A. PC2018-022 Consider and act upon a request for approval of a preliminary plat for the Fresenius Medical Care subdivision, an approximate 1.5 acre tract of land generally located
approximately 220 feet southeast of the intersection of E. Live Oak Road and FM 3009,
Guadalupe County, Texas. There was a brief discussion.
Mr. Greenwald motioned to table item PC2018-022. Mr. Rae second the motion. The
vote was 5-1 with one nay vote from Mr. Outlaw, motion carried. B. WA2017-006 Consider and act upon a request for approval of a waiver to not connect to the Public
Wastewater System for the Corbett Booster Station Subdivision, an approximate 4.2 acre
tract of land generally located approximately 1000 feet northeast of the intersection of Alsatian Way and Ray Corbett Drive, Bexar County, Texas. There was a brief discussion.
Mr. Outlaw motioned to approve item WA2017-006 with the condition that if further development occurs which would require sanitary sewer facilities, that the applicant would have to apply for OSSF wavier or to connect to sanitary sewer. Mr. Rae second the motion. The vote was 6-0, motion carried.
C. PC2017-018 Consider and act upon a request for approval of a preliminary plat for the Corbett Booster Station Subdivision, an approximate 4.2 acre tract of land generally located
approximately 1000 feet northeast of the intersection of Alsatian Way and Ray Corbett
Drive, Bexar County, Texas. There was a brief discussion.

There was a lengthy discussion. Mr. Outlaw motioned to forward to City Council a recommendation of approval of item PC2017-018 with conditions to amend section M to read accessory buildings, uses, and
structures shall conform to applicable provisions of city adopted codes to include
residential and commercial building codes and fire code with revisions as stated by Staff. Mr. Braud second the motion. The vote was 5-1 with one nay vote from Mr. Greenwald, motion carried.

Commissioners requested staff to gather more information on other cities requirements on Automatic Teller Machine and propose a UDC amendment to allow drive thru Automatic Teller Machines with the appropriate regulations.

SUBJECT: Consider and act upon a request for approval of a final plat of the Lizcano Estates Subdivision, an approximately 10 acre tract of land located at the northeast corner of the intersection of Ware Seguin Road and Ware Seguin Road, more specifically described as 11917 Ware Seguin Road, City of Schertz, Bexar County.
GENERAL INFORMATION: Owner: Juan Enrique and Karen Lizcano Applicant: Urban Civil / Scott B. Horowitz and Keith W. Wooley APPLICATION SUBMITTAL DATE: September 24, 2018 (Original Application) October 9, 2018 (Revised Submittal) ITEM SUMMARY: The applicant is proposing to develop approximately 10 acres of land into four (4) residential lots, Lot 1 being 2.400 acres, Lot 2 being 2.399 acres, Lot 3 being 2.399 acres, and Lot 4 being 2.400 acres. The subject property is zoned Single – Family Residential / Agricultural, R-A. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 11917 Ware Seguin Road and is currently vacant and undeveloped. ACCESS AND CIRCULATION: The proposed lots have frontage on Ware Seguin Road. In order to reduce the number of driveways onto this portion of Ware Seguin Road, which is identified as a Secondary Rural Arterial, the 4 lots will be utilizing a 30’ shared access, 15’ of which is located on Lot 2, and 15’ of which is located on Lot 3. In order for Lots 1 and 4 to have the ability to access this shared access onto Ware Seguin Road there is a 40’ cross access easement across the entire widths of Lot 2 and Lot 3. Additionally, in order to limit the proposed 4 lots to only the one access point there is a 1’ Vehicle Non Access easement across all portion of the lots adjacent to Ware Seguin Road on both the southern and western property lines except for the 30’ of the access point shared between Lot 2 and Lot 3. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a Tree affidavit which indicates that the site does not contain protected or heritage trees. PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community Services Department has determined that a fee-in lieu of parkland dedication in the amount of $1,000 per dwelling unit will be paid by the Developer prior to recording of the final plat.

PUBLIC SERVICES: The site is serviced by City of Schertz Water, SARA, CPS, AT&T, CenterPoint Energy, and Spectrum. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. Water: This site is currently serviced through a City of Schertz 12” water line. Sewer: This site is not currently serviced by a public wastewater system. On September 12, 2018 the Planning & Zoning Commission approved a waiver request to allow all four lots to be served by on-site sewage facilities (OSSF). Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. The City Engineer has reviewed and approved the drainage report. Sidewalks, Hike and Bike Trails: Sidewalks are required along Ware Seguin Road for the length of the subdivision and will be designed to meet the City of Schertz specifications. Road Improvements: The subject property is located adjacent to the bend in Ware Seguin Road. The portion of Ware Seguin Road in which the subject property and proposed lots front is identified on the Master Thoroughfare Plan as a Secondary Rural Arterial roadway consisting of 90’ ROW with 48 feet of pavement which includes curb and gutters. The portion of Ware Seguin Road adjacent to the frontage of the lots is approximately 60-feet wide. The proposed final plat is dedicating 0.402 acres of Right-Of-Way in order to provide their portion of the desired 90’ of ROW. Additionally, the subject properties western property line is adjacent to the portion of Ware Seguin Road that is identified on the Master Thoroughfare Plan as a Residential Collector with 70’ of right-of-way. The portion of Ware Seguin Road adjacent to the western property line is currently 60’ of right-of-way. The proposed final plat is dedicating 5’ of right-of-way adjacent to this property line in order to dedicate their portion of the desired 70’ of right-of-way. STAFF ANALYSIS AND RECOMMENDATION: The proposed final plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval of the final plat. Planning Department Recommendation

Background
September 18, 2018 Reports from Boards and Commissions – Since June 20, 2018
Board of Adjustment
• June 25 - BOA denied four variance requests for sheds that were installed too close to the houses in violation of the setback requirements. The residents indicated that HOA requirements prohibited the sheds from being placed in the backyard as the houses backed up to a golf course.
• August 27 – BOA approved sign variances for a new business. Planning and Zoning Commission
• June 27 – approved the plat for the CCMA south Schertz sewer treatment plant and recommend approval of modified development standards for utility facilities.
• July 11 - approved a plat for a commercial lot.
• July 25 – discussed amendments to the UDC for sheds.
• August 8 – recommended approval of a specific use permit for a convenience store with gas pumps at the current Jack in the Box site on IH 35 and FM 3009. Continued the discussion of UDC amendments for sheds.
• August 22 – recommended approval of a Specific Use Permit for a convenience store with
gas pumps at the corner of Maske Road and FM 1518. Approved the preliminary plat for
the future Fire Station #3 site. Continued the discussion of UDC amendments for sheds.
• September 12 – approved a number of plats and associated waivers. Recommended denial of a rezoning request at FM 1518 and Schaefer Road. Continued the discussion of UDC amendments for sheds.
TSAC August 2 – TSAC discussed prohibiting parking in front of mailboxes. They also recommended approval of school zones in front of Rose Garden Elementary and Danville Middle School (Comal ISD at Hubertus and FM 482).
Historical Preservation July 19 - The Historical Preservation Committee discussed the Summer 2018 Newsletter and Remembrances Special Edition Article 2018-3 which are available on the City’s website.
Parks and Recreation Advisory Board June 25 – The Parks Board discussed and expressed support for creating a trailhead at FM 3009 and Wiederstein Road. They also discussed working with SCUCISD to acquired parkland at Wiederstein Road and Schertz Parkway. They received and update on parks projects and discussed
possible amendments to their bylaws.
Library Board August 6 and September 10 – At both meetings, the Library Board received reports on the board’s finances, library usage and the bookstore.
Schertz Economic Development Corporation
• June 28 - During the meeting, the SEDC Board reviewed the monthly SEDC financials
and the SEDC’s quarterly recruitment activities. The SEDC Board considered, discussed
and approved the SEDC’s 2018-19 budget. The upcoming budget includes over $4
million that will be used for SEDC projects, $456,630 will be allocated for the SEDC’s
service agreement with the City of Schertz, and just under $500,000 will be used for the
SEDC’s recruitment and retention activities.
• July 10 - the SEDC Board approved a Performance Agreement with Kellum Family
Medicine.
• August 23 – Staff presented the July SEDC financial report, the 2nd Quarter Economic
Update, and the Quarterly Business Retention and Expansion (BRE) Update. Staff
provided updates on the BRE plan implementation. During the August meeting staff held
the first in a series of meetings to forecast/plan the use of SEDC reserves. This item will
be added to each of the SEDC Board’s regular meetings to develop a long-term strategy
to use the SEDC fund and grow the Schertz economy. The SEDC Board held a public
hearing and approved the Economic Development Performance Agreement with Schertz
125.
Committee of Committees Advisory Board Summary
CCAB Notes 09/19/18:
Brian James gave the City Manager report. He gave an update on the approved City budget and
tax rate.
Assistant Police Chief Marc Bane provided an overview of Animal Care Services operations,
similar to the work session discussion he provided to City Council on September 11, 2018. The
Board then toured the Animal Adoption Center.
