Waiver — On -site Sewage Facility associated with PC2014 -072 Consider and act upon a request for approval of a waiver regarding an on -site sewage facility for Block 1, Lot 1, of the Barsness Subdivision, an approximately 4 acre tract of land generally located at 12424 Lower Seguin Road. Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat approximately 13 acres into two lots, and develop Lot 1 into a single family residential lot. Minutes Planning and Zoning Commission January 14, 2015 Page 1 of 4 The applicant is seeking approval of a waiver for Lot 1 to install a privately owned On -Site Sewage Facility (OSSF). Lot 1 is zoned Single- Family Residential/ Agricultural (R -A) and Predevelopment (PRE). City Council approved on January 6, 2015 the rezoning from PRE to R -A of the back two acres of the subject property. The subject property is located at 12424 Lower Seguin Road in the City of Schertz. Lot 1 is currently undeveloped. The applicant is requesting a waiver to the required connection to a public waste water system to allow a privately owned on -site sewage facility for Lot 1 because of the lengthy distance to the nearest sewer line and costs associated with building and connecting to that line. Currently, the closest sewer connection to the subject property is located at the intersection of Vesoul Valley and Saverne Way in Rhine Valley Subdivision Unit 1. The sewer line would need to be extended approximately 2,000 feet along Vesoul Valley and Lower Seguin Road to reach the subject property. The Project Engineer estimates that it will cost $273,355.40 to extend the sewer main from its current location to the subject property. This extension would include the installation of six (6) manholes and sewer line depths ranging from 8 feet to 18 feet. The subject property is located at the top of the sewer shed. Granting this waiver will not negatively impact future public sewer connections to surrounding properties since this property is located at the top of the sewer shed. This waiver request has been reviewed with no objections by Public Works, Engineering and Planning Departments. Staff recommends approval of the waiver based on the distance to the sewer connection. The granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure. Additionally, granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious to other property in the area. Mr. Richmond stated to be clear is this 'a 4 acre tract. Mr. Cox stated that it is 3.28 acres, but we round up to approximately 4 acres, and zoning was passed for the back for 2 acres. Mr. Evans asked if the Ford Engineering letter was correct by stating 2 acres. Mr. Cox stated yes, it is correct for the 2 acres in the back of the property for the house. Mr. Richmond asked the Applicant if they had any comment at this time. Applicant stated no. Mr. Greenwald asked about the only sewer connection is being about the middle of Rhine Valley. Mr. Cox stated that this is the closest that they could tie into. This property is part of a Planned Development District, as such it must comply with the design requirements of the PDD and any area that is not directly addressed in this document must comply with the design criteria of the Schertz Unified Development Code (UDC),as amended. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is undeveloped and is generally located south of the intersection of Aranda Lane and Lower Seguin Road. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access via Lower Seguin Road and the extension of Sagenite which was constructed with the Sedona subdivision. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a Tree Affidavit which indicates that protected or heritage trees may be destroyed or damaged. A tree survey is required to be submitted at the time of final plat. PARKS: All parkland requirements have been satisfied, no fees are required. The Crossvine is proposing more than 2.5 miles of "must build" trails; several pocket parks throughout the entire development; open space in excess of 15 %; 13.1 acres of public parkland (Heritage Park) previously dedicated to the City of Schertz; and an Amenity Center which is currently under construction in Module 1, Unit 1. This unit includes construction of a small private park and extension of open space and trails. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to approval of the final plat. This final plat was reviewed using the Rhine Valley PDD (Ordinance 13 -S -37) and the UDC, Ordinance 11 -S -15, as amended. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and generally located on Alsatian Way 1,100 feet south of the intersection of Alsatian Way and Ray Corbett Drive. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access via Strasbourg Way and Alsatian Way as well as Arches Valley and Rothau Drive stub outs which were constructed with Unit 1. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a Tree affidavit which indicates that development of this site will involve the removal of protected or heritage trees. The tree mitigation and preservation plan will be reviewed by Parks and Community Services department prior to approval of the final plat. PARKS: A five (5) acre public park was dedicated with Unit 1 of this subdivision which meets the parkland dedication requirements for this subdivision. Parkland improvements including a soccer field, multi - purpose ball field, and a sport court will be constructed with this subdivision. The parkland improvements are being constructed in two (2) phases. Phase I of the improvements are currently under construction and phase II of the improvements will be constructed prior to recording the subsequent unit of this subdivision. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to approval of the final plat. Water and Sewer: This site will be serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision and stubbed for future development. Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. A preliminary drainage report has been reviewed and approved by the City Engineer. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along Lower Seguin Road and on both sides of the street throughout the subdivision. All sidewalks are designed to meet the City of Schertz specifications. Additional Design Criteria: The subject property is affected by the additional design requirements imposed by the PDD Design Standards along Lower Seguin Road and Alsatian Way to include landscaping buffers and screening. A 6' masonry fence will be constructed along Lower Seguin Road and a 6' wood or masonry fence with masonry columns will be constructed along Alsatian Way prior to recording the final plat.
