13-R-24 - Professional Services agreement w/Ford Engineering design for Southeast Quadrant Elevated Tank and WaterlineRESOLUTION NO. 13 -R -24 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH FORD ENGINEERING, INC., RELATING TO ENGINEERING AND DESIGN FOR THE SOUTHEAST QUADRANT ELEVATED TANK AND WATERLINE TIE TO FM 1518 AND SCHAEFER ROAD PROJECT, AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, the City staff of the City of Schertz (the "City ") has determined that the City requires professional services relating to engineering and design for the Southeast Quadrant Elevated Tank and Waterline Tie to FM 1518 and Schaefer Road; and WHEREAS, City staff has determined that Ford Engineering, Inc. is uniquely qualified to provide such services for the City; and WHEREAS, pursuant to Section 252.022(a)(4), the City is not required to seek bids or proposals with respect to a procurement for personal, professional, or planning purposes; and WHEREAS, the City Council has determined that it is in the best interest of the City to contract with Ford Engineering, Inc. pursuant to the Engineering Services Agreement attached hereto as Exhibit A (the "Agreement "). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS IreR u Section 1. The City Council hereby authorizes the City Manager to execute and deliver the Agreement with Ford Engineering, Inc. in substantially the form set forth on Exhibit A. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Ford Engineering, Inc. understands the scope of work is generally as follows: Ford Engineering Inc. and its team will provide professional engineering and surveying services for the City to advertise for bids and to construct a 1.0 million gallon elevated storage tank (EST), SCADA improvements, valves, meters, water mains to bring water to the new EST, and site improvements. The supply main to the new tank .will have a control valve on -site, and another control valve will be installed on the 12 inch main located on FM 1518. Control valves and tank levels will be tied to the City's SCADA system. The EST is to be a 1.0 million gallon composite tank similar to the existing EST's located throughout the city. The new EST will be equipped to accommodate future cellular equipment. It is anticipated that the location of the project will be in the general vicinity of FM 1518 south FM 78 on a piece of undeveloped property near the intersection of Lisa Meadow and Voges Pass. This property will need to be obtained by the City of Schertz. Project Scone Land Acquisition It is anticipated that the proposed property will be located on property currently owned by Cibolo Creek Municipal Authority. Current City code states that the subdivision of property into two or more properties must have a plat of the subdivision prepared. Ford Engineering will perform a boundary survey of the property, and prepare the legal description of the area to be acquired by the City of Schertz; anticipated to be approximately 1.0 acre in size. Our understanding of the City code is that there are two options for platting the property; a preliminary_ plat for the entire property followed' by a final plat of the area to be acquired, or a master plan of the entire property and a minor plat of the area to be acquired by the City. If improvements to Lisa Meadows are required for final plat approval, then additional compensation to FEI will be necessary to provide that service. Ford Engineering Inc. will provide the platting services as discussed above and included in the City's Unified Development Code. The land acquisition is assumed to begin with the preliminary design and be completed prior to issuance of plans and specifications for bidding. Platting the acquired property will continue through the design process. Design Ford Engineering Inc will provide a topographic survey of the project site. The project site will include the property acquired for the elevated storage tank. Also the topographic survey will included survey within the right of way Lisa Meadows from FM 1518 to Schaefer Road (approximately 3,000 linear feet) where the new supply and distribution mains will be installed. The topographic survey will include the area where the new mains will tie into the existing mains on FM 1518 and Schaefer Road. It is anticipated that the new mains will be located within the right of way. The topographic survey will include sufficient detail of existing features to situate the EST, perform the necessary site improvements, and design the supply and distribution mains to the new site. Ford Engineering Inc's team will provide four geotechnical boring in the approximate location of the new elevated storage tank. The borings and accompanying report will indicate summarized laboratory data, groundwater levels observed during and after completion drilling, boring location plan, encountered soils conditions, design values for allowable bearing capacity for foundations, estimated settlement of foundations, subgrade preparation/earthwork recommendations. The current conditions of the property are agricultural, and there should be no environmental/archeological issues associated with the proposed site. The design will encompass the layout of the proposed elevated tank on the project site and will take into consideration the following criteria in the design: the tank is initially designed to be filled from the existing 12 inch water main FM 1518 and distribute to existing main in Schaefer Road, future supply will come from the SSLGC waterline near Cibolo Creek. An isolation valve will be installed on the FM 1518 main at the point of tie -in. The City has indicated that no pumps are required at this time. A water network analysis will performed by FEI to verify the ability of the EST to meet the City's requirement of capacity and pressure for the City's water service area south of Lisa Meadows. A report of the finding will be included with the 30% construction plans. Site work will be the sufficient to provide access, parking, and security for the EST. The electrical engineering design team member will provide electrical and instrumentation and controlslSCADA plans/specifications. Ford Engineering, Inc. and its team will prepare construction plans, specifications, and estimates of probable construction cost, for a 30°/x, 60% and 90% review and approval. Final plans and specifications will be in conformance with City of Schertz standards of construction and materials. Ford Engineering Inc. will provide supporting plans, reports, and documents for the acquisition of permits from TxDOT, TCEQ, and the FAA. Fees required by review agencies, if any, are not included in this proposal and will be the City's responsibility. With final approval from the City, a bid set of construction plans and specifications will be provided to City for advertisement of bid. Ford Engineering Inc. will prepare and distribute plans and specifications to interested bidders. Ford Engineering, Inc. will have a representative available for pre -bid and bid opening meetings with the City of Schertz. Upon receipt of bids, Ford Engineering Inc will prepare a tabulation of bids, review references, and provide a recommendation to the City for awarding the project. Construction With the project awarded, the. design team will meet with the City and the Contractor for a preconstruction conference. Ford Engineering Inc. will provide one set of staking . as described in the in the contract documents. The design team will review shop drawings and material submittals, and provide comments or recommendations of approval. Monitoring and testing of the fill placement and compaction, and field observations and laboratory testing to evaluate the quality of construction materials for subgrade and foundation preparation and construction is considered additional services and is not included in this proposal. Estimated fee for these additional services may range from $7,500 to $10,000, and may be requested by the City. All construction testing aside from earthwork, reinforcing steel, and cast in place concrete, will be the responsibility of others. Ford Engineering, Inc. will have a representative available for pre - construction and monthly project meetings during construction. Additional site visits will be considered additional services. After construction has been completed and work approved by the Owner, Ford Engineering Inc. and its team will incorporate any changes made during construction, as indicated by the contractor on a marked up set "ef plans, into a set of Project Record Drawings. Ford Engineering, Inc. and its team will have representatives present at the site for facility startup. Based on our preliminary research, we anticipate that the design of these facilities can be accomplished in 120 days broken down as follows: 30% Design 45 days 60% Design 30 days 90% Design 30 days Final Plans and Specifications 15 days Engineering Fee Compensation for these services will be in the amount of $200,552.00 which will cover all costs associated with the scope described above. Additional services and significant changes will be compensated for as provided by Attachment 1 to the Second Amendment to agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. dated April 1, 2012 (the "Second Amendment). Further, the services described in this letter shall be subject to the terms of the Agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. dated February 9, 2010, as amended by the First Amendment to Agreement for Engineering Services dated October 1, 2011 and the Second Amendment.
