General Provisions, and changes in regards to updated language for clarity, have more
consistency with Comprehensive Land Plan and Master Thoroughfare Plan, Vested Rights, and

Mrs. Wood and Ms. Grobe gave a presentation to the commissioners on recommending approval
to Council on an amendment of Part III, Schertz Codes of Ordinances, Unified Development
Code, and Article 3 Boards, Commissions and Committees and associated updates in UDC
Articles 4, 8, 9, 11 & 14. They explained the background of Article 3, and explained changes in
regards to consistency with the City Charter, with the by -laws, a title change of Transportation
Safety Advisory Commission, clarification of the Commission's approval authority of amending
and minor plats, Board of Adjustment to hear only zoning related cases, and the creation of a
new Commission called the "Building Standard Commission ". Mrs. Wood and Ms. Grobe
explained the responsibilities of the proposed new Commission. Staff recommended approval
of the amendments of the Unified Development Code.

requirements from one to two years. During the discussion the commission expressed concerns
about added costs to the developer and if other cities were moving toward a two year warranty
period. Mr. James and Mr. Busch responded to these concerns and discussed some recent
warranty failures that occurred around the 1 year mark and Mr. Busch referenced some nearby
and target cities that have moved to the 2 year warranty period.

GENERAL INFORMATION:
As stated in the UDC, City Council from time to time, on its own motion, or at the recommendation of City Staff
make amendments, change or modify text to any portion of the UDC to establish and maintain sound stable
and desirable development. It is generally considered good practice to periodically review and update the
development regulations due to changing conditions, community goals and State and Federal regulations.
Based on the update to the Comprehensive Land Use Plan and changes in development it has becomes
necessary to update the UDC.
This amendment was drafted by Planning Staff and reviewed by the City Attorney (Daniel Santee, Denton
Navarro Rocha Bernal & Zech).

In order to promote the development of a walkable community, Staff is proposing to revise UDC Section
21.14.6.A to remove the exemption for sidewalks along Interstate Highways 35 and 10. Staff is proposing that
UDC Section 21.14.6.A Sidewalks and Hike and Bike Trails- Requirements be amended to read as follows:
• "Sidewalks shall be required along both sides of all streets throughout the City as required in section
21.14.1. All lots must have access to sidewalks."
STAFF RECOMMENDATION:
The UDC currently does not require sidewalks to be constructed along Interstate Highways 35 and 10. It is the
opinion of staff that sidewalks should be required along all roadways in order to promote pedestrian access and
a walkable community. Staff recommends the approval of the amendment to the Unified Development Code
(UDC), Article 14 Transportation, Section 21.14.6.A Sidewalks and Hike and Bike Trails as presented.
COMMISSIONERS CRITERIA FOR CONSIDERATION:
The Planning and Zoning Commission in making a recommendation to City Council on the proposed Unified
Development Code Amendment. In considering action on a UDC Amendment, the Commission should
consider the criteria within UDC, Section 21.4.7 D.

BACKGROUND: The final plat of Enterprise Industrial Park Subdivision was approved on May 28, 2008 by the
Planning and Zoning Commission. The plat was amended on August 30, 2013 to adjust the lot line between
Lots 1 & 2, add a fourteen foot (14') CPS easement and correct the FEMA floodplain. After the amended plat
approval in 2013, a replat was approved on August 13, 2014 creating a new lot from a portion of the former Lot
1 for a total of three lots within this subdivision. A subsequent replat that was recorded on September 16, 2016
created a total of five buildable lots within the subdivision. This current replat request is to further subdivide one
of the existing lots into two lots for a total of 6 buildable lots that will be established within this subdivision.
ITEM SUMMARY: The applicant is proposing to replat Lot 7, Block 1 of the Enterprise Industrial Park
Subdivision into a total of two (2) buildable commercial lots. The new lots being created are Lots 9 (14.7
acres), and 10 (31.12 acres). The property is zoned Manufacturing Light (M -1).
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is generally located on the north side
of the intersection of Schertz Parkway and Lookout Road. The subject property is currently undeveloped.
ACCESS AND CIRCULATION: This development is designed to have two (2) points of access off of Lookout
Road through variable width ingress- egress easements.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with the 1996 Unified
Development Code (UDC), Section VIII.4.1 Tree Preservation /Removal, as the site has vested rights. The tree
affidavit submitted indicates that there are protected and heritage trees on the site that will be removed. Under
the 1996 UDC, heritage and protected trees which are inside the building footprint are exempt from the
mitigation requirement and the exempt trees do not count towards the minimum 25% preservation requirement.
Tree surveys and a protection and mitigation plan will be required as part of the site plan process. Staff is
working with the applicant through the site plan process for Lot 9 to ensure the tree mitigation and preservation
plan complies with the 1996 UDC requirements.
PUBLIC SERVICES: The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable.
PUBLIC IMPROVEMENTS AND SERVICES: No public improvements are required for this subdivision.
• Water and Sewer: This site is currently serviced by Schertz water and sewer.
• Drainage: The applicant is responsible for all drainage associated with the subject property, and for
compliance with the Storm Water regulations. The City Engineer has reviewed and approved a storm
water management plan for the subject tract.
• Road Improvements: No roadway improvements or ROW dedications are required.
