6. PUBLIC HEARING:
The Planning and Zoning Commission will hold a public hearing related to zone change requests and replats within this agenda. The public

Subject: Consider and act upon a request for approval of a final plat of the OJR RWRP
Subdivision, an approximate 318 acre tract of land located at 12423 Authority Lane,
City of Schertz, Bexar County, Texas.
GENERAL INFORMATION
Owner /Applicant: Cibolo Creek Municipal Authority (CCMA)
Project Engineer: Moeller & Associates, Shane Klar, P.E.
CCMA has owned the property and operated the existing wastewater treatment plant prior to the land being
incorporated into the City limits. CCMA is planning on expanding the treatment facility in order to increase
capacity to keep up with a growing demand. The preliminary plat was approved by the Planning and Zoning
Commission on May 24, 2017.
APPLICATION SUBMITTAL DATE: June 5, 2017 (Original Application)

ITEM SUMMARY: The applicant is proposing to final plat approximately 318 acres of land establishing one lot
within the Public Use zoning district. The plat was reviewed in accordance with the current Schertz Unified
Development Code (UDC) (Ordinance 11 -S -15, as amended).
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently developed with a
wastewater treatment plant and is located at 12423 Authority Lane.
ACCESS AND CIRCULATION: The proposed lot has direct access off Lisa Meadows, a public right -of -way
that is located west of the lot and Schaefer Road, located south of the site. Currently CCMA accesses the facility
off Authority Lane, which is a private drive that connects to W. Schaefer Road.
TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant submitted a tree
affidavit which indicates that this site has no protected or heritage trees.
PUBLIC SERVICES: The site is serviced by Schertz water, CCMA, GVEC, AT &T, and Charter Communications
(Time Warner Cable).
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement. A waiver was granted by the Planning and Zoning Commission on May 24, 2017, thus
this project does not involve any public infrastructure improvements.
Water and Sewer: This site will be serviced by an existing 6" water line and existing sewer lines. Sewer service
will be provided by the applicant, CCMA, who holds the certificate of convenience and necessity (CCN) for this
site. Water service will be provided by the City of Schertz.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the storm water regulations. A preliminary drainage map has been reviewed and approved by the City
Engineer.
Sidewalks Hike and Bike Trails: The applicant submitted a request to waive requirements of constructing public
infrastructure improvements associated with the extension of FM 3009 based on rough proportionality. The
waiver was granted by the Planning and Zoning Commission on May 24, 2017.
Road Improvements: The subject property is adjacent to Lisa Meadows, an existing road located west of the
property in the City's extra territorial jurisdiction. The proposed final plat is bisected by a 120 -foot right -of -way
that is identified on the City's Master Thoroughfare Plan as the future extension of FM 3009. The applicant
submitted a request for a waiver from public infrastructure improvements based on rough proportionality, and
requested that the applicant not be required to construct public infrastructure improvements or dedicate right -of-
way to extend FM 3009. The waiver was granted by the Planning and Zoning Commission on May 24, 2017.
STAFF ANALISYS AND RECOMMENDATION: The proposed final plat is consistent with applicable
requirements for the property, ordinances and regulations. Staff recommends approval of the final plat.

PUBLIC NOTICE: Sixty five (65) public hearing notices were mailed to surrounding property owners within two
hundred (200) feet of the subject properties on June 2, 2017 with a public hearing notice to be published in the
"San Antonio Express" prior to the City Council public hearing. At the time of this staff report, staff has received
one (1) responses in favor and one (1) opposed.
ITEM SUMMARY: The applicant is proposing to rezone approximately 12 acres of land generally located at the
intersection of FM 3009 and Ashley Oak Drive, from Apartment / Multi - Family Residential (R -4) to Planned
Development District (PDD) to allow for an expansion to the existing Assisted Care or Living Facility.

GENERAL LOCATION AND SITE DESCRIPTION: The subject area is generally located at the intersection FM
3009 and Ashley Oak Dr. The Subject property extends approximately 961 feet from FM 3009. The subject
property consists of the existing Autumn Winds Living & Rehabilitation Center, an assisted care / living facility,
located at 3301 FM 3009 and the adjacent approximately 4 acres of undeveloped land.
PROPOSED ZONING: The proposed rezone is for approximately 12 acres of land from Apartment / Multi -
Family Residential (R -4) to Planned Development District (PDD) with a base zoning of Apartment / Multi - Family
Residential (R -4) with a modification in order to allow for an assisted care / living facility and a modification to
buffering / screening requirements with the adjacent residential.
CONFORMANCE WITH THE COMPREHENSIVE PLAN: The Comprehensive Land Use Plan (CLOP) through
the Future Land Use Plan designates the subject property as Single - Family Residential. The objectives for
Single Family Residential is for areas to be utilized as a traditional neighborhood design and to also include a
mix of residential uses as well as limited commercial development to support the daily activities of the
development.
• Comprehensive Plan Goals and Objectives: The proposed rezoning is generally in conformance with
the goals and objectives of the Comprehensive Plan. Specifically, the proposed rezoning to PDD with a
base zoning of Apartment / Multi - Family Residential (R -4) provides the mix of residential uses that the
Comprehensive Plan describes.
• Impact of Infrastructure: The proposed rezoning should have a minimal impact on the existing water
and wastewater systems due to only two lots being undeveloped.
• Impact of Public Facilities /Services: The proposed rezoning should have a minimal impact on public
services, such as schools, fire, police, parks and sanitation services.
• Compatibility with Existing and Potential Adjacent Land Uses: The subject property is generally
surrounded by single family land uses. It is staff's opinion the requested rezone is compatible with
surrounding properties.
STAFF ANALYSIS AND RECOMMENDATION:
The applicant is requesting to rezone the property from Apartment / Multi - Family Residential (R -4) to Planned
Development District (PDD). The PDD will be in conformance with the base zoning of R -4 with modifications to
the allowed land uses and the screening and fence requirements.
The proposed Planned Development District (PDD) will be subject to the following zoning standards:
The property within the Autumn Winds Living & Rehabilitation PDD will develop in accordance with the
current Apartment/Multi- Family Residential District (R -4) zoning as specified in the Unified Development

If the land use "Assisted Care of Living Facility" is being developed the owner / developer may provide
a 50 foot wide landscape buffer and building setback along all property lines adjacent to single family
residential districts. Within this 50 foot wide landscape buffer a planting ratio of no less than one (1)
shade tree every 20 linear feet and fifteen (15) shrubs every 50 linear feet will be provided. This
extended buffer and additional planting is an alternative to constructing an 8 ft. high masonry wall as
required by UDC Section 21.9.8.13.3.
The proposal to rezone the property from the current Apartment / Multi - Family Residential to Planned
Development District (PDD), to allow for the Assisted Care / Living Facility land use is appropriate. The current
land use on the property is an assisted care- living and rehabilitation center. The current zoning of Apartment
Multi- Family Residential (R -4) makes this land use a legal non - conforming due to the land use assisted care /
living facility not being permitted in R -4. In order for the existing business to expand, the property must be
rezoned. Currently, an assisted care or living facility is only allowed by right in the General Business and
General Business -2 zoning districts. It is the opinion of staff that rather than proposing a rezone to General
Business in order to allow for the assisted care or living facility it is more appropriate, due to the adjacent
residential, to remain with the limitations of the R -4 zoning but to modify the permitted land uses to allow for the
assisted care or living facility. With the R -4 base zoning and the land use modification, only the following land
uses would be allowed by right: Assisted Care or Living Facility, Family or Group Home, Gated Community,
Golf Course / County Club, Multi - Family Apartment Dwelling, Municipal Uses, One- Family Dwelling attached
and detached, Park or Public use, School, and a Two - Family Dwelling.
The applicant has requested a change to Article 9 section 21.9.8.8.3 Fences adjacent to Residential Property
requirements. The current requirement is for the applicant to provide a masonry screening wall a minimum of 8'
in height to separate the non - residential / multi - family use from the adjacent single - family residential.
Additionally, the applicant would be required to provide a 20' wide landscape buffer along the property lines that
are adjacent to single - family residential. Within this buffer there is a minimum requirement to plant 1 shade
tree every 30 linear feet and a minimum of 10 shrubs per 50 linear feet. In order to protect numerous trees
located along the property line the applicant is requesting to provide a 50' wide landscape buffer and provide a
planting ratio of 1 shade tree per 20 linear feet and 15 shrubs every 50 linear feet. It is the opinion of staff that
the additional 30' of landscape buffer and the additional plantings at this site will provide a comparable buffer to
the UDC requirement.
Based on the goals and objectives of the Comprehensive Land Use Plan, the existing land use conditions,
Planned Development District is the most appropriate zoning district for this property. Staff recommends
approval of the proposed rezoning as submitted.

General
Autumn Winds Living & Rehabilitation is an existing 24,760 square foot skilled nursing facility
(SNF), or nursing home, as stated on the rezoning application. It is owned by Omega
Healthcare and operated by Trinity Healthcare. The facility, located in a predominantly
residential neighborhood, sits on 11 acres of heavily vegetated land at the intersection of
Ashley Oak Dr. and Roy Richard Dr. (FM 3009). The front of the building, which faces Roy
Richard Dr., is set back approximately 310 ft. from the road while the side of the building is
located approximately 77 ft. from Ashley Oak Dr.
Autumn Winds is proposing an expansion of approximately 22,316 square feet that would
accommodate 30 private resident rooms, administration offices and a state -of- the -art
physical and occupational therapy facility. The expansion is to be located behind the existing
SNF and is proposed to house the new entrance into the facility, making Ashley Oak Dr. the
main arterial onto the property. The expansion will not be built in phases, but all at once.
The property within the Autumn Winds Living & Rehabilitation PDD will develop in
accordance with the current Apartment /Multi - Family Residential District (R -4) zoning as
specified in the Unified Development Code (UDC) as amended and with the following
modifications:

|am opposed to the request for ZC2017-005 rezoning. With all of the cars from the doctor's office parking up and down
on both sides of Ashley Oak Drive we can barely drive down the street to get to our homes. A new development would
only create more traffic.
