MINUTES OF WORKSHOP JUNE 7, 2018
I. Call to Order and Establish a Quorum.
Mayor Carpenter called the workshop to order at 6:44 PM.
Members present were:

II. Introduction
Mayor Carpenter welcomed those present.
III. OLD BUSINESS:
1. Update regarding Member Cities listing of all Emergency Operations Assets
and primary points of contact. — Status
Mayor Carpenter stated we are continuing to gather information that we will
begin to share with everyone. Mayor Carpenter stated that our ( Schertz)
Emergency Coordinator or a designee would be willing to meet quarterly with
others from the group. If we need to continue this discussion next meeting, we
can do that.
Mayor Thompson stated that he has spent some time with their County
Emergency Coordinator due to our size and having partnered with the county. In
his words he stated that he works for him. He came and the walked around the
city and gave suggestions that their conference room could be made into a
command center an alternate facility for him as well. They recently went through
getting their hazardous mitigation plan approved by council. The city is doing a
new emergency management plan to start energizing their staff. Mayor Thompson
stated that he did have conversations with the County person that we wanted to
possibly partner with them. He stated that he would start unearthing some of the
old interlocal agreements to see how they would fit with what we (NEP) would
like to do. This process will take a while, but they have some help, and this is
their primary job.
Mayor Williams stated that he turned in the basic of what the City of Universal
City has to Brenda. He also stated that they have a relationship with the county.
Mayor Carpenter stated that we will continue this discussion and place it on each
workshop agenda as we are working on this.
2. Discussion regarding the purpose and goals of the NEP organization.
Mayor Carpenter stated he does not believe there are any changes or asked if
there was anything the members wanted to discuss for clarification or
ratification. Members present did not have anything currently.
IV. NEW BUSINESS:
3. Discussion regarding an appointment to the Alamo Area Metropolitan
Planning Technical Advisory Committee (TAC).
Mayor Carpenter stated that we have a regular member, but we do not have an
alternate member to sit in when and if our regular member can't be there. We do
have a volunteer to do that.
Mayor Carpenter recognized Mayor Boyle who stated that City Councilmember
Joel Hicks is very interested in the alternate position. Mayor Boyle stated that
Mr. Hicks has been attending the meetings since the beginning of the year and is
very interested and qualified for the position.
Mayor Williams stated that Blake has been on the MPO for several years and has
also been a great asset to NEP.
It was the concurrence of the members present to bring forward on the next
agenda the appointment of Mr. Hicks.
4. Discussion and update regarding the Cities and NEP relationship with JBSA.
(Nigel Davies)
Mr. Nigel Davies spoke regarding his close relationships with JBSA and that he
would be happy to assist in any way possible with keeping the relationship going
with NEP. He wanted to know how he could work with JBSA and NEP to
leverage those relationships. He is looking for guidance of the Mayors of NEP.
Members present stated that we fine out earlier enough where NEP can work with
them and act on it. Mayor Williams stated that several Mayors have relationships
with members of Randolph and it would be great if Nigel could strengthen those
relationships as he has those contacts.
Mr. Davies stated that he has known Major Smith who is with the Outreach
program for over two years and has a great relationship, and this will also help.
Mayor Dennis stated she feels disconnected sometimes from the base, she attends
all the events that she has been invited to but is curious to know what Mr. Davies
is doing and what he is working on. Mr. Davies stated that he is working very
closely with the 558. He stated that they want to do more for the community, but
it is hard as they are a little scattered. There is .a problem with all the students
trying to get them occupied. They are all trying to find out where they fit,
especially the new leadership and he is working with that.
Mayor Dennis asked how we can help them, specifically Randolph, such as
maybe we can do their streets cheaper than they are doing. Mr. Davies stated that
that is one thing that they would really be interested in. Mayor Dennis stated that
these are the things that she is really looking for, so we can have a more solid
thing to say. Mr. Davies stated that this would be something for General
Lenderman to work with. Mayor Dennis and Mayor Williams reminded Nigel of
the Airman recognition program that we did a while back and that they are
interested in continuing.
Members discussed a possible welcome reception with General Lenderman
outside the base. Mr. Davies stated that he would contact the General and get the
ball rolling. Members present also let Mr. Davies know that they are very
interested in participating in the different awards ceremonies for the Airmen that
come up and to please let them know.
Mayors present stated that we all should invite members from Randolph to our
city events. Somehow obtain a list that we can send out notices. Also discussed
was getting the wives involved in different city events, especially those that need
volunteers.
Mayor Carpenter stated that we could use the base assistance with the upcoming
VFW event. He stated as soon as he gets the information he would share out to
Nigel and the others. Mayor Carpenter stated it would be great to fill the VFW
hall.
The Mayors continue discussions regarding keeping communications open with
the base, and if there is anyway Nigel can assist us it would be great. Any
information you may have to send it to Brenda shall disseminate out to the
Mayors.
5. Discussion regarding the cancellation of the NEP July Meetings.
Members present agreed that due to the Holiday and those possibly traveling the
NEP July meetings should be cancelled. An agenda item will be placed on the
next agenda for consideration to be approved.
Mayor Williams indicated that since the upcoming legislation session is on us
August would be a good time for the Representative Cuellar to come speak to us
at our meeting. All we would need to do is contact his office. Mayor Carpenter
indicated the only wrinkle to throw in is Bexar County is beginning to get into the
machination of their budget discussions. Commissioner Calvert called and
indicated that he would like to come speak to us about whether or not we would
be interested in have a resolution of support for things that would be done in our
area, his precinct of Bexar County. He wants to be cautious about resolutions
suggesting to other elected bodies how to spend their money, if this was
something worthwhile he would hear him out. Mayor Dennis indicated that she
would not support a resolution and that the only city he is speaking to is
Converse. That should be between them. She does not support us as an
organization giving a resolution.
V. Items of Interest by the Member Cities.
Mayor Thompson City of Garden Ridge indicated that he and in researching other cities
received a letter from a law firm in Dallas supposedly representing a company Moxy Pest
Control. Moxy pest control is a legitimate company in the law firm is supporting Moxy's
efforts to be able to solicit in their city between five and 9 o'clock and that our ordinance
is preventing them. Mayor Thompson stated they sent the letter to the Denton Navarro
which was very threatening.
Mayor Carpenter stated we received a challenge letter as well interjecting that we are
going to be suspending our ordinance temporarily to revise as not to open ourselves up to
a lawsuit.
Mayor Thompson stated the long and short of this is their coming off to enable Moxy to
come in to do this. Our legal team which is the same legal team to several of us, before
they knew there was over hundred 144 letters, their approach to them was if they didn't
come to us, they didn't apply for a permit, they haven't tried to solicit, and we haven't
stopped them, then they don't have a case.
Mayor Thompson stated the letter is threatening, you have to respond within 10 days, we
are going to file suit, and all the legal fees are going be paid by your city. They cited a
bunch of case laws which none of it is in Texas. Denton Navarro first said were not an
answer or respond and then when they started talking. to other cities they found out some
other cities were involved in this. One of the partners called the firm in Dallas and got
more information that there are many more cities and unearth some more information.
Long and short of this now what Denton Navarro believes is that Moxy really has very
little to do with this because they're small pest control company that would never have
the money to pay for this kind of legal action, but they believe that there's somebody else
behind this. A letter was written from Denton Navarro on behalf of Garden Ridge stating
that their client has not been precluded from soliciting within the city. The City of Garden
Ridge is also going to suspend their ordinance until they have reviewed their ordinance.
It has nothing to do with Moxy or the organization.
Mayor Dennis City of Live Oak inquired if any city had been approached by the anti -fire
arms group. Mayor members present indicated that some have been approached by the
group.
Mayor Boyle City of Cibolo stated that the Youth Alliance Pilot Program at the ballfields
across from City Hall begins this Friday from 7 to 10. Many activities are planned.
Mayor Boyle also stated that on the 22nd of June Malcom Brown, their local NFL Star
will be hosting a football camp at Steel High School. He would like to see maybe next
year where this program could be rotated to other cities and spread it around.
Mayor Dennis City of Live Oak stated that a couple of week ago a gentleman, and she
doesn't know who he is, but he indicated that if there was not a sign posted "Employees
Only" that he can just walk in to these places. They have now put up signs in their City
Hall indicating employees only and secured some of their doors. She indicated that if he
has not visited you yet, he will probably be coming around. If anyone needs more
information just contact Scott Wayman at the city.
Mayor Dennis also inquired if we were going to have someone represent us form a legal
side like we did at the upcoming legislative session in January. We can't wait to look for
that person, they need to be involved and already out there in the field knowing people.
She stated she didn't support it last time and probably won't again, but if we are going to
hire someone we need to do it now.
Mayor Carpenter stated that last session it was an interesting exercise, we received some
benefit out of it, but for the money we spent we could do other things that could have a
bigger influence. Ideas were suggested that we could hire a marketing firm that would
take our ideas and put them together that we could mail out to all the legislators. We need
to have a way to take our message and get it out there. It was also mentioned to get on a
bus and go and knock on doors and see our legislators, be available to testify in front of
committees, etc. Getting up to Austin makes a huge impression. We need to make sure
that we get a bus and get up to Austin like we did last year.
Mayor Williams stated that at the last Military Transformation. Task Force meeting they
did a presentation and the airfield off Martindale off IH 10 they are facing some serious
encroachment problems, and no one knew about it. They were also talking about funding
it, it was formed during the BRAC several years ago. It is a combination of the city —
San Antonio and the County there are Tri Chairs members which include Commissioner
Kevin Wolf — Bexar County, Councilmember Clayton Perry — San Antonio and Carroll
Schubert San Antonio Chamber of Commerce Chair they are looking at funding sources
to continue the group. It does in his opinion have its purpose. This would not be a huge
expense by NEP, he just believes we need to explore this to infuse our partnership.
Mayor Carpenter indicated that he would not have a problem doing this but what he
would ask of the committee in exchange for our donations, for them to come out here to a
reception so we can talk to them about who we are and what we do and why they should
care.
Mayor Dennis reminded everyone of our core values and our vision. Does it have to do
with economic development for the Northeast Partnership. Mayor Carpenter stated that in
that they are very active in the support of Joint Base San Antonio, the preservation of the
missions on all of the bases and if there is a BRAC that closes a facility in transforming
that facility into something useful for the communities around it. From that perspective
that would be correct. Mayor Williams stated as a representative and speaking to them,
they knew nothing that was going on with Randolph unless he told them. Their focus was
Fort Sam and Lackland. Our involvement with them and that group is really important.
Mayor Williams stated that they did not approach him, he just thought that he would
bring it up. Mayor Carpenter indicated to call them up and have them tour Randolph, that
will get them out of down town San Antonio and out here where we are. We must stay
vigilant about Randolph and protect Randolph.
Mayor Seiler stated that the 15th of the month he gets to teach at the upcoming newly
elected officials seminar for small cities. He also stated that he sits on the Regional
Review Committee that will be meeting on the 26th to set the rules for the FY18 /19 for
AACOG submissions.
Mayor Dennis stated that TML puts out great hand books for newly elected officials and
everyone should be able to get one to their elected officials.
Mayor Boyle thanked Ms. Dennis for volunteering her time to sit on their Charter Review
Commission.
Mayor Carpenter asked if other Mayors received an open records request for all their
Mayoral emails from January through March from the graduate student at St Louis
University? No other mayor received the request. Mayor Carpenter explained.
Mayor Carpenter stated he had an opportunity to go on a tour of Brooks City Base, he
encouraged those interested to let him know and he can get them in touch with the
director. Mayor Carpenter explained the makeup of the Brooks City Base and explained
how they have been successful.
Mayor Carpenter stated that on Monday he has an opportunity to sit on a panel with three
others discussing eminent domain with the San Antonio League of Women Voters. He
indicated that this was very interesting and had interesting discussions. There was an
attorney from a Texas firm who helps landowners fight condemnations, there was an
individual from a private firm who does city planning who assists land owners to avoid
condemnations and another individual from the Texas Farm Bureau and their principal
job is to help landowners fight condemnations and of course himself an elected official.
He stated that at the end of the program it was positive and why he is bringing this up two
individuals in charge of the Women League of Voters indicated that if he had friends or
colleagues who would be interested in sitting on a panel of other subjects to let them
know or he know.
Lastly Mayor Carpenter suggested a possible mixer to invite all elected officials from
Bexar and Guadalupe county and some business owners to continue to drive and expand
the dialogue.
VI. Establish a Date, Time, &z Location of the Next Meeting. (Next up is the City of
Kirby to host for August 2, 2018)
The next meeting will be in Kirby.
VII. Review and discussion regarding the Agenda for June 14, 2018, regular meeting.
Add items to cancel the July meetings and the appointment of Joel Hicks to serve as
alternate on the Alamo Area Metropolitan Planning Technical Advisory Committee.
VIII. Adjournment
Mayor Carpenter adjourned the workshop at 8:00 p.m.
