Guadalupe County, Texas.

Section 395.058 (c) (4) of the Texas Local Government Code requires the Capital Improvements Advisory
Committee (CIAC) to file semi - annual reports with respect to the progress of the capital improvements plan and
report to City Council any perceived inequities in implementing the plan or imposing impact fees. Section 90-
158 of the City's Code of Ordinance includes this same requirement.
The two expense to the Capital Impact Fee Funds for this period were auditor services fees for both Water and
Sewer Impact Fees and investment management fees against the Sewer Impact Fees only.
Project Expenses for Water Impact Fee projects was $6,248.00 in engineering costs for the Corbett Elevated
Tank.
Project Expenses for the Sewer Impact Fee projects was $247,870.62 in engineering costs for the Woman
Hollering Trunk Line.
The attached report is the semi - annual report from October 1, 2017 through March 31, 2018,
STAFF ANALYSIS AND RECOMMENDATION:
Staff recommends the CIAC accept this report and file the semi - annual report with City Council. The semi-
annual report will consist of the items presented to the CIAC and the draft minutes from this meeting.

was not consistent with the properties' zoning. The commissioners and staff had a general
discussion on properties within floodplain areas, properties zoned M -1, and areas that are
designated by the Future Land Use Plan as commercial campus and estate neighborhood. The
discussion also included sewer availability in southern Schertz, staff's anticipated UDC
Amendments, and a brief discussion on the current status of light rail and how it may affect the
City's Future Land Use Plan.

Mrs. Gould gave a presentation on a request for approval of a waiver to the requirement to
extend and connect to a public wastewater system for proposed Lots 2, 3, and 4, of the Cullins
Subdivision. Mrs. Gould described the general location of the project site and indicated that
extension and connection to the nearest public sewer line would involve roughly 3,500 feet of
sewer line construction and about 9 manholes. Mrs. Gould indicated that staff recommended
approval of the waiver based on the distance to the nearest available sewer connection.
Staff and commissioners had a discussion about the location of the subdivision and plans for the
future South Schertz plant. The commission inquired about whether this subject site is within
the service area for the future south plant facility and staff confirmed that the project site is
within the dual service area of the City and SARA and that it would not be serviced by the south
Schertz plant.

ITEM SUMMARY: The applicant is proposing to replat approximately 5.405 acres of land into two (2)

a small portion being used as Single - Family Residential which is to be demolished, and is at 3581 FM 3009
and 3701 FM 3009.
PUBLIC NOTICE: Texas Local Government Code Section 212.015 requires that a public hearing notice be
published and written notice be provided to owners of lots in the original subdivision and that are within 200
feet of the lots to be replatted. The Cal Stone Subdivision currently consists of two (2) lots, one of which, Cal
Stone Lot 1, is owned by Kellum Real Estate, LLC, the owner /applicant for this replat request. The other
original Cal Stone Subdivision Lot 2 is not included within this requested replat. Two (2) public hearing notices
were mailed to the property owners on April 19, 2018 and the notice was published in the San Antonio
Express on April 20, 2018. At the time of this staff report no responses have been received.
ACCESS AND CIRCULATION: Due to the properties being adjacent to FM 3009, TXDOT has indicated
that a maximum of one (1) access point will be allowed for the two lots. Specifically Lot 4 is designed to
have one access point off of F.M. 3009, for both lots to utilize. The lots are interconnected by a designated
25 foot Ingress/ Egress Easement as shown on the plat.
TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with the Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
tree affidavit which indicates that no damage or destruction to any protected or heritage trees will occur with
the replat. Tree preservation and mitigation will also be reviewed with the development of the two lots.
PUBLIC SERVICES: The site is serviced by Schertz water, CCMA, GVEC, AT &T, Spectrum/ Time Warner
Cable, and Centerpoint Energy.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be
installed prior to recording of the replat per UDC, Section 21.4.15., unless otherwise specified in an
approved development agreement.
Water and Sewer: This site will be serviced through a 12" water line and 8" sewer line located along FM 3009.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for
compliance with the Storm Water regulations. A drainage plan has been reviewed and approved by the City
Engineer.
Sidewalks Hike and Bike Trails: Sidewalks along FM 3009 are required and will be installed with
development of the newly created lots.
Road Improvements: The subject property is located adjacent to FM 3009, a TXDOT roadway. On January
13, 2017 TXDOT provided a no object to access and drainage letter. Currently FM 3009 is a 120' ROW. No
dedication is proposed or required along FM 3009.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed replat is consistent with applicable requirements for the property, ordinances and
regulations. Staff recommends approval of the replat.

CASE: ZC2018 -002 — UDC Amendment to Article 9 to exempt Public Water and
Wastewater from landscaping, tree planting and mitigation, and architectural
requirements.
SUBJECT: Hold a public hearing, consider and make a recommendation on an amendment
of Part III, Schertz Codes of Ordinances, Unified Development Code (UDC), to
subsections in Articles 9 and 16 to amend certain site design standards for public
water and wastewater facilities.
GENERAL INFORMATION:
As stated in the UDC, City Council from time to time, on its own motion, or at the recommendation of City
Staff make amendments, change or modify text to any portion of the UDC to establish and maintain sound
stable and desirable development. It is generally considered good practice to periodically review and
update the development regulations due to changing conditions, community goals and State and Federal
regulations.
These amendments were drafted by the Planning and Engineering Staff.
UPDATE:
This item was presented to the Planning and Zoning Commission at the last meeting on April 25,
2018. The Commission tabled the item so that staff could evaluate the current UDC requirements
for steel utility poles. Staff has reviewed UDC Section 21.15.4, which requires steel poles unless a
waiver is granted by the City Manager or his/her designee to allow wooden poles. Staff believes
that the UDC's current utility pole requirements are applicable to uses beyond public water and
wastewater facilities, thus staff would like to fully evaluate potential ways to amend Section 21.15.4
separate from the current proposed amendments. This will allow us adequate time to reach out to
each of the electricity service providers, look into the pros and cons of steel versus wooden poles,
evaluate potential criteria for waiver requests, and prepare any proposed amendments upon full
evaluation of the poles in different scenarios beyond public water and wastewater facilities.
During the April 25, 2018 meeting, comments were provided by the Commission regarding how
certain development standards would be implemented for future public water and wastewater
facilities. Staff plans to present some visual depictions of existing facilities to demonstrate how the
proposed UDC amendments would affect the design of different facility types.
BACKGROUND SUMMARY:
During the development of several recent Capital Improvement Projects involving water and wastewater
facilities, the Engineering Staff has found that several of the requirements in the UDC are in conflict with the
goals of these facilities. In the past, several variances were required from the current UDC requirements for
water and wastewater facilities. Through a series of internal meetings, Planning and Engineering Staff
determined that it would be appropriate to make the necessary changes to the UDC in order to streamline
the approval process. The changes being proposed are limited to public water and wastewater facilities as
defined in the definition that is proposed to be added to Article 16.
PROPOSED AMENDMENTS:
Below is a summary of the proposed amendments to Article 9
• Section 21.9.5 Exterior Construction and Design Standards
o 21.9.5.6.1: Proposed change to exempt public water and wastewater facilities from the
requirements of this section to allow the structures of these facilities to not adhere to the
exterior architectural requirements.
• Section 21.9.7 Landscaping
0 21.9.7.E.1: Proposed change to exempt public water and wastewater facilities from the
planting requirements of this section.
0 21.9.7.G.2: Proposed addition to remove the requirement for landscaping in the landscape
buffer when an 8' masonry fence is installed at or near the property line adjacent to
residential use, residential zone(s), or a public right -of -way.
0 21.9.7.H: Proposed change to exempt public water and wastewater facilities from the
landscaping requirements associated with parking areas.
• Section 21.9.8 Screening and Fencing
• Section 21.9.8.6.1: Exempting public water and wastewater facilities from this provision so
that fencing could exceed eight (8) feet and also so that opaque fencing could be placed in
the front yard.
• Section 21.9.8.B.2.b: Proposed to allow barb wire fencing if being used for public water
and wastewater facilities so long as fencing is not visible from public rights -of -way.
• Section 21.9.9 Tree Preservation and Mitigation

Staff recommends approval of the amendments to the following Unified Development Code (UDC)
Sections: Article 9, Sections; 21.9.5 Exterior Construction and Design Standards, 21.9.7 Landscaping,
21 .9.8 Screening and Fencing, and 21.9.9 Tree Preservation and Mitigation; and Article 16 Definitions.

The Planning and Zoning Commission in making a recommendation to City Council on the proposed
Unified Development Code Amendments. In considering action on a UDC Amendment, the Commission
should consider the criteria within UDC, Section 21.4.7 D.

Sec. 21.9.5.B.1. Exterior construction and design standards.
B. Applicability. The provisions of this section are deemed to be minimum standards and shall
be applicable to the following:
1. All new buildings within the corporate limits of the City except public schools and
pliblic water and wastewater facilities; and
Sec. 21.9.7.E. Landscaping.
E. Landscape Installation Required.

2. A minimum of twenty percent (20 %) of the total land area of any proposed multifamily
or nonresidential development shall be landscaped and shall be comprised of trees,
shrubs, sod or other ground cover. In the event of the construction of a phased
development, the minimum twenty percent (20 %) requirement shall apply to each phase
as it is developed.
3. All properties shall provide shade trees at a ratio of nine (9) trees per acre (43,560
square feet) of gross lot area. Industrial property shall provide shade trees at a ratio of
nine (9) trees per acre, calculated at sixty percent (60 %) of the gross lot area or by
exclusion of the main enclosure structure ground floor area from the gross lot area,
whichever is less. Public schools shall provide shade trees at a ratio of at least four (4)
trees per acre. Existing trees may be counted toward meeting the requirements of this
section.
a. Every single family residential lot shall provide a minimum of three (3) shade trees
which shall include a minimum of one (1) tree in the front yard and one (1) tree in
the rear yard.
b. Any property that is unable to satisfy the tree requirements of this section shall be
required to pay tree mitigation fees in accordance with section 21.9.9 of this UDC.
3. The use of native and adapted, drought tolerant plants is encouraged to meet the
requirements of this section.
4. Artificial plants or turf shall not be counted towards meeting the requirements of this
section.
Sec. 21.9.7.G. Landscaping.
G. Nonresidential and Multifamily Landscape Buffer Requirements.
1, In addition to any screening requirements of section 21.9.8, a nonresidential or
multifamily use adjacent to a residential use or residentially zoned property shall provide
a minimum twenty foot (20') landscape buffer adjacent to the property line of the
residential use or residentially zoned property. A minimum of one (1) shade tree shall be

planted for each thirty linear feet (30') of landscape buffer. A minimum of ten (10)
shrubs shall be planted for each fifty linear feet (50') of landscape buffer. All other areas
within the landscape buffer shall be covered with grass or another solid vegetative cover
approved at the time of Site Plan approval.

Sec. 21.9.7.H. Landscaping.
H. Parking Area Landscaping. Parking lots, vehicular use areas and parked vehicles are to be
effectively screened from the public view and adjacent property. Both the interior and
perimeter of such areas shall be landscaped in accordance with the following criteria. Areas
used for parking or vehicle storage that are under, on or within buildings are exempt from
these standards. Section H does not apply to public schools, or public water and wastewater
facilities.
Sec. 21.9.8.13. Fences in Nonresidential and Multifamily Areas.
1. Height. No fence, screen, or wall shall exceed eight feet (8') in height. No fence, screen, or
wall within a required front yard shall exceed eight feet (8') in height. Fences constructed in the
front yard shall be non - opaque and shall not interfere with the sight visibility triangle as required
by this UDC or any other applicable City ordinances, codes and regulations. "I;lblic water and

2. Fence Materials.
a. Materials Permitted. Fences may be constructed of pressure treated wood, decorative metal,
chain link or similar woven wire mesh, stone, brick, or other materials traditionally used in
private fence construction.
b. Prohibited Materials. Above- ground electrical fencing, wire mesh (such as hog wire or
chicken wire), screening slats within chain link fences and barbed wire are prohibited except
when being tised on parcels or lots one (1) acre or greater in size in conjunction with the
containment of livestock or farm animals, or when used for public; water and wastewater

Sec. 21.9.9.B .I.a. Tree Preservation and Mitigation.
B. Applicability and Exemptions.
1. The provisions of this section are applicable to the following:
a. all new residential and nonresidential development within the City except public
schools and public water and wastewater facilities;
Sec. 21.9.9.0 Tree Preservation and Mitigation.
C. Tree Preservation. The existing natural landscape character, especially native oaks, elms,
and pecan trees, shall be preserved to the maximum extent reasonable and feasible. Except
as otherwise exempted in section 21.9.9.13.3. above, a tree removal permit is required for the
removal of any tree with a DBH greater than eight inches.
1. Protected Trees. Any Protected Trees not exempt from preservation in section B.3.
above may be removed upon approval of a Tree Removal Permit by the Director of
Parks, Recreation and Community Services Any decision of the Director of Parks,
Rrecreation and Community Services regarding a tree removal permit may be appealed

2. Heritage Trees. Any Heritage Trees to be removed may be removed upon approval of a
Tree Removal Permit by the Director of Parks, Recreation and Community Services.
Any decision by the Director of Parks, Recreation and Community Services regarding a
tree removal permit may be appealed to 4ie434A-flie Plannima and Zonino Commission
in accordance with section 21.4.14 of this UDC. All Heritage Trees shall be required to
meet the mitigation requirements of this section.
