GENERAL INFORMATION:

ITEM SUMMARY: The applicant is proposing to plat approximately 6 acres of land into three (3) residential lots.
The applicant is seeking approval of a waiver to UDC Sec. 21.15.313 wastewater systems in order to install
privately owned On -Site Sewage Facilities (OSSF) on each lot. The subject property currently has one single
family residential unit on one of the lots proposed and the remainder of the site is undeveloped. The site is
zoned Single Family Residential /Agricultural (RA).
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located approximately 3,500 feet
north of the intersection of Pfeil Road and IH -10. There is an existing single - family residence on a portion of
the site. The remainder of the site is undeveloped.
PUBLIC IMPROVEMENTS:
The applicant is seeking approval of a waiver to not extend and connect to public wastewater. Instead of
extending and connecting to the public wastewater system, the applicant is requesting to install a privately
owned On -Site Sewage Facility (OSSF) on each of the lots being proposed. OSSF systems are regulated by
Bexar County. Where the subject site is located, it is considered a dual service area for sewer, where the City
of Schertz is responsible for collection of sanitary sewer and San Antonio River Authority (SARA) treats the
sanitary sewer.
In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts
and parcels on which the development is proposed shall be connected to a public wastewater system.
Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall
comply in full with the requirements of this UDC.
Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF
requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15
Waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article
12 when undue hardship will result from requiring strict compliance.
STAFF ANALYSIS AND RECOMMENDATION:
The applicant is requesting a waiver to the required connection to a public waste water system to allow privately
owned on -site sewage facilities. The request for an on -site sewer facility is due to the lengthy distance to the
nearest sewer line connection and costs associated with building that line. The closest potential sewer
connection to the subject property would be San Antonio River Authority's new sewage treatment plant near IH
10, which is about 3,500 feet away. Extension of a sewer line to the subject site would require the line to be
extended approximately 3,500 linear feet along Pfeil Road and would also require an estimated nine manholes.
For proposed Lots 3 and 4, in order to connect to sewer, easements would be required across numerous
private tracts.
This waiver request has been reviewed with no objections by Public Works, Engineering and Planning
Departments. Staff recommends approval of the waiver based on the distance to the nearest available sewer
connection. The granting of this waiver will not have a negative impact on existing or proposed municipal
infrastructure. Additionally, granting of this waiver will not be detrimental to the public health, safety or welfare,
or be injurious to other properties in the area.

COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its
opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and
Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest.
In making their findings, the Planning and Zoning Commission shall take into account the nature of the
proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will
reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and
upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the
Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of
other land in the area in accordance with the provisions of this UDC. Such findings of the
Planning and Zoning Commission, together with the specified facts upon which such findings
are based, shall be incorporated into the official minutes of the Planning and Zoning
Commission meeting at which such waiver is granted. Waivers may be granted only when in

harmony with the general purpose and intent of this UDC so that the public health, safety, and
welfare may be secured and justice done.
B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver.
C. Such findings together with the specific facts on which such findings are based shall be incorporated into the
official minutes of the Planning and Zoning Commission meeting at which such exception is granted.
D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law,
ordinance, code or regulation of the City.
E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may
be appealed to the City Council. When considering an appeal, the City Council shall consider the same
standards as the Planning and Zoning Commission as outlined above.

Dear Ms. Gould:
Pursuant to UDC Section 21.12.15-Waivers, the Owners of the above referenced tract hereby
request a waiver for providing sanitary sewer system to the above referenced tract and to allow for
privately owned Onsite Sanitary Sewer Facilities (OSSF). We have coordinated with the City of
Schertz Public Works Department, and there are no City of Schertz public sanitary sewer lines in
the vicinity of this tract. The Owner of this tract proposes to provide an OSSF in accordance with
Bexar County Regulations. The existing house on existing Lot I (proposed Lot 2) already has a
septic system onsite; therefore, the proposed lots are already proven to be suitable for the design
and installation of private septic systems.
After requesting of Ms. Emily Grobe of your office the location of the nearest sewer system, she
said that the sewer is so far away that a nearest location was not realistically locatable. For the
purpose of this letter, we will therefore assume that the San Antonio River Authority's new
sewage treatment plant near IH 10 (east of Pfeil Road) will ultimately have a gravity main in the
IH 10 west bound frontage road. The connection to the theoretical sewer line would require
approximately 3,500 feet of new sewer line running from the subdivision in a southwesterly
direction along Pfeil Road toward the IHI 0 frontage Road, including an estimated nine manholes
(please see attached Exhibit).
The subdivision's elevation at Pfeil Road is at elevation 660. The elevation of the frontage road at
Pfeil Road is 634; therefore, a gravity main appears to be a theoretical possibility. The lowest
elevation of the subdivision is at 644 (on proposed Lot 4). An offsite gravity sewer main that
would service Lots 3 and 4 would require easements across many private tracts, which in our
professional opinion is not feasible. Therefore, Lots 3 and 4 must have private lift stations to
pump their effluent up to Pfeil Road's theoretical gravity main.

The estimated cost to provide sewer service to the proposed replat is:
1. 8" PVC Gravity Sanitary Sewer= 3,500 LF @ $80.00/LF = $280,000
2. 9 Sanitary Sewer Manholes (assume 400-ft spacing) @ $7,500/each = $ 67,500
3. Two private Lift Station @ $10,000 each = $ 20,000
Total = $367,500
The large sum required to extend the sanitary sewer line would be a substantial burden on the
owner of Lots 2-4, and worth far more than the value of the platted lots. In addition, this cost is
based on a hypothetical scenario that does not currently exist. For the above stated reasons, we
hereby request a waiver be granted for the proposed Lots 2-4, Replat of Cullins Subdivision.

reviewed and permitted through BexarCoUn1y. A building permit will not be issued
without either Bexar County OSSF approved permit or extension of and connection to
the public system.

ITEM SUMMARY: The applicant is proposing to replat the existing Lot 1, of the Cullins Subdivision, and an
adjacent unplatted 2.1 acre area to create a total of three (3) residential lots.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located approximately 3,500 feet
north of the intersection of Pfeil Road and IH -10. There is an existing single - family residence on a portion of
the site. The remainder of the site is undeveloped.
PUBLIC NOTICE: Texas Local Government Code Section 212.015 requires that a public hearing notice be
published and written notice be provided to owners of lots in the original subdivision and that are within 200 feet
of the lots to be replatted. The Cullins Subdivision currently consists of only one lot, of which is owned by Ms.
Cullins, the owner /applicant for this replat request. One (1) public hearing notice was mailed to the property
owner on April 5, 2018 and the notice was published in the San Antonio Express on April 5, 2018. At the time
of this staff report no responses have been received.
ACCESS AND CIRCULATION: All three lots are designed to have direct access off Pfeil Road.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with the Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a tree
affidavit which indicates that no damage or destruction to any protected or heritage trees will occur with this
plat.
PARKS: There is no parkland being proposed with this subdivision. A fee -in lieu of parkland dedication in the
amount of $1,000 per dwelling unit for the two new lots being created will be due prior to recording of the replat.
PUBLIC SERVICES: The site is serviced by City of Schertz for water, City of Schertz and SARA for sewer
(dual service area), CPS, Charter Communications, and AT &T.
PUBLIC IMPROVEMENTS AND SERVICES: No public infrastructure improvements are required for this
subdivision.
Water: The site will be serviced through an existing 8" water line that runs along Pfeil Road.
Sewer: This site is not currently serviced by a public wastewater system. The applicant is requesting a waiver
to allow proposed Lots 2, 3, and 4 to each be served by an on -site sewage facility (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. Engineering Department has reviewed and approved the storm water
management plan.
Sidewalks Hike and Bike Trails: Sidewalks along Pfeil Road are required and will need to be installed with
development of the newly created lots.
Road Improvements: No right -of -way dedications or roadway improvements are required.
STAFF ANALYSIS AND RECOMMENDATION: The proposed replat is consistent with all applicable zoning
requirements for the property, ordinances, and regulations of the City. Staff recommends approval of the replat.

CASE: ZC2018 -002 — UDC Amendment to Article 9 to exempt Public Water and
Wastewater from landscaping, tree planting and mitigation, and architectural
requirements.
SUBJECT: Hold a public hearing, consider and make a recommendation on an amendment
of Part III, Schertz Codes of Ordinances, Unified Development Code (UDC), to
subsections in Articles 9 and 16 to amend certain site design standards for public
water and wastewater facilities.
GENERAL INFORMATION:
As stated in the UDC, City Council from time to time, on its own motion, or at the recommendation of City
Staff make amendments, change or modify text to any portion of the UDC to establish and maintain sound
stable and desirable development. It is generally considered good practice to periodically review and
update the development regulations due to changing conditions, community goals and State and Federal
regulations.
These amendments were drafted by the Planning and Engineering Staff.
BACKGROUND SUMMARY:
During the development of several recent Capital Improvement Projects involving water and wastewater
facilities, the Engineering Staff has found that several of the requirements in the UDC are in conflict with the
goals of these facilities. In the past, several variances were required from the current UDC requirements for
water and wastewater facilities. Through a series of internal meetings, Planning and Engineering Staff
determined that it would be appropriate to make the necessary changes to the UDC in order to streamline
the approval process. The changes being proposed are limited to public water and wastewater facilities as
defined in the definition that is proposed to be added to Article 16.
PROPOSED AMENDMENTS:
Below is a summary of the proposed amendments to Article 9
• Section 21 .9.5 Exterior Construction and Design Standards
o 21.9.5.B.1: Proposed change to exempt public water and wastewater facilities from the
requirements of this section to allow the structures of these facilities to not adhere to the
exterior architectural requirements.
• Section 21.9.7 Landscaping
o 21.9.7.E.1: Proposed change to exempt public water and wastewater facilities from the
planting requirements of this section.
• 21.9.7.G.2: Proposed addition to remove the requirement for landscaping in the landscape
buffer when an 8' masonry fence is installed at or near the property line adjacent to
residential use, residential zone(s), or a public right -of -way.
• 21.9.7.H: Proposed change to exempt public water and wastewater facilities from the
landscaping requirements associated with parking areas.
• Section 21.9.8 Screening and Fencing
• Section 21.9.8.B.1: Exempting public water and wastewater facilities from this provision so
that fencing could exceed eight (8) feet and also so that opaque fencing could be placed in
the front yard.
• Section 21.9.8.B.2.b: Proposed to allow barb wire fencing if being used for public water
and wastewater facilities so long as fencing is not visible from public rights -of -way.
• Section 21.9.9 Tree Preservation and Mitigation
• 21.9.9.B.1.a: Proposed change to exempt public water and wastewater facilities from the
tree preservation and mitigation requirements.
• 21.9.9.C.1 and 21.9.9.C.2: Appeals related to approval by the Director of Parks,
Recreation, and Community Services for tree removal permit may be appealed to the
Planning and Zoning Commission.
Below is a summary of the proposed amendments to Article 16
• Section 21.16 Addition of the proposed definition for public water and wastewater facilities.
STAFF RECOMMENDATION:
Staff recommends approval of the amendments to the following Unified Development Code (UDC)
Sections: Article 9, Sections; 21.9.5 Exterior Construction and Design Standards, 21.9.7 Landscaping,
21.9.8 Screening and Fencing, and 21.9.9 Tree Preservation and Mitigation; and Article 16 Definitions.

Unified Development Code Amendments. In considering action on a UDC Amendment, the Commission
should consider the criteria within UDC, Section 21.4.7 D.

Sec. 21.9.5.B.1. Exterior construction and design standards.
B. Applicability. The provisions of this section are deemed to be minimum standards and shall
be applicable to the following:
1. All new buildings within the corporate limits of the City except public schools and
pliblic water and wastewater facilities; and

2. A minimum of twenty percent (20 %) of the total land area of any proposed multifamily
or nonresidential development shall be landscaped and shall be comprised of trees,
shrubs, sod or other ground cover. In the event of the construction of a phased
development, the minimum twenty percent (20 %) requirement shall apply to each phase
as it is developed.
3. All properties shall provide shade trees at a ratio of nine (9) trees per acre (43,560
square feet) of gross lot area. Industrial property shall provide shade trees at a ratio of
nine (9) trees per acre, calculated at sixty percent (60 %) of the gross lot area or by
exclusion of the main enclosure structure ground floor area from the gross lot area,
whichever is less. Public schools shall provide shade trees at a ratio of at least four (4)
trees per acre. Existing trees may be counted toward meeting the requirements of this
section.
a. Every single family residential lot shall provide a minimum of three (3) shade trees
which shall include a minimum of one (1) tree in the front yard and one (1) tree in
the rear yard.
b. Any property that is unable to satisfy the tree requirements of this section shall be
required to pay tree mitigation fees in accordance with section 21.9.9 of this UDC.
3. The use of native and adapted, drought tolerant plants is encouraged to meet the
requirements of this section.
4. Artificial plants or turf shall not be counted towards meeting the requirements of this
section.
Sec. 21.9.7.G. Landscaping.
G. Nonresidential and Multifamily Landscape Buffer Requirements.
1, In addition to any screening requirements of section 21.9.8, a nonresidential or
multifamily use adjacent to a residential use or residentially zoned property shall provide
a minimum twenty foot (20') landscape buffer adjacent to the property line of the
residential use or residentially zoned property. A minimum of one (1) shade tree shall be

planted for each thirty linear feet (30') of landscape buffer. A minimum of ten (10)
shrubs shall be planted for each fifty linear feet (50') of landscape buffer. All other areas
within the landscape buffer shall be covered with grass or another solid vegetative cover
approved at the time of Site Plan approval.

Sec. 21.9.7.H. Landscaping.
H. Parking Area Landscaping. Parking lots, vehicular use areas and parked vehicles are to be
effectively screened from the public view and adjacent property. Both the interior and
perimeter of such areas shall be landscaped in accordance with the following criteria. Areas
used for parking or vehicle storage that are under, on or within buildings are exempt from
these standards. Section H does not apply to public schools, or public water and wastewater
facilities.
Sec. 21.9.8.13. Fences in Nonresidential and Multifamily Areas.
1. Height. No fence, screen, or wall shall exceed eight feet (8') in height. No fence, screen, or
wall within a required front yard shall exceed eight feet (8') in height. Fences constructed in the
front yard shall be non - opaque and shall not interfere with the sight visibility triangle as required
by this UDC or any other applicable City ordinances, codes and regulations. "I;lblic water and

2. Fence Materials.
a. Materials Permitted. Fences may be constructed of pressure treated wood, decorative metal,
chain link or similar woven wire mesh, stone, brick, or other materials traditionally used in
private fence construction.
b. Prohibited Materials. Above- ground electrical fencing, wire mesh (such as hog wire or
chicken wire), screening slats within chain link fences and barbed wire are prohibited except
when being tised on parcels or lots one (1) acre or greater in size in conjunction with the
containment of livestock or farm animals, or when used for public; water and wastewater

Sec. 21.9.9.B .I.a. Tree Preservation and Mitigation.
B. Applicability and Exemptions.
1. The provisions of this section are applicable to the following:
a. all new residential and nonresidential development within the City except public
schools and public water and wastewater facilities;
Sec. 21.9.9.0 Tree Preservation and Mitigation.
C. Tree Preservation. The existing natural landscape character, especially native oaks, elms,
and pecan trees, shall be preserved to the maximum extent reasonable and feasible. Except
as otherwise exempted in section 21.9.9.13.3. above, a tree removal permit is required for the
removal of any tree with a DBH greater than eight inches.
1. Protected Trees. Any Protected Trees not exempt from preservation in section B.3.
above may be removed upon approval of a Tree Removal Permit by the Director of
Parks, Recreation and Community Services Any decision of the Director of Parks,
Rrecreation and Community Services regarding a tree removal permit may be appealed

2. Heritage Trees. Any Heritage Trees to be removed may be removed upon approval of a
Tree Removal Permit by the Director of Parks, Recreation and Community Services.
Any decision by the Director of Parks, Recreation and Community Services regarding a
tree removal permit may be appealed to 4ie434A-flie Plannima and Zonino Commission
in accordance with section 21.4.14 of this UDC. All Heritage Trees shall be required to
meet the mitigation requirements of this section.
