Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

A. Minutes for November 19, 2014 and December 17, 2014 Regular meetings
Mr. Richmond stated that since some Commissioners were absent on each of those days, they
would consider these minutes separately. Ms. White pointed out one correction on the December
17, 2014 minutes; in the first line, the date should read December 17, 2014 instead of October 8,
2014.
Minutes for November 19, 2014
Mr. Crawford motioned to approve the minutes for November 19, 2014. Mr. Dahle seconded the
motion. Vote was 7 -0. Motion carried.
Minutes for December 17, 2014
Mr. Crawford motioned to approve the minutes for December 17, 2014 as corrected. Mr.
Greenwald seconded the motion. Vote was 5 -0 -2 with Mr. Evans and Mr. Dahle abstaining.
Motion carried.
ITEMS FOR INDIVIDUAL CONSIDERATION
A. Waiver — On -site Sewage Facility associated with PC2014 -072
Consider and act upon a request for approval of a waiver regarding an on -site sewage facility
for Block 1, Lot 1, of the Barsness Subdivision, an approximately 4 acre tract of land
generally located at 12424 Lower Seguin Road.
Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat
approximately 13 acres into two lots, and develop Lot 1 into a single family residential lot.

The applicant is seeking approval of a waiver for Lot 1 to install a privately owned On -Site
Sewage Facility (OSSF). Lot 1 is zoned Single - Family Residential / Agricultural (R -A) and
Predevelopment (PRE). City Council approved on January 6, 2015 the rezoning from PRE to
R -A of the back two acres of the subject property. The subject property is located at 12424
Lower Seguin Road in the City of Schertz. Lot 1 is currently undeveloped.
The applicant is requesting a waiver to the required connection to a public waste water system
to allow a privately owned on -site sewage facility for Lot 1 because of the lengthy distance to
the nearest sewer line and costs associated with building and connecting to that line. Currently,
the closest sewer connection to the subject property is located at the intersection of Vesoul
Valley and Saverne Way in Rhine Valley Subdivision Unit 1. The sewer line would need to be
extended approximately 2,000 feet along Vesoul Valley and Lower Seguin Road to reach the
subject property. The Project Engineer estimates that it will cost $273,355.40 to extend the
sewer main from its current location to the subject property. This extension would include the
installation of six (6) manholes and sewer line depths ranging from 8 feet to 18 feet. The
subject property is located at the top of the sewer shed. Granting this waiver will not
negatively impact future public sewer connections to surrounding properties since this property
is located at the top of the sewer shed.
This waiver request has been reviewed with no objections by Public Works, Engineering and
Planning Departments. Staff recommends approval of the waiver based on the distance to the
sewer connection. The granting of this waiver will not have a negative impact on existing or
proposed municipal infrastructure. Additionally, granting of this waiver will not be detrimental
to the public health, safety or welfare, or be injurious to other property in the area.
Mr. Richmond stated to be clear is this a 4 acre tract. Mr. Cox stated that it is 3.28 acres,
but we round up to approximately 4 acres, and zoning was passed for the back for 2 acres.
Mr. Evans asked if the Ford Engineering letter was correct by stating 2 acres. Mr. Cox
stated yes, it is correct for the 2 acres in the back of the property for the house. Mr.
Richmond asked the Applicant if they had any comment at this time. Applicant stated no.
Mr. Greenwald asked about the only sewer connection is being about the middle of Rhine
Valley. Mr. Cox stated that this is the closest that they could tie into. Mr. Greenwald
stated that he is tired of seeing septic systems being installed with no inspection
provisions.
Discussion followed between the Applicant, Staff and the Commission.
Mr. Dahle moved to approve this item as presented. Mr. Glombik seconded the motion. Vote was
7 -0. Motion carried.
B. PC2014 -072 Barsness Subdivision — Preliminary Plat
Consider and act upon a request for approval of a preliminary plat of the Barsness
Subdivision an approximately 13 acre tract of land situated in the Julian Diaz Survey No. 66,
Abstract No. 187, City of Schertz, Bexar County, Texas, located at 12424 Lower Seguin
Road.
Mr. Cox presented this item by stating that the Applicant is proposing to preliminary plat

approximately thirteen (13) acres into two (2) lots. The subject property is zoned Single - Family
Residential/ Agricultural (R -A) and Predevelopment (PRE). City Council approved the rezoning
from PRE to R -A of the back two acres of Lot 1 on January 6, 2015. The subject property is
located at 12424 Lower Seguin Road. Lot 1 is undeveloped and zoned R -A for the back 2 acres
and PRE and R -A along the 50 foot common access easement. Lot 2 is zoned R -A for the first 240
feet and PRE for the remainder. A legal non - conforming commercial business is located on the
PRE portion of Lot 2. Both of the proposed lots have frontage on Lower Seguin Road which is
accessible from FM 1518 to the west. Additionally, a proposed 50 foot common access easement
and an existing culvert provide access across the drainage easement to the back portion of Lots 1
& 2. The applicant has submitted a Tree affidavit which indicates that the site does not contain
any protected or heritage trees.
There is no parkland being proposed with this subdivision. The Parks, Recreation and Community
Services Department has determined that a fee -in lieu of parkland dedication in the amount of
$1000 per dwelling unit will be paid by the Developer prior to recording of the final plat. This site
is currently serviced through an 8" water line that extends down Lower Seguin Road along the
front of the property. This site is not currently serviced by a public wastewater system. The
applicant is requesting a waiver to allow lot 1 to be served by an On -site sewage facility (OSSF)
which has been granted. The applicant is responsible for all drainage associated with the subject
property, and for compliance with the Storm Water regulations. The City Engineer has reviewed
and approved the preliminary drainage report. Sidewalks are required along Lower Seguin Road
for the length of the subdivision and will be designed to meet the City of Schertz specifications.
The subject property is located adjacent to Lower Seguin Road, which is identified on the Master
Thoroughfare Plan as a 60 foot Right -of -Way. The applicant is proposing a 0.165 acre variable
width right -of -way dedication along Lower Seguin Road. Additionally, Lower Seguin Road will be
improved to City of Schertz specifications. Construction plans for all public improvements will be
submitted and approved by Public Works and Engineering prior to approval of the final plat. The
proposed preliminary plat is consistent with applicable requirements for the property, ordinances
and regulations. Staff recommends approval of the final plat.
Mr. Greenwald asked if the property has a development agreement. Mr. Cox stated that the
property is located inside the City of Schertz city limits and does not have a development
agreement on it. Mr. Greenwald asked if the Applicant is aware he has a CPS easement line down
the property. Mr. Cox stated yes.
Discussion continued between the Applicant, Staff and the Commission.
Mr. Greenwald moved to approve this item as presented. Mr. Dahle seconded the motion. Vote
was 7 -0. Motion carried.

• Mr. Dahle stated that that he attended the Mayor's Task Force meeting, and there are
several items under consideration: more citizen involvement and a list of project
priorities with recommendations to City Council.
• Mr. Crawford asked Mr. James about last night's City Council agenda item calling for
an agreement with Randolph AFB. Mr. James stated that City Council passed a
resolution supporting legislation changing state law within a certain distance of
Randolph.
• Mr. Richmond stated that there is a vacancy on the TIRZ Board #2. Staff nominated
him and he accepted.
• Mr. Richmond stated that they received Community Volunteer Fair information from
Staff.
C. Announcements by City Staff.
• Ms. Sanchez stated that the quarterly activity report was given to the Commission along
with two copies of amended plats which were approved by Staff.
• Ms. Sanchez stated that a copy of the Master Calendar for 2015 was also included in
their packet.
• Ms. Sanchez stated that Monday, January 19, 2015 is Martin Luther King holiday and
the offices are closed. There is another P &Z meeting on January 28, 2015.
• Mr. James stated there were some recent updates provided to City Council by
representatives of the Lone Star Rail District. Staff will plan a joint meeting with a
Q &A as part of a Public Hearing with other boards attending at the beginning of a P &Z
meeting in the future.
