The Schertz Planning and Zoning Commission convened on July 27, 2016 at 6:00 p.m. at the
Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

1. CALL TO ORDER/ROLL CALL:
Mr. Richmond called the meeting to order at 6:02 P.M.
2. HEARING OF RESIDENTS:
There was no one who spoke.
3. CONSENT AGENDA:
A. Minutes for July 11, 2016 special meeting
Mr. Greenwald motioned to approve the consent agenda. Mr. Crawford seconded the
motion. The vote was approved 5 -0 with 2 abstentions from Commissioner Dahle and
Commissioner Evans, motion carried.
4. PUBLIC HEARING:
A. PC2016 -028
Hold a public hearing, consider and act upon a request for approval of a replat of
Enterprise Industrial Park Subdivision. The property consists of approximately 110 acres
of land and is more specifically described as being a portion of the Vicente Micheli Survey
No. 114, Abstract No. 383, and a portion of the G.M. Dolson Survey No. 96, Abstract No.
20, City of Schertz, Comal County, Texas.

Mrs. Gould gave a presentation on the proposed request to replat Lots 2 & 4, Block 1 of
the Enterprise Industrial Park Subdivision into a total of four (4) buildable commercial
lots. This replat will expand Lot 2 to include the drainage channel adjacent to Lookout
Road. Additionally this replat will subdivide Lot 4 into three (3) new commercial lots.
The new lots being created are Lots 5 (20.77 acres), 6 (21.11 acres) and 7 (45.82 acres).
This replat will also be removing a section of water line easement that was established
with previous plats. The Engineering Department has requested this section of water line
easement be abandoned as it is not needed to provide service to the subdivision. This
development is designed to have two (2) points of access off of Lookout Road through
variable width ingress- egress easements. The applicant's tree inventory worksheet has
identified ten (10) heritage and protected oak trees, of which nine (9) are exempt. No
public improvements are required for this subdivision. The replat is consistent with
applicable requirements for the property, ordinances and regulations. Staff recommended
approval of the proposed replat,

Mr. Richmond then opened up for discussions and comments.
The commissioners asked questions and commented on the following items: the legal
description on the replat; access to Lookout Road for proposed Lot 6; questions on sheet
#3 about the electrical easement; extending the existing utilities and why the water line
easement vacation was not by separate instrument; lot 8 fire lane and gate for access.
Mrs. Gould and Mr. Cox responded to the commissioner's questions and concerns
explaining where the access to each lot was located. Mrs. Gould also explained the
configuration of lot 8. Mr. Cox explained the existing electrical easement and that the
current easement is still sufficient for the electric provider. Mr. Cox explained that
easements can be removed by plat if they were established by plat. Mr. Cox explained
that the fence that is located in proposed lot 8 is accessible by the Fire Department by the
use of a Knox box.
Mr. Crawford motioned to approved PC2016 -028. Mr. Dahle seconded the motion. The
vote was 7 -0. Motion carried.
B. ZC2016 -006
Hold a public hearing, consider and make a recommendation to City Council about a
request to rezone approximately 14 acres of land generally located 705 feet west of the
intersection of FM 482 and Hubertus Road, from Manufacturing District, Light (M -1) to
Agricultural District (AD). The property is specifically described as 13.17 acres out of the
Rafael Garza Survey No. 98, Abstract No. 175, City of Schertz, Comal County, Texas.

Mrs. Gould gave a presentation on a proposed request to rezone approximately 14 acres of
land from Manufacturing District, Light (M -1) to Agricultural District (AD). The property
is generally located 705 feet west of the intersection of FM 482 and Hubertus Road. Nine
(9) public hearing notices were mailed to surrounding property owners on July 15, 2016
with a public hearing notice to be published in "The Daily Commercial Recorder" and the
"Herald" prior to the City Council public hearing. At the time of this staff report one
response in favor has been received. The applicant is requesting to rezone the subject
property from Manufacturing District, Light (M -1) to Agriculture District (AD). The
primary reason for the proposed rezoning is to create two lots and construct a single family
home on each of the proposed lots. Staff recommended approval of the rezone request
based on its compatibility with the adjacent land uses and compliance with the
Comprehensive Land Use Plan.
The Applicant had no presentation or comments.

Mr. Richmond then opened up for discussions and comments.
The commissioners asked questions and had a discussion regarding the following items:
surrounding properties and their zoning; zoning concerns, mixture of residential and
commercial properties.
Mr. Cox and Mr. James responded to the commissioner's questions and concerns. Mr. Cox
explained that with the Comprehensive Land Use Plan update in 2013 City initiated
rezoning was not undertaken at that time. The current project was the first property that
has requested to be rezoned to the Agricultural District (AD) zoning designation, which
was established in 2013. Mr. James noted that Agricultural District (AD) is consistent with
the Comprehensive Plan and that staff would also recommend the same zoning designation
to the surrounding properties with the same situation. Mr. James also described that the
City should propose and make recommendations for zoning in conformance with the
Comprehensive Plan. There was additional discussion between Mr. James and the
Commission about typical zoning practices and City initiated rezoning.
Mr. Greenwald motioned to forward to City Council a recommendation of approval of this
request. Mr. Glombik seconded the motion. The vote was 7 -0. Motion carried.
C. Amendments to UDC Article 9 Site Design Standards for Public Schools
Hold a public hearing, consider, and make a recommendation to the City Council to
amend the Unified Development Code (UDC) Article 9 Site Design Standards for Public
School.
Mr. James gave a presentation to amend the Unified Development Code (UDC) Article 9
Site Design Standards for Public School. Mr. James explained the background on Article
9 Site Design Standards and that staff is proposing to modify the UDC so that Section 21.

9.5 would not apply to public schools. Landscaping can be problematic given the large
sites schools occupy. Tree preservation is often a problem because in order for districts to
find suitable size site they have to selects sites with challenges — trees, topography, etc.
Mr. James also discussed the parking standards currently listed in the UDC. Staff
recommended approval of the amendments to the UDC.

Mr. Richmond then opened up for discussions and comments.
The commissioners and Mr. James had a discussion on questions and concerns the
commission had. The discussion included concerns with access, circulation, traffic and
parking, safety.
Mr. James answered questions and engaged in conversation with the commissioners. He
explained the differences between improving existing schools and building new schools.
Mr. James also explained current problems with existing schools that residents are facing,
really focusing on access and circulation. Mr. James expressed that this is a more difficult
item to discuss and come to a consensus on how to most accurately correct. Mr. James
also noted that if tabled that he will bring the specific UDC language to the P &Z for
additional review.
Mr. Greenwald motioned to table this item. Mr. Crawford seconded the motion. The vote
was 7 -0. Motion carried.
5. REQUESTS AND ANNOUNCEMENTS
A. Requests by Commissioners to place items on a future Planning and Zoning Agenda.
The Commissioners requested that the following items be placed on future agendas:
• Request to have the tabled agenda item, Amendments to UDC Article 9 Site
Design Standards for Public Schools, added to the next meeting agenda

• Discussion about apartment complexes

Mr. Dahle commented that he attended the meeting on Wednesday, July 20th regarding the
new Fire/ EMS station and the improvements to FM 1518. He mentioned there were about
70 people who attended the meeting which was a great turnout.

submitted to the Planning and Zoning Department between July 11, 2016 and July
