MINUTES OF MEETING
Thursday, May 11, 2017 —11:30 a.m.
1. Call to Order and Establish a Quorum — A quorum was present.
Mayor Carpenter called the meeting to order at 12:00 p.m. A quorum was present.
Mayor Pro -Tem Claire Walters was the proxy for New Berlin.
2. Welcome and Introductions
Mayor Carpenter welcomed everyone in attendance and those present stood and
introduced themselves.
3. Approval of minutes of the workshop meeting of April 6, 2017 and the minutes of
the regular meeting of April 13, 2017.
Mayor Seiler moved seconded by Mayor Daly to approve the minutes of the April 6,
2017 workshop meeting and minutes of the regular meeting of April 13, 2017. The vote
was unanimous. Motion Passed.
4. Approval of the Treasurer's Report for April 2017.
Mayor Daly made a motion seconded by Mayor Dunn to approve the treasurer's report
for April 2017. The vote was unanimous. Motion Passed.
5. Discussion and possible action regarding NEP Summer Break. (Item requested
by Mayor Seiler)
Mayor Carpenter recognized Mayor Seiler who stated that he wanted to suggest that
during the summer months and that as many will be on vacation he would suggest that
we cancel the July and September Regular meetings.
Mayor Daly stated that the 4th of July is a holiday where individuals travel as well as
Labor Day in September, he would suggest that July and September meetings be
cancelled, other member cities concurred.
Mayor Dunn moved seconded by Mayor Seiler that we cancel the July and September
regular meetings. The vote was unanimous. Motion Passed.
Mayor Carpenter stated that if we need a meeting we will call one if the Legislature calls
a special session, we will call a meeting.

Discussions occurred regarding the Mayor's Workshop meetings during the summer
months. Mayor Carpenter stated that we could discuss this at our June Workshop.
Mayor Carpenter congratulated Mr. Dick Neville City of Universal City and Bill Seiler City of
Marion for being re- elected. Mayor Carpenter congratulated Judson ISD for passing their bonds.
Mayor Carpenter stated that the City of Garden Ridge has a new Mayor Mr. Larry Thompson,
who was unable to join us today and mentioned that City of Kirby has a new Mayor Ms. Lisa
Pierce.
6. Update regarding the 85t' Texas Legislation session.
Mayor Carpenter stated that the House Ways and Means last night discussed Senate Bill
2. Mayor Carpenter stated that he had watched a video on Chairman Bonnen who is also
the Speaker Pro -Tem who had gotten a little cross with a representative of a city because
the representative intimated if you vote for this bill you must therefore be against first
responders. Representative Bonnen was right is saying that is too broad of a stroke, but
an interesting thing that he showed his card a little bit was when he asked did you come
out to any of sessions that we had around the state bashing cities over the last year. The
city representative did not answer, Bonnen asked did you come to any of the sessions
that we had with the special committee of the House going around the state beating up
and bashing cities? The City representative answered no, answer was no, we didn't do
that only the Senate did that, so let's move forward. That was an interesting comment
saying you have some support here, don't ruin it for yourself, basically is what he was
saying.
Mayor Carpenter recognized Catarina Gonzales who stated that the Chicken bill has
passed the Senate but is in House and Urban Affairs. She stated a lot is going on, today
is the last day for the House to consider House bills on second reading. They will be
working until midnight, and there is a lot of stalling on the calendar right now. They are
still on Saturdays calendar, page 3 yesterday of an 18 -page calendar. Many things will
be dying today.
One of the things dying today is Representative Huberty's annexation bill, but the other
side of that is that Senator Campbell's annexation bill was kicked out of the House
Committee yesterday and she expects it to hit the floor sometime next week. This is a
high priority kill bill for a lot of cities. Huberty in order to get his bill on the calendar
had agreed to exempt a lot of areas, San Antonio included and make it more of a Houston
centered bill. She isn't sure this is going to hold same agreement with the Senate bill.
Tomorrow is the last date for the local consent calendar and local bills will have their
calendar next week. On the 23rd is the last day to consider second reading of senate bills
so we are winding down and getting to the finish line.
There has not be a whole lot passing. Bill passages rate, and they usually file in the 6,000
bill range and the normal passage rate is 20 -25% she doesn't believe they will get to this
amount this year and a lot of this has to do with the fighting that is going on with the

Lieutenant Governor, Governor and Speaker. They are not on the same page at all. She
provided examples of this, i.e., SB 6 the bathroom bill. Just this weekend the Governor
was calling Pastors of major churches saying you need to get your congregation to
pressure your members to get the Speaker to get this bill out of committee. This did not
work out and is dead for this session unless they have another way to amend it. There
are being calls for a special session on bathrooms.
Sanctuary cities S134 did pass and it has some ugly things in it for local officials. You
do have the civil liability and criminal liability that we had spoken about before. In
addition to this, the House put a more restrictive provision on it, that's why they are
calling it the "show me your papers bill ". Now law enforcement can inquire about
immigration status when they detain a person. Detained can be a traffic stop. This is
having some spill over affects because there are bills out there, for instance the Dog
Tethering bill, which is out there where they are talking about putting big heavy chains
on dog's necks. There is some push back now from law makers as they are saying is this
going to be an excuse for law enforcement to inquire about someone's immigration
status. This has had some spill over. And not only that but people are very angry in the
House about the way that debate happened, it was a very ugly debate. There is also some
payback happening on other people's bills and the people who voted for it.
The bill passes and the amendments are not available on line yet, they became available
on Friday and without any warning the Governor signs the bill into Law on Sunday.
Doesn't invite the bill author or the House sponsor for the bill and doesn't invite the
Lieutenant Governor, he just holds this face book live bill signing. Keep in mind the bill
does not go into effect until September, there's no urgency for this. No reason to exclude
the public or press and your bill authors who did all the work. This has created some
hard feelings.
The other thing is the Local Consent Calendar, this is a calendar they have and up put
innocuous bills on there, there is no controversy, or someone's local bill, where there
should be no problems with them. But if you get mad as someone or you feel it doesn't
have to be on the Local Calendar you can either talk for 10 minutes on the bill or you
can get 5 signatures to get it off the Local Calendar. This happened to the Chairwoman
of the Local Calendar Committee. There was a group of people who knocked one of
her bills off, you shouldn't do this, she keeps names. There were some already residual
bad feelings happening on the Local Calendar.
Again, this week the same group of people knocked off a bill that would have prevented
the shaming of poor children when they can't afford their school lunch, it would have
helped with that problem. Ms. Gonzales stated that if you are not familiar with that, that
some schools where there is no money in the school's lunch account the child can go
through the line and they take their tray and throw it away because they don't have any
money in their account. This is a horrible thing to happen. The Representative provided
a very impactful personal privilege speech on this bill. She stated that she has been doing
this for 20 years and this was the worst thing she has ever seen.

You also have that set up where people are angry, in the meantime you also have a
House Chairman who wants his raise the age bill, has been passed by the House and is
over in the Senate. This would raise the age of criminal responsibility in the State of
Texas from 17 to 18. They are not pushing that bill in the Senate, so its dead over there,
he is angry. So yesterday he went on a let me slaughter all the Senate Bills on the Local
Calendar, and he did. He knocked them off the Local Calendar, and he has said that I
they don't move his bill that there is going to be a big funeral for a lot more Senate bills.
This is also happening right now.
The budget negotiations are still going on and the Senate and House are still not on the
same page. She stated that is one thing she has mentioned before; the Legislature has
to pass a budget. If they do not agree, this is one thing that could lead to a special session.
Senate Bill 2, they had the hearing last night, keep in mind it has been sitting in the
House since March. Her understanding is that they do not have the votes. There were
some very testy exchanges going on between the Local Officials and Chairman Bonnen.
He did present a substitute bill from what came out of the Senate. Main provision on
this for your roll back if it was 3 to 6 percent that could be a rollback election by petition,
over 6 percent would be an automatic one, this also includes CPI, it also exempted
smaller cities. A much more reasonable bill. She believes he still doesn't have the votes.
She was told before from the Chairman of Calendars that it is DOA, but now you also
have the Lieutenant Governor and the Governor calling members saying if you don't
vote for that bill, all your bills are dead in the Senate.
Mayor Carpenter asked if the substitute bill said that Certificates of Obligation would
have to be paid out of general funds? Ms. Gonzalez stated she was not sure as they
rolled this out yesterday.
Basically, she stated that they are killing the calendar, they are debating every fine point
on the bills.
Mayor Carpenter stated that if anyone wanted some input there are representatives here
today from Senator Campbell and Senator Menendez office avail yourself the
opportunity to speak to them.

weekend, elderly and children stay inside.

8. Establish a Date and Time of Next Northeast Partnership for Economic
Development Meeting — June 8, 2017.

The City Live provided the door prizes for this meeting. For June, the City of Marion will
provide door prizes.
10. Items of Interest by Members.
Live Oak City Manager Scott Wayman stated they have a parade coming up May 27.
Contact them if anyone wants to participate. They also have the Freedom Walk and their
pool opens that day.
Mayor Williams City of Universal City stated that Saturday night, May 13th Date night and
Dancing, 7:00 p.n. Olympia Hills Golf and Conference Center and after that they are
featuring the movie La La Land and it begins at 8:30 p.m., contact Katie if interested.
Deborah Rice with the Judson ISD stated they are looking for internships / externships for
their students for next year. They are looking at technology, medical, etc. This would be

the students going out to the business facilities and /or the business workers coming to the
school to mentor the kids as well.
Liane Garrett stated The Randolph Rotary Club is now accepting nominations for the
volunteers of the quarter. Also, let them know if any students in the surrounding schools
are needing sponsorship for free lunches. They have funds available to offer some
assistance in this area.
City Manager Schott Wayman reminded everyone tonight, there is a TML Region 7
meeting at the Hilton Garden Inn in Live Oak. The training starts at 3:30 p.m., social
begins at 5:30 p.m. followed by dinner and meeting.
Mahammad Musa stated that the Texas Public Works Association is having its annual
conference in San Antonio on June 14 -16. Registration will end on May 15.
Catarina Gonzalez stated the annual Hog -Wild Seminar is coming up on May 22 and it is
free. Training for local elected officials will be in San Marcos.
AACOG in partnership with Denton, Navarro., Rocha, Bernal, Hyde & Zech, and CPS
Energy will host a free one -day Elected officials workshop on Tuesday, June 13, 2017 from
8:30 to 4:00 p.m. — held at the Al J Notzon III Board Room Tesoro Drive.
Mayor Alan Dunn stated the City of Cibolo will have its annual Memorial Day Celebration
on Monday, May 29 at 9:00 a.m. at Veterans Park.
Mayor Williams stated that apparently there are children that are turned away of school
districts that we are part of and he agrees with Ms. Garrett we have funds available that
would assist. We might consider contacting the school districts to see and let them know
we would be glad to help, but we would need a consensus from the group.
Representative from Judson ISD stated that they needed to clarify that, but so that everyone
understands, the students enrolled in the hot meal program that are turned away are given
an alternative meal, the kids are taken care of.
Mayor Carpenter stated that tensions right now at the legislature are very high so if anyone
intends to go to Austin to testify in front of the legislative committees that they be very
respectful. Others have spoken and their words were alienating some of their own allies.
Just be very careful and respectful and state facts. By watching those in Austin, they are
poised and ready for a fight if not provided the respect and professionalism they deserve.

Mayor Carpenter provided an update on the hearing that was before the Texas Commission
on Environmental Quality (TCEQ) yesterday. He stated that he and Mayor Keil from
Seguin testified yesterday against the proposed Post Oak Clean Green Landfill project that

could potentially ruin the Carrizo /Wilcox aquifer water source. He felt they handled
themselves very well.

As there was no further business, Mayor Carpenter adjourned the meeting at 12:39 p.m.
