UNIVERSAL SCHERTZ, TEXAS AUTHORIZING AN INTERLOCAL COOPERATIVE
AGREEMENT WITH THE CITIES OF CIBOLO, LIVE OAK,
'a AND R COUNTY ', OTHER
THEREWITH MATTERS IN CONNECTION
WHEREAS, the Parties recognize the vulnerability of the people and communities
located in the cities of Cibolo, Live Oak, Schertz, Selma, Universal City and Bexar, Guadalupe
and Comal Counties to damage, injury, and loss of life and property resulting from criminal
activity and enforcement of laws that may present equipment and manpower requirements
beyond the capacity of each individual Party; and
WHEREAS, the Parties must confront the threats to public health and safety posed by
possible criminal activity capable of causing severe damage to property and danger to life;
specifically in the area of fraud to include Fraudulent Use of Possession of Identifying
Information, Misapplication of Fiduciary Property, Forgery and Credit Card or Debit Card
Abuse; and
WHEREAS, the Parties to this Interlocal Agreement recognize that it is in the best
interests of themselves and their citizens to create a plan to foster communications and the
sharing of resources, personnel and equipment in the event of such criminal activity and
enforcement of laws; and
WHEREAS, the governing officials of the Parties desire to secure for each Party the
benefits of the Interlocal Agreement for the protection of life and property in the investigation of
criminal activity and enforcement of laws; and
WHEREAS, the Parties wish to make suitable arrangements for furnishing assistance in
coping with criminal investigations and enforcement of laws and are so authorized and make this
Agreement pursuant to Chapter 791, Texas Government Code (Interlocal Cooperation Act); and
Chapter 362, Local Government Code; and
WHEREAS, the Parties recognize that a formal Interlocal Agreement would allow for
better coordination of effort, would provide that adequate equipment, facilities and manpower is
available, and would help ensure that assistance is accomplished on an as requested basis and
thus desire to enter into an agreement to provide assistance; and
WHEREAS, it is expressly understood that any Mutual Aid extended under this
Agreement and the operational plans adopted pursuant thereto, is furnished in accordance with
the Chapter 362, Local Government Code, and other applicable provisions of law.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS THAT:
Section 1. The City Council hereby authorizes the City Manager and Police Chief to
execute the Agreement with the Cities of Cibolo, Live Oak, Schertz, Selma, Universal City and
Bexar County in substantially the form set forth on Exhibit A.
Section 2. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings of the City Council.
Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 4. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 5. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the City
Council hereby declares that this Resolution would have been enacted without such invalid
provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Government Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final
passage, and it is so resolved.
