A. ZC2015 -008
Hold a public hearing, consider and act upon a request to rezone approximately 2.1 acres of
land in the Verde Enterprise Business Park Planned Unit Development (PUD) Ordinance 07-
S-14A to Planned Development District (PDD). The property is specifically Lot 2, Block 13 of
the Verde Enterprise Business Park Unit 11 subdivision and generally located on Schertz
Parkway approximately 250 feet north of the intersection of Schertz Parkway and IH -35 in
the City of Schertz, Guadalupe County, Texas.
Mr. Cox gave a presentation about a proposal to rezone approximately 2.1 acres of land in the Verde
Enterprise Business Park Planned Unit Development. Five (5) public hearing notices were mailed
to surrounding property owners on December 30, 2015. At the time of this staff report no responses
have been received. The request is to develop Lot 2, Block 13 of Unit 11 in accordance with the
existing PUD Ordinance 07 -S -14A with the exception to the building setback adjacent to property
located outside that is commercial or industrial. The request is to rezone the subject property to
modify the development standards to change the building setback from a t)erimeter lot line of
property outside
50' to 20'. Staff recommends approval of the zoning request.

Mr. Crawford asked what would be developed on this lot. Mr. Cox responded that the applicant has
discussed constructing a hotel on this site.
Mr. Dahle moved to recommend approval of ZC2015 -008 to City Council. Mr. Crawford seconded
the motion. The vote was unanimous. Motion carried.
B. PC2015 -036
Hold a public hearing, consider and act upon a request for approval of a replat of the
Cottonwood II Subdivision Lots 1 &z 2, Block 1, consisting of approximately 3 acres,
establishing two (2) lots. The property is generally located on Schertz Parkway approximately
450 feet north of the intersection Schertz Parkway and Live Oak Road, City of Schertz,
Guadalupe County, Texas
Mr. Cox presented a request for approval of a replat of the Cottonwood II Subdivision Lots 1 & 2,
Block 1, consisting of approximately 3 acres, establishing two (2) lots. The purpose of this replat
is to provide a public right -of -way between Lots 1 and 2 to provide access to Schertz Parkway. The
lots will have access onto the new roadway being created with this plat. The applicant has submitted
a tree affidavit which indicates that the site does contain protected or heritage trees but no trees will
be removed. The civil construction plans have been reviewed by the Public Works and Engineering
Departments.
Water and Sewer: This site is currently serviced by existing 16" water line and 12" sewer line on
Schertz Parkway. An 8" water line is going to be extended down Mare Way and stubbed out for
future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and
for compliance with the Storm Water regulations. A storm water management plan has been
reviewed and approved by the City Engineer.
Sidewalks, Hike and Bike Trails: Sidewalks along Schertz Parkway currently exist and meet the
City of Schertz specifications. Sidewalks are required along Mare Way and will be constructed
with the development of the property. All sidewalks will be designed to meet the City of Schertz
specifications.
Road Improvements: Schertz Parkway is an improved road and does not require any additional
improvements or ROW dedications. Mare Way will be developed to City of Schertz specifications.
Construction plans for all public improvements have been approved by Public Works and
Engineering.
Staff recommends approval of this request.

proposed to have a dedicated right hand turn lane.
Mr. Crawford moved to approve the replat Cottonwood II Subdivision PC2016 -036. Mr. Dahle
seconded the motion. The vote was unanimous. Motion carried.
4. ITEMS FOR INDIVIDUAL CONSIDERATION:
A. PC2015 -037
Consider and act upon a request for approval of a preliminary plat of the Bindseil Farms
Subdivision, an approximately 35 acre tract of land situated in the Toreiba Herrera Survey
No. 68, Abstract No. 153; G. Malpez Survey No. 67, Abstract No. 221, City of Schertz,
Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road
and Schertz Parkway.
Mr. Cox presented a request for approval of a preliminary plat of the Bindseil Farms Subdivision,
an approximately 35 acre tract of land, generally located northwest of the intersection of Live Oak
Road and Schertz Parkway. The applicant is proposing to preliminary plat approximately 35 acres
of land establishing 84 single family residential lots. The Master Thoroughfare Plan shows Live Oak
Road being extended from the intersection at Schertz Parkway northwest along the edge of the Dietz
Creek and intersecting with Maske Road. The connecting section of Mare Way must be constructed
and accepted by the City and the replat of Cottonwood II subdivision must be recorded before a final
plat of Bindseil Farms will be recorded. The tree affidavit submitted indicates that no protected or
heritage trees will be removed from this site. There is no parkland being proposed with this
subdivision. The site is serviced by Schertz water and sewer, GVEC, CenterPoint Energy, AT &T,
and Time Warner Cable. The civil construction plans must be reviewed and approved by the Public
Works and Engineering Departments prior to approval of the final plat.
Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be
extended throughout the subdivision.
Drainage: The applicant is responsible for all drainage associated with the subject property and for
compliance with the Storm Water regulations. A drainage report has been reviewed and approved
by the City Engineer. The City Engineer has granted a waiver to onsite detention based on storm
water. The project engineer has demonstrated that that there is no adverse effect created by releasing
storm water into the Dietz Creek channel. Additionally, approximately 10 acres of drainage ROW
will be dedicated to the City.
Sidewalks. Hike and Bike Trails: Sidewalks will be constructed along both sides of the street
throughout the subdivision and along the Live Oak Road Extension. All sidewalks will be designed
to meet the City of Schertz specifications.
Road Improvements: All streets will be developed to City of Schertz specifications. A 60' ROW
dedication has been provided for the extension of Live Oak Road from Schertz Parkway to the limits
of the proposed subdivisio . Construction p ans f6r all public improveme s wilt be submitted an
approved by Public Works and Engineering prior to approval of the final plat.

Mr. Richmond, Mr. Crawford, Mr. Greenwald, and Mr. Braud asked questions regarding access and
construction of Live Oak Road and sidewalks and hike and bike trails along Live Oak Road. Mr.
Cox, Ms. Wood, and Mr. James responded to the questions and concerns.
Mr. Greenwald moved to approve PC2015 -037. Mr. Crawford seconded the motion. The vote was
unanimous. Motion carried.
A. Public Hearing and discussion on Unified Development Code Article 11 Signs and
Advertising Devices.
Mr. James gave a presentation on the unified Development Code Article I1 Signs and
Advertising Devices. The presentation was focused abound the possible reduction in sign
height on FM 3009, revisions to temporary signs and rewriting of the sign code. There was a
brief discussion between staff and the commissioners regarding the sign code format, ways
to regulate signs, temporary signs and digital signs. Mr. James will be bring forward in the
future a draft revision to Article 11 Signs and Advertising Devices.
B Public Hearing and discussion on Fence and Shed Building Code Amendments.
Mr. James gave a presentation on the Fence and Shed Building Code Amendments. Staff is
proposing a code amendment to not require a permit for replacing a fence. This amendment
would not remove any fencing or shed restrictions or regulations. A discussion between Mr.
James and the Commission where they conversed about concerns with encroaching over
easements/ utility lines and that people would not follow the regulations if a permit was not
required.
Mr. James presented amending the building code to not require a permit for a shed under 120
square feet. The building code generally exempts accessory structures under 200 feet from
needing a permit, however Schertz's local amendments require a permit for all accessory
structures. It is staff's opinion that 200 square feet is too large to not permit and recommends
not permitting accessory structures under 120 square feet and it is moveable. There was a
brief discussion between Mr. James and the commissioners regarding placement of sheds in
easements, concerns with the safety of structures built without a permit, and discussion of the
criteria for a shed that does not require a permit.
6. REQUESTS AND ANNOUNCEMENTS:
A. Requests by Commissioners to place items on a future Planning and Zoning Agenda.
Mr. Crawford wanted to confirm that there would be more discussion regarding Live Oak
Rd. in the future and Mr. James confirmed there would be. Mr. Richmond noted the new City
Council meeting schedule.
