PC2014 -055 Consider and act upon a request for approval of a final plat of Wynter Hill Subdivision, an approximately 23 acre tract of land situated in the Toreiba Herrera Survey No. 68, Abstract No. 153, City of Schertz, Guadalupe County, Texas, generally located 750 feet north of the intersection of Live Oak Road and Oak Run. Mr. Cox presented this item by stating that the Applicant is proposing to final plat approximately 23 acres of land establishing 58 single family residential lots with a minimum lot size of 9,600 square feet. The site is zoned Single Family Residential District -1 (R -1). The subject property is currently undeveloped and located off Oak Run approximately 750 feet north of Live Oak Road. This development is designed to have two (2) points of access via Oak, Run Street through the Mesa Oaks Subdivision and via Water Oak Street through The Reserve at Mesa Oaks Subdivision. The applicant has submitted a Tree Preservation and Mitigation Plan which indicates that there are three (3) protected size trees and one (1) heritage size tree on the property. The applicant will be removing one (1) protected size tree requiring eight inches (8 ") of mitigation or a fee in lieu in the amount of $800. Mitigation is due at the time the tree is removed. The Developer has elected to pay a fee in -lieu of parkland dedication and development. A fee in the amount of $1000 per dwelling unit must be paid by the Developer prior to recording of the final plat. This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision. The subdivision will provide onsite detention. Sidewalks will be constructed along both sides of the street throughout the subdivision. The plat identifies a pipeline easement at the rear of Lots 1 thru 8, Block 2 on the southeast corner of the property. As requested by Staff, the applicant has provided a detail showing that the lots encumbered by the pipeline easement are buildable lots. The applicant has indicated that they are currently working on having the pipeline easement vacated and documents will be filed by separate instrument with the Guadalupe County Clerk's office. Staff has requested a copy of the recorded documents be submitted to the City. The final plat has been reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, Fire and Police. Staff recommends approval of the final plat. Mr. Braud asked which HOA will be in this subdivision. The Owner, Mr. Gray, stated that it will be a separate HOA to maintain the drainage basin. Mr. Braud asked if there is going to be a detention basin. Mr. Gray stated that yes, there will be a drainage basin. Mr. Braud asked if it will be detention or retention. Mr. Gray stated that it will be detention. The Engineer, Mr. Koehl, stated that it is a detention basin and they are providing full detention. Discussion followed between the Applicant, Staff and the Commission. Mr. Crawford moved to approve as submitted. Mr. Glombik seconded the motion. Vote was 5 -0. Motion carried. PC2014 -061 Hold a public hearing, consider and act upon a request for approval of a replat of the Tri - County Development Park Subdivision. The property consists of approximately 11 acres and is more specifically described as Lot 12 and a portion of Lot 17 out of the Tri- County Development Park Subdivision, Comal County, Schertz, TX, located at 7377 Doerr Lane. Mr. Cox presented this item by stating that the applicant is proposing to replat Lot 12 and a portion of Lot 17 of Tri - County Development Park Subdivision into one (1) buildable commercial lot identified on the plat as Lot 19, Block 1. The remaining portion of Lot 17 is being replatted into the adjacent Benevest Subdivision. The property is zoned Manufacturing Light (M -1). Public hearing notices were published in "The Daily Commercial Recorder" on November 26, 2014 and in the "Herald" on December 3, 2014. There were six (6) notices mailed to surrounding property owners on December 1, 2014. At the time of this staff report one (1) response neutral to the request was received. The subject property is located at 7377 Doerr Lane and is currently undeveloped. Access to this property will be from Doerr Lane. The applicant has submitted a Tree Affidavit which indicates that there are no protected or heritage trees on the site. This site is serviced by an existing 12" water line and 12" sewer line. The applicant is proposing to reroute an existing drainage channel by abandoning a portion of the existing drainage easement and providing a new drainage channel easement. The new drainage channel must be constructed and approved prior to recording the plat. Sidewalks will be constructed along Doerr Lane with the development of the site. All sidewalks will be designed to meet the City of Schertz specifications. The replat is consistent with applicable requirements for the property, ordinances and regulations. It has been reviewed by the City Engineer, Public Works, Parks, Inspections, and Fire with no objections. Staff recommends approval. Mr. Cox stated that the Applicant was not present. Mr. Richmond asked Staff to remind applicants that they are expected to be present to support their agenda item. Mr. Richmond opened the Public Hearing at 6:19 P.M. There being no one to speak, Mr. Richmond closed the Public Hearing at 6:20 P.M. Mr. Cox stated that the remainder of Lot 17 will be the replat in the next item to be considered by the Commission. Mr. Crawford asked what will happen to the drainage when they abandon the easement. Mr. Cox stated that the concrete channel and it will be rerouted and the new channel will continue to carry the water to the same location. Mr. Greenwald stated that on note 1 there is City of Schertz, city electric and gas. Mr. Cox stated that this is a typo which should say City of San Antonio and can be a condition to correct the note if this is approved. Mr. Greenwald stated that there is a reference quoting floodplain and is it correct for this area. Mr. Cox stated that Jim Hooks has reviewed the Minutes Planning and Zoning Commission December 17, 2014 Page 3 of 8 plat and the flood plain note. Discussion continued between the Staff and the Commission. Mr. Greenwald moved to approve this item with the correction to Note #1 to be revised to the City of San Antonio. Mr. Braud seconded the motion. Vote was 5 -0. Motion carried. B. PC2014 -067 Hold a public hearing, consider and act upon a request for approval of a replat of the Benevest Subdivision. The property consists of approximately 6 acres and is more specifically described as Lots 6 thru 9, Block 2 out of the Benevest Subdivision and the remaining portion of Lot 17 out of the Tri- County Development Park Subdivision, Comal County, Schertz, TX, generally located 800 feet north of the intersection of Guada Coma Drive and Tri County Parkway. Mr. Cox presented this item by stating that the Applicant is proposing to replat Lots 6, 7, 8 and 9, Block 2 of Benevest Subdivision and a portion of Lot 17 of Tri - County Development Park Subdivision into one (1) buildable commercial lot identified on the plat as Lot 10, Block 2. The property is zoned Manufacturing Light (M -1). Public hearing notices were published in "The Daily Commercial Recorder" on November 26, 2014 and in the "Herald" on December 3, 2014. There were eleven (11) notices mailed to surrounding property owners on December 1, 2014. At the time of this staff report three (3) responses were received, two (2) in favor and one (1) neutral to the request. Access to this property will be from Guada Coma Drive. The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. This site is serviced by an existing 12" water line and 12" sewer line. The new drainage channel must be constructed and approved prior to recording the plat. Sidewalks will be constructed along Guada Coma Drive with the development of the site. Mr. Richmond stated that the same Note #1 should be made on this item as the other one. Mr. Cox stated yes, the condition is that upon approval the note is changed. ZC2014 -016 Minutes Planning and Zoning Commission December 17, 2014 Page 4 of 8 Hold a public hearing, consider and make a recommendation on a request to rezone approximately 2 acres of land from Single Family Residential District - 2 (R -2) to Neighborhood Services (NS). The property is more specifically described as a tract of land out of the Genobera Malpaz Survey No. 67, Abstract No. 221, City of Schertz, Guadalupe County, Texas; generally located on Schertz Parkway five hundred and fifty feet (550') south of the intersection of Schertz Parkway and Elbel Road. Mr. Richmond stated that the Applicant has withdrawn this item. 5. ITEMS FOR INDIVIDUAL CONSIDERATION A. PC2014 -039 Consider and act upon a request for approval of a preliminary plat of The Crossvine Module 1, Unit 2 Subdivision consisting of approximately 48 acres. The property is more specifically described as a portion of the Julian Diaz Survey No. 66, Abstract No. 187 County Block 5059, City of Schertz, Bexar County, Texas, generally located west of FM 1518. Ms. Wood presented this item by stating that the Applicant is proposing to preliminary plat approximately 48 acres of land establishing 120 single family residential lots of three (3) different lot sizes: 5,500 square feet, 7,200 square feet and 8,400 square feet as dictated by The Crossvine Subdivision PDD. This property is part of a Planned Development District, as such it must comply with the design requirements of the PDD, and any area that is not directly addressed in this document must comply with the design criteria of the Schertz Unified Development Code (UDC). The subject property is undeveloped and is generally located west of FM 1518 approximately 500 feet south of the intersection of Longleaf Parkway and FM 1518. This development is designed to have two (2) points of access via FM 1518 and the extension of Hollering Vine constructed in Crossvine Module 1, Unit 1. All parkland requirements have been satisfied, no fees are required. The Crossvine is proposing more than 2.5 miles of "must build" trails; several pocket parks throughout the entire development; open space in excess of 15 %; 13.1 acres of public parkland (Heritage Park) previously dedicated to the City of Schertz; and an Amenity Center which is currently under construction in Module 1, Unit 1. This unit includes construction of a pocket park and extension of open space and trails. All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15. A 20' right -of -way dedication has been provided with this plat for the future expansion of FM 1518. The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval. The Owner, Mr. Price, stated the initial phase is completed except for the amenity center, landscape around the center, and landscape issues being worked with a redesign. This preliminary plat is for the next phase. Weekley and Ryland have opened models and they have twelve (12) homes under contract as of today. The next phase will have the same design standards and the same feel to what they have in the current phase. Minutes Planning and Zoning Commission December 17, 2014 Page 5 of 8 Mr. Greenwald asked about the north edge and the distance from the couple of lots on sheet 2, and if the developers are responsible for any noise abatement. Mr. Price stated the builders are away of the long term potential of FM 1518 going to four lanes and trying to mitigate with walls and contributing 20' of ROW on the frontage of FM 1518. Discussion followed between the Applicant, Staff and the Commission. Mr. Greenwald moved to approve this item as presented. Mr. Crawford seconded the motion. Vote was 5 -0. Motion carried. B. PC2014 -062 Consider and act upon a request for approval of a preliminary plat of the Rhine Valley Subdivision, Unit 3A, an approximately 11 acre tract of land situated in the Miles S. Bennett Survey No. 75, Abstract No. 61, County Block 5057, the Julian Diaz Survey No. 66, Abstract No. 187, County Block 5059, and the William Bracken Survey No. 74, Abstract No. 43, County Block 5056, City of Schertz, Bexar County, Texas, generally located on Ray Corbett Drive 2200 feet east of the intersection of Ray Corbett Drive and FM 1518. Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat approximately 11 acres of land establishing 48 single family residential lots. All of the lots in this unit will be SF 50 lots with a minimum size of 6,000 square feet as dictated by the Rhine Valley PDD (Ordinance 13- 5 -37). This final plat was reviewed using the Rhine Valley PDD (Ordinance 13 -5 -37) and the UDC, Ordinance 11 -5 -15, as amended. The subject property is currently undeveloped and located generally 2,200 + feet east of the intersection of FM 1518 and Lower Seguin Road. This development is designed to have two (2) points of access via Forbach Drive and Belfort Point which were constructed with Unit 1. The Applicant has submitted a Tree affidavit which indicates that the site contains protected or heritage trees; however, no trees will be removed from the site. The tree mitigation and preservation plan will be reviewed by Parks and Community Services department prior to approval of the final plat. A five (5) acre public park was dedicated with Unit 1 of this subdivision which meets the parkland dedication requirements for this subdivision. Parkland improvements including a soccer field, multi - purpose ball field, and a sport court will be constructed with this subsequent unit. Parkland improvements must be completed prior to recording the final plat. This site will be serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision and stubbed for future development. The Applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. Drainage report has been reviewed and approved by the City Engineer. The subdivision will provide onsite detention. Sidewalks will be constructed along both sides of the street throughout the subdivision. The subject property is affected by the additional design requirements imposed by the PDD Design Standards along Ray Corbett Drive to include landscaping buffers and screening. A 6' masonry fence will be constructed along the proposed extension of Ray Corbett Drive prior to recording the final plat. One landscape buffer lot (Lot 2, Block 18) adjacent to the proposed extension of Ray Corbett Drive has been provided with this plat. It has been reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, Minutes Planning and Zoning Commission December 17, 2014 Page 6 of 8 and Fire. Staff recommends approval. Mr. Braud asked about the drainage comment again. Mr. Cox stated that the Applicant has submitted a preliminary drainage report and at final plat, a full drainage report is required. Mr. Brand asked if we can say that a preliminary drainage report has been reviewed and approved. Mr. Cox stated that yes they can make that change on future staff reports. Mr. Braud asked where is the water going to end up. The Engineer, Burt Wellman, stated that the ultimate drainage path is to end up in the detention basin constructed in Unit 1 and in a drainage easement in a future channel. Discussion continued between the Applicant, Staff and the Commission. Mr. Glombik moved to approve this item as presented. Mr. Braud seconded the motion. Vote was 5 -0. Motion carried. C. PC2014 -063 Consider and act upon a request for approval of a preliminary plat of San Antonio Machine and Welding Subdivision, an approximately 7 acre tract of land situated in the J. Saladin Survey No. 404, Abstract No. 229, City of Schertz, Guadalupe County, Texas, located at 18115 IH -35 North. Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat approximately seven (7) acres of land establishing two (2) commercial lots. The subject property is zoned General Business (GB) and Manufacturing -Light (M -1). The subject property is located at 18115 IH -35 North and has two existing buildings on the site. The subject property is provided access to IH -35 through a 24 foot shared access easement in accordance with UDC Sec 21.10.6 to provide interconnectivity between lots. The Applicant has submitted a Tree affidavit which indicates that the site contains protected or heritage trees; however, no trees will be removed from the site. The tree mitigation and preservation plan will be reviewed by Parks and Community Services department prior to approval of the final plat. This site will be serviced through a 12" water line that extends along the front of the property. Additionally an 8" sewer line will be extended along IH -35 across the front of the property and stubbed out for future development. All sidewalks will be designed to meet the City of Schertz specifications. Construction plans for all public improvements will be submitted and approved by Public Works and Engineering prior to approval of the final plat. The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval of the preliminary plat. Mr. Greenwald asked if this is the old McKenzie Air location. Mr. Cox stated that it is the San Antonio Machine and Welding location. Mr. Braud asked about the statement in the plat map which states San Antonio property. Mr. Cox stated that this is CPS and this is how it is shown on the tax records. Announcements by City Staff. • Ms. Wood stated that the monthly financial report was included in the Commission packets. • Ms. Wood wished everyone a Merry Christmas and Happy New Year on behalf of Staff and that the City offices would be closed on December 25th and 26th and January 1St and 2" d for the holiday. • Mr. Richmond thanked Staff for their outstanding job this year, and wished everyone a Merry Christmas and Happy New Year.
