Mr. Cox presented this item by stating that the Applicant is proposing to rezone approximately 2
acres of land from Predevelopment District (PRE) to Residential Agriculture District (RA). The
subject property is currently undeveloped and is located on Lower Seguin Road approximately 850
feet east of the intersection of Lower Seguin Road and FM 1518. Seven (7) public hearing notices
were mailed to surrounding property owners on November 6, 2014. Public hearing notice will be
published in "The Daily Commercial Recorder" on and the Herald" prior to the City Council
public hearing. At the time of this meeting, one (1) response has been received and it was in favor
with no comments.
The Sector Plan amendment to the Comprehensive Land Use Plan (CLUP) designates the subject
property as Estate Neighborhood which is defined as Residential Agriculture District (RA) base
zoning with single - family residential uses only.
• Comprehensive Plan Goals and Objectives: The proposed zone change is consistent with
the proposed single- family residential use for Estate Neighborhood.
• Impact on Infrastructure: The proposed zoning should have a minimal impact on the
existing and planned water and wastewater systems.
• Impact on Public Facilities /Services: The proposed rezoning request should have a minimal
impact on public services, such as schools, fire, police, parks and sanitation services.
• Compatibility with Existing and Potential Adjacent Land Uses: The subject property is
currently surrounded by undeveloped land, single family residential and agriculture uses
which are consistent with the Comprehensive Land Use Plan.
The primary reason for the proposed rezoning is to construct a single family home on the two
acres. Staff recommends approval of the zoning request based its compatibility with the adjacent
land uses and compliance with the Comprehensive Land Use Plan.

Ms. Wood presented this item by stating that the Applicant is requesting to zone approximately 70
acres of land generally located at 7720 Trainer Hale Road approximately 1500 feet north of
Interstate 10 to Public Use District (PUB). The subject property is currently located in the Extra
Territorial Jurisdiction (ETJ) of the City of Schertz and is owned by Cibolo Creek Municipal
Authority which has indicated their desire to voluntarily annex the property and develop a
municipal wastewater treatment plant at this location.
Sixteen (16) public hearing notices were mailed to surrounding property owners within 200 feet on
November 7, 2014 with a public hearing notice to be published in "The Daily Commercial
Recorder" and the `Herald" prior to the City Council public hearing. At the time of this meeting,
nine (9) responses were received, six (6) opposed, one (1) opposed but lives in Cibolo, one (1) in
favor, and one (1) with no comment.
The Future Land Use Plan (FLUP) designates the subject property for Agricultural Residential
which is defined in the Comprehensive Land Plan as intended to preserve the rural /agriculture state
to include large lot residential and some related commercial uses permitted such as: landscaping
business, metal workshop, farmers market, convenience store, etc.
• Comprehensive Plan Goals and Objectives: The proposed rezoning request is generally in
conformance with the goals and objectives of the Comprehensive Plan. In particular, the
proposed zone change supports the goal to ensure adequate development of public facilities
as well as upgrade public facilities and services in order to meet the challenges of growth.
• Impact on Infrastructure: The proposed zone change will have a large impact on the
wastewater infrastructure system by providing additional capacity for community growth.
• Impact on Public Facilities /Services: The proposed rezoning request should have a minimal
impact on public services, such as schools, fire, police, parks and sanitation services.
• Compatibility with Existing and Potential. Adjacent Land Uses: The subject property is
currently surrounded by undeveloped land, single family residential and agriculture uses
which is currently consistent with the Comprehensive Land Use Plan.
The Comprehensive Land Use Plan identifies this area as Agricultural Residential to provide for
large acre lots and includes ancillary uses to the neighborhood. This zone change recommendation
will be presented in conjunction with a voluntary annexation request. Staff recommends approval.
Mr. Ellis, the Applicant, stated that they are taking steps to mitigate nuisances to address issues
beforehand.

Mr. Richmond stated that the Commission is acting on a rezoning application. Ms. Wood stated
the survey received was for 69.111 acres, that this is a zoning process, and we have not received an
application for platting. Notices were mailed out according to state law to current tax owners from
Bexar County within 200 feet of this property. A list of those notices is available if someone
would like to speak to Staff after the meeting.
Mr. Ellis, the Applicant, stated that there will be silent blowers to mitigate noise, and they are
visiting other sites near residential neighbors to determine requirements to mitigate odor. He stated
that they have the 69 acres, will purchase an additional 60 acres, and will landscape to shield the
road.

Consider and act upon a request for approval of an amendment to the master development
plan for Verde Enterprise Business Park, an approximately 214 acre tract of land situated in
the Toreiba Herrera Survey No. 68, Abstract No. 153; City of Schertz, Guadalupe and Comal
County, Texas, generally located on the north of the intersection of Schertz Parkway and 111-
35.
Mr. Cox presented this item by stating that the Applicant is proposing to amend the master
development plan for the subject property to add approximately 5 acres of land to Unit 12A & B.
The entire subdivision is approximately 214 acres of land zoned Planned Development District
(PDD). The original Master Development Plan (MDP) was approved by the Planning and Zoning
Commission on May 10, 2005 and has been revised various times with the last amendment being
approved on February 25, 2013. The property is approximately 214 acres of land zoned Planned
Development District (PDD). The subdivision has been partially developed. On July 22, 2014, City
Council approved the rezoning to PDD for the approximately 5 acres of land that the applicant is
requesting to add to the MDP.

This development is designed to have multiple access points from Schertz Parkway, Lookout
Road, IH -35, and two internal roads which have been constructed, Mid - Cities Parkway and Verde
Parkway. Cross lot access easements provide additional traffic circulation along the commercial
portion of the development. Unit 1.2A has frontage on IH -35 and Unit 12B has frontage on Verde
Parkway. The addition is serviced through 12" water lines and 8" sewer lines that will be extended
throughout the addition and stubbed for future development. The applicant is responsible for all
drainage associated with the subject property, and for compliance with Storm Water regulations,
which may require on -site detention at the time of site plan.

Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat
approximately 9 acres establishing two (2) buildable lots and one (1) drainage lot. The subject
property is currently undeveloped and is located 600 feet east of the intersection of Schertz
Parkway and IH -35. Access to this Unit will be through the existing Verde Parkway for Unit 12B
and IH -35 for Unit 12A. The site is serviced by Schertz water and sewer, CPS, Centerpoint
Energy, AT &T, and Time Warner Cable. This site is serviced through existing 12" water lines that
run along IH -35 and Verde Parkway, The site is served by 8" sewer lines that will be extended
along the subdivision. Sidewalks along IH -35 and Verde Parkway are required and will be installed
with development of the lots. No right -of -way dedications or roadway improvements are required.
The applicant will be responsible for driveway improvements that TxDOT requires along IH -35.
The proposed preliminary plat has been reviewed with no objections by the City Engineer, Public
Works, Parks, Inspections, Fire and Police. The plat is consistent with all applicable zoning
requirements, ordinances and regulations of the City. Staff recommends approval.

involvement from citizens.

Consider and act upon a request for approval of a final plat of Wynter Hill Subdivision, an
approximately 23 acre tract of land situated in the Toreiba Herrera Survey No. 68, Abstract
No. 153, City of Schertz, Guadalupe County, Texas, generally located 750 feet north of the
intersection of Live Oak Road and Oak Run.
Mr. Cox presented this item by stating that the Applicant is proposing to final plat approximately
23 acres of land establishing 58 single family residential lots with a minimum lot size of 9,600
square feet. The site is zoned Single Family Residential District -1 (R -1). The subject property is
currently undeveloped and located off Oak Run approximately 750 feet north of Live Oak Road.
This development is designed to have two (2) points of access via Oak Run Street through the
Mesa Oaks Subdivision and via Water Oak Street through The Reserve at Mesa Oaks Subdivision.
The applicant has submitted a Tree Preservation and Mitigation Plan which indicates that there are
three (3) protected size trees and one (1) heritage size tree on the property. The applicant will be
removing one (1) protected size tree requiring eight inches (8 ") of mitigation or a fee in lieu in the
amount of $800. Mitigation is due at the time the tree is removed. The Developer has elected to
pay a fee in -lieu of parkland dedication and development. A fee in the amount of $1000 per
dwelling unit must be paid by the Developer prior to recording of the final plat. This site is
serviced through 8" water lines and 8" sewer lines that will be extended throughout the
subdivision. The subdivision will provide onsite detention. ;Sidewalks will be constructed along
both sides of the street throughout the subdivision.
The plat identifies a pipeline casement at the rear of Lots 1 thm 8, Block 2 on the southeast corner
of the property. As requested by Staff, the applicant has provided a detail showing that the lots
encumbered by the pipeline easement are buildable lots. The applicant has indicated that they are
currently working on having the pipeline easement vacated and documents will be filed by separate
instrument with the Guadalupe Country Clerk's office. Staff has requested a copy of the recorded
documents be submitted to the City.
The final plat has been reviewed with no objections by the City Engineer, Public Works, Parks,
Inspections, Fire and Police. Staff recommends approval of the final plat.
Mr. Braud asked which HOA will be in this subdivision. The Owner, Mr. Gray, stated that it will
be a separate HOA to maintain the drainage basin. Mr. Braud asked if there is going to be a
detention basin. Mr. Gray stated that yes, there will be a drainage basin. Mr. Braud asked if it will
be detention or retention. Mr. Gray stated that it will be detention. The Engineer, Mr. Koehl, stated
that it is a detention basin and they are providing full detention.

County Development Park Subdivision. The property consists of approximately 1.1 acres and
is more specifically described as Lot 12 and a portion of Lot 17 out of the Tri- County
Development Park Subdivision, Comal County, Schertz, TX, located at 7377 Doerr Lane.
Mr. Cox presented this item by stating that the applicant is proposing to replat Lot 12 and a portion
of Lot 17 of Tri- County Development Park Subdivision into one (1) buildable commercial lot
identified on the plat as Lot 19, Block 1. The remaining portion of Lot 17 is being replatted into the

existing drainage easement and providing a new drainage channel easement. The new drainage

GENERAL INFORMATION:

ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 13 acres into two lots and
develop Lot 1 into a single family residential lot. The applicant is seeking approval of a waiver for Lot 1 to install
a privately owned On -Site Sewage Facility (OSSF). Lot 1 is zoned Single - Family Residential/ Agricultural (R -A)
and Predevelopment (PRE). City Council approved on January 6, 2015 the rezoning from PRE to R -A of the
back two acres of the subject property.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 12424 Lower Seguin
Road in the City of Schertz. Lot 1 is currently undeveloped.
PUBLIC IMPROVEMENTS:
The applicant is seeking approval of a waiver for Lot 1 to install a privately owned On -Site Sewage Facility
(OSSF) which is regulated by Bexar County. The site is located within the City of Schertz Certificate of
Convenience and Necessity (CCN).
In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.6, Wastewater System, all lots, tracts
and parcels on which the development is proposed shall be connected to a public wastewater system.
Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall
comply in full with the requirements of this UDC.
Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF
requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15
Waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article
12 when undue hardship will result from requiring strict compliance.
STAFF ANALYSIS AND RECOMMENDATION:
The applicant is requesting a waiver to the required connection to a public waste water system to allow a
privately owned on -site sewage facility for Lot 1 because of the lengthy distance to the nearest sewer line and
costs associated with building and connecting to that line. Currently, the closest sewer connection to the subject
property is located at the intersection of Vesoul Valley and Saverne Way in Rhine Valley Subdivision Unit 1.
The sewer line would need to be extended approximately 2,000 feet along Vesoul Valley and Lower Seguin
Road to reach the subject property. The Project Engineer estimates that it will cost $273,355.40 to extend the
sewer main from its current location to the subject property. This extension would include the installation of six
(6) manholes and sewer line depths ranging from 8 feet to 18 feet. The subject property is located at the top of
the sewer shed. Granting this waiver will not negatively impact future public sewer connections to surrounding
properties since this property is located at the top of the sewer shed.
This waiver request has been reviewed with no objections by Public Works, Engineering and Planning
Departments. Staff recommends approval of the waiver based on the distance to the sewer connection. The
granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure.
Additionally, granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious
to other property in the area.

COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its
opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and
Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest.
In making their findings, the Planning and Zoning Commission shall take into account the nature of the
proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will
reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and
upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the
Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of
other land in the area in accordance with the provisions of this UDC. Such findings of the
Planning and Zoning Commission, together with the specified facts upon which such findings
are based, shall be incorporated into the official minutes of the Planning and Zoning
Commission meeting at which such waiver is granted. Waivers may be granted only when in
harmony with the general purpose and intent of this UDC so that the public health, safety, and
welfare may be secured and justice done.
B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver.

C. Such findings together with the specific facts on which such findings are based shall be incorporated into the
official minutes of the Planning and Zoning Commission meeting at which such exception is granted.
D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law,
ordinance, code or regulation of the City.
E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may
be appealed to the City Council. When considering an appeal, the City Council shall consider the same
standards as the Planning and Zoning Commission as outlined above.

Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
Tree affidavit which indicates that the site does not contain any protected or heritage trees.
PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community
Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per
dwelling unit will be paid by the Developer prior to recording of the final plat. This application was reviewed
under UDC, Ordinance 11 -S -15 with amendments.
PUBLIC SERVICES: The site is serviced by Schertz water, CPS, AT &T, and Time Warner Cable.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement. The civil construction plans must be reviewed and approved by the Public Works and
Engineering Departments prior to approval of the final plat.
Water: This site is currently serviced through an 8" water line that extends down Lower Seguin Road along the
front of the property
Sewer: This site is not currently serviced by a public wastewater system. The applicant is requesting a waiver
to allow lot 1 to be served by an On -site sewage facility (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. The City Engineer has reviewed and approved the preliminary drainage
report.
Sidewalks Hike and Bike Trails: Sidewalks are required along Lower Seguin Road for the length of the
subdivision and will be designed to meet the City of Schertz specifications.
Road Improvements: The subject property is located adjacent to Lower Seguin Road, which is identified on the
Master Thoroughfare Plan as a 60 foot Right -of -Way. The applicant is proposing a 0.165 acre variable width
right -of -way dedication along Lower Seguin Road. Additionally, Lower Seguin Road will be improved to City of
Schertz specifications. Construction plans for all public improvements will be submitted and approved by Public
Works and Engineering prior to approval of the final plat.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and
