning and Zoning Commission. Mr. Kessel commented that the award of excellence is based on numerical categories for eligibility, and that only 15 cities received it in 2012 including Cedar Park, College Station, and Frisco, to name a few. The Commission is to be applauded for their part in being recognized with this significant award. Mr. Richmond thanked his fellow Commissioners for the outstanding working relationship among themselves and with Staff to bring about this recognition. A picture was taken by Chuck McCullough of the Commission and Staff. CONSENT AGENDA A. Minutes for August 13, 2014 Regular Meeting Mr. Brand moved to approve the consent agenda. Mr. Dahle seconded the motion. Vote was 6 -0. Motion carried. ITEMS FOR INDIVIDUAL CONSIDERATION: Minutes Planning and Zoning Commission September 10, 2014 Page I of A. Waiver — On -site Sewage Facility associated with PC2014 -005 Consider and act upon a request for approval of a waiver regarding an on -site sewage facility for Block 1, Lot 15, of Randolph Commercial Park Subdivision, an approximately one (1) acre tract of land generally located on Lower Seguin Road approximately 1800 feet northeast of the intersection of Lower Seguin and Loop 1604. Mr. Cox presented this item by stating that the Applicant is proposing to final plat approximately one (1) acre of land establishing one (1) commercial lot. The subject property is zoned Manufacturing -Light (M -1). The applicant is seeking approval of a waiver to install an on -site sewage facility (OSSF) on Block 1, Lot 15 because of the lengthy distance to the nearest sewer line and costs associated with building and connecting to that line. The applicant is requesting a waiver to the requirement for connection to a public waste water system to allow a privately owned on -site sewage facility (OSSF) at Block 1, Lot 15. Currently, the closest existing sewer line to the subject property, serving in the City of Schertz, is located at the intersection of FM 1518 and Lower Seguin Road. The sewer line would be required to extend approximately 12,700 feet along Lower Seguin Road to reach the subject property. The Project Engineer estimates the cost at approximately $1,256,000 to extend the sewer main from its current location on Lower Seguin Road and FM 1518 to the subject property. This extension would include the installation of thirty two (32) manholes and trenching of the sewer line through a thirty foot (30') high point. The subject property is at an elevation of 696 feet which is six feet (6') lower than the Lower Seguin and FM 1518 intersection which is at an elevation of 702 feet. Due to the site's proximity to the City of Converse and the topography providing more favorable conditions for gravity flow, the Public Works Department asked the City of Converse about the possibility of this area tying into Converse's sewer system. Public Works has indicated that the City of Converse does not have the capacity to serve this area of Schertz at this time; Public Works is continuing this discussion for the future. Staff recommends approval of the waiver based on the distance to the sewer connection. Mr. Greenwald asked the Applicant, Mr. Synnott, what they were going to do at the property. Mr. Synnott stated it is a commercial development and the end use has not been determined; the name of the company is not tied to the use of the property. Mr. Dahle asked Staff about the McArthur subdivision which is close to this property. Mr. Cox stated that this subdivision is in Converse and Staff does not know. Discussion followed between Staff, the Applicant and the Commission. Mr. Crawford moved to approve this item as presented. Mr. Greenwald seconded the motion. Vote was 6 -0. Motion carried. B. PC2014 -005 Randolph Commercial Park Subdivision, Block 1, Lot 15 — Final Plat Consider and act upon a request for approval of a final plat for Block 1, Lot 15, of Randolph Commercial Park Subdivision, an approximately one (1) acre tract of land generally located on Lower Seguin Road approximately 1800 feet northeast of the intersection of Lower Seguin and Loop 1604. Mr. Cox presented this item by stating that the Applicant is proposing to final plat approximately Minutes Planning and Zoning Commission September 10, 2014 Page 2 of 4 one (1) acre of land establishing one (1) commercial lot. The subject property is zoned Manufacturing -Light (M -1). The Planning and Zoning Commission approved the master plan on April 27, 2011 and subsequently approved an amended master plan on October 26, 2011. A preliminary plat for the entire 23 lot subdivision was approved on March 14, 2012 by the Planning and Zoning Commission. A six month extension for the preliminary plat was granted on March 12, 2014 by the Planning and Zoning Commission and expires on September 14, 2014. The subject property has frontage on Lower Seguin Road and has an existing 50 -foot egress and ingress easement which will provide future cross access and circulation to adjacent lots. The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted indicates that no protected or heritage trees will be removed from this site. This site will be serviced through an 8" water line that will be extended down Lower Seguin Road. This site is not currently serviced by a public wastewater system and the applicant has requested a waiver to allow the lot to be served by an On- site sewage facility (OSSF). The applicant will construct all improvements along Lower Seguin Road including curbs, gutters and sidewalks designed to meet the City of Schertz specifications. Staff recommends approval of the final plat. Mr. Greenwald moved to approve this item as presented. Mr. Crawford seconded the motion. Mr. Brand questioned if there is water now. Mr. Cox stated that the applicant will extend water. Ms. Sanchez stated that Schertz water comes from the adjacent property known as the Tates property. Mr. Brand asked what is Canyon Regional Water. Mr. Greenwald stated that it was an entity that Schertz belonged to many years ago along with many other cities. There was no further discussion and Mr. Richmond called for a vote. Vote was 6 -0. Motion carried. C. PC2014 -027 Bindseil Farms — Preliminary Plat Consider and act upon a request for approval of a preliminary plat of the Bindseil Farms Subdivision, an approximately 34 acre tract of land situated in the Toreiba Herrera Survey No. 68, Abstract No. 153; G. Malpez Survey No. 67, Abstract No. 221, City of Schertz, Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road and Schertz Parkway. Mr. Cox stated that Staff realized after posting the agenda that an additional waiver needs to be processed in order for this plat to meet the City requirements for subdivisions, and Staff is asking the Commission to table this item until the next meeting. Mr. Dahle moved to table this item until the next meeting. Mr. Brand seconded the motion. Vote was 6 -0. Motion carried. 5. REQUESTS AND ANNOUNCEMENTS A. Requests by Commissioners to place items on a future Planning and Zoning Agenda. • Mr. Richmond stated that there are several requests pending from previous meetings and that Staff is prioritizing. B. Announcements by Commissioners. Minutes Planning and Zoning Commission September 10, 2074 Page 3 of Mr. Greenwald stated that he attended the Cibolo City Council meeting with a workshop session that explained the size of development and the status of water. He thinks they will corning to the SSLGC for water and that shouldn't be a problem. Mr. Crawford stated that he attended a three day Texas Floodplain seminar in San Antonio this past week with all four of our Floodplain Managers. • Ms. Sanchez stated that septic with lot sizes discussion will be at the next meeting. • Ms. Sanchez stated that SchertzFest will be September 14`x' and 20t1i and that they need judges for the "BBQ. If you want to volunteer, please let her know. • Ms. Sanchez stated that Staff is still looking into the TxDot billboard question. • Ms. White stated that the APA Conference information has been distributed to those Commissioners who are attending. • Ms. Sanchez stated that there were 3 site plans received during August 25, 2014 through September 5, 2014. 6.
