turnaround structure the nights of November 28th (Wednesday night for SBML) and
November 29th (Thursday night for NBML).

Mayor Carpenter recognized Planner 1 Nick Koplyay who introduced this item stating the
applicant is requesting to rezone the property from General. Business District (GB) and
Manufacturing Light District (M -1) to Planned Development District (PDD).

The Comprehensive Land Use Plan, along with the North Schertz Sector Plan amendment,
identifies this area as Commercial Campus, and the proposed rezone to Planned
Development District (PDD) would allow the property to better represent this land use.
The proposed zoning of the Planned Development District (PDD) would uphold the intent
of the originally approved zoning by maintaining a base zoning of General Business
District (GB) with minor additions, and it would also allow the property to more closely
represent the intended land development characteristics from the Comprehensive Land Use
Plan through the Future Land Use Plan and the North Sliertz Sector Plan. Staff
recommends approval of the requested rezone to Planned Development District (PDD).

Mayor Carpenter recognized Water & Wastewater Manager Jimmy Hooks who stated staff
recommends that City Council approve Resolution 18-R-149, authorizing the City Manager

to enter into an agreement with L. Hoist North America for the lease of 110 acre /ft of
Edwards Aquifer Water in the amount of $28,171.25. Mr. Hooks addressed questions from
Council.
Mayor Carpenter recognized Councilmember Edwards who moved seconded by Mayor
Pro -Tern Scagliola to approve Resolution No. 18 -R -1.49. The vote was unanimous with
Mayor Pro -Tem Scagliola, Councilmembers Davis, Gutierrez, Edwards, Heyward
and Brown voting for and no one voting no. Councilmember Larson was absent.

The funds 'thAt were budgeted for these items would return to FY 2017 -18's Fund balance
since they weren't spent in that fiscal year. This adjustment would move $442,284,
$397,978, and $76,512 from the General Fund, Water &Sewer, and Parkland Dedication
Fund Balances, respectively to reestablish a budget for these items.
Going forward, Public Affairs will be handling ground breakings and grand openings and
Parks will be putting on community events like Jubilee and Moving on Main. The funding
for the Fire Station #3 Grand opening was budgeted in the Special Events Budget which
will now be overseen by Parks. This adjustment will move $4,000 for the grand opening
from Special Events to Public Affairs.

This ordinance will reduce the General Fund Balance in the amount of $442,284, which
was previously authorized to be spent in the FY 2017 -1.8 Budget. The Fund Balances of the
Water & Sewer Fund and the Parkland Dedication Fund will also be reduced by $397,978
and $76,512, respectively, to continue to spend previously authorized funds without
impacting the current budget.
The transfer of the Fire Station #3 Grand Opening will not affect any fund balance, only the
location of expenses for reporting purposes. Staff recommends approval of first reading.

for FY 2018 -19. Staff proposes to amend that budget to re- appropriate funds for programs
and purchases from FY 2017 -1.8 that were not completed and transfer the budget for the
grand opening of Fire Station 3 from Other Events in Special Events to the Public Affairs
Department in the General Fund.

The above equipment and software were budgeted for and ordered before the close of the
fiscal year but delivery and installation was not able to occur until after September 2018. . Due
to rain delays funding for FY 2017 -18's SchertzQ wasn't used until October. Staff still wants
to have an event in the September 2019 . time frame and needs an adjustment to free up
budget.
Based on the Generally Accepted Accounting Principles (GAA.P), which governs how to
properly account for expenses on financial statements, entities must recognize the expense
when it occurs. In the above equipment cases this is when the City takes delivery. Based on
those rules, these expenses will be recorded in FY 2018 -19 and will require a budget
adjustment.
The funds that were budgeted for these items would return to FY 2017 -18's Fund balance
since they weren't spent in that fiscal year. This adjustment would move $442,284, $397,978,
and $76,512 from the General Fund, Water &Sewer, and Parkland Dedication Fund
Balances, respectively to reestablish a budget for these items.
Going forward, Public Affairs will be handling ground breakings and grand openings and
Parks will be putting on community events like Jubilee and Moving on Main. The funding
for the Fire Station 3 Grand opening was budgeted in the Special Events Budget which will
now be overseen by Parks. This adjustment will move $4,000 for the grand opening from
Special Events and to Public Affairs.
City Council approved this on first reading at their meeting ofNovember 27, 2018.
Summary of Recommended Action
Approval of Ordinance 1.8 -T -38 approving the budget adjustment.
FISCAL IMPACT
This ordinance will reduce the General Fund Fund Balance in the amount of $442,284, which
was previously authorized to be spent in the FY 201.7 -18 Budget. The Fund Balances of the
Water & Sewer Fund and the Parkland Dedication Fund will also be reduced by $397,978
and $76,51.2, respectively, to continue to spend previously authorized funds without
impacting the current budget.
The transfer of the Fire Station 3 Grand Opening will not affect any fund balance, only the
location of expenses for reporting purposes.

WHEREAS, pursuant to Ordinance 18 -T -32, the City of Schertz (the "City ") adopted the
budget for the City for the fiscal year 2018 -201.9 (the "Budge ), which provides funding for the
City's operations throughout the 2018 -2019 fiscal year; and
WHEREAS, the City needs to re- appropriate $442,284 from the General Fund Balance,
$397,978 from the Water & Sewer Fund Balance, and $76,512 from the Parkland Dedication
Fund Balance for projects and equipment budgeted for in FY 201.7 -18 but were not able to be

Fire Department's uniforms budget by $977, equipment by $12,644, supplies by $954, and
maintenance by $4,496; the SchertzQ event budget in the Special Events Fund by $25,198; the
Information Technology professional services budget by $231,817 and the equipment budget by
$9,500 for the new permit software and implementation; the Water & Sewer capital outlay
budget by $397,978; and the Parkland Dedication budget by $76,512 for the completion of the
playscape; for a total of $442,284 to be funded by General Fund Fund Balance, $397,978 from
the Water & Sewer Fund Balance, and $76,512 from the Parkland Dedication Fund Balance.
Section 2. The City shall transfer $4,000 from the Special Events Fund to the Public
Affairs Department budget for the Fire Station 3 Grand Opening.
Section 3. The recitals contained in the preamble hereof are hereby found to be true, and
such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part
of the judgment and findings of the Council.
Section 4. All ordinances and codes, or parts thereof, which are in conflict or
inconsistent with any provision of this Ordinance are hereby repealed to the extent of such
conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters
resolved herein.

BACKGROUND
The applicant is proposing to rezone approximately 1.7 acres of land, from General. Business
District (GB) and Manufacturing Light District (M -1) to Planned Development District (PDD).
The purpose of the Planned Development District is to promote and encourage innovative
development that is sensitive to surrounding land uses, while adhering to the provisions outlined
in the Schertz Unified Development Code (UDC). The proposed Planned Development District
(PDD) will maintain a base zoning of General Business District (GB) in regards to its use, with
simple modifications to the architectural design and signage regulations due to the scale and
location of the building.
The subject area is located at 18659 1 -35 N. The subject property consists mostly of undeveloped
land, with the EVO Entertainment center under construction on a portion of it.
The public hearing notice was published in the San Antonio Express News on November 7, 2018.
Two (2) public hearing notices were mailed to surrounding property owners within two hundred
(200) feet of the subject property on November 1, prior to the Planning & Zoning Commission
meeting that took place on November 1.4, 2018. At the time of this report, Staff has received zero
(0) responses regarding the request.
The following representatives spoke at the November 14, 2018 Planning & Zoning Commission
Public Hearing:

City Council approved this on first reading at their meeting of November 27, 2018.
Goal
The proposed rezone is for approximately 17 acres of land from General Business District (GB)
and Manufacturing Light District (M -1) to Planned Development District (PDD), located at 18658
I -35N.
Community Benefit
It is the City's desire to promote safe, orderly, efficient development and ensure compliance with
the City's vision of future growth.
Summary of Recommended Action
The Comprehensive Land Use Plan (CLUP) through the Future Land Use Plan and the North
Schertz Sector Plan designates the subject property as Commercial Campus. The Commercial
Campus land use area is intended to encourage the development of lower intensity commercial
and office uses in the locations between major intersections as a buffer between the Interstate
Highway and adjoining neighborhoods.
• Comprehensive Land Plan Goals and Objectives: The proposed rezone is generally in
conformance with the goals and objectives of the Comprehensive Plan. The development
standards for the proposed Planned Development District state that the property will
develop in accordance with the base zoning district of General Business District (GB)
with modifications to the UDC regarding site design standards and signage. The proposed
zone change supports the commercial use that the Future Land Use Plan designates as
appropriate
• Impact on Infrastructure: The proposed rezone would have a minimal impact on the
existing infrastructure, including planned water and wastewater systems in the area.
• Impact on Public Facilities /Services: The proposed rezoning should have a minimal impact
on public services, such as schools, fire, police, parks and sanitation services.
• Compatibility with Existing and Potential Adjacent Land Uses: The subject property is
currently surrounded by agricultural use and undeveloped land, a flea market, and
interstate highway right -of -way. The proposed Planned Development District is intended
to provide a commercial business that is suitable for properties with highway frontage. It
is Staff's opinion that the rezoning request is compatible with the surrounding properties.

The applicant is requesting to rezone the property from General Business District (GB) and
Manufacturing Light District (M -1) to Planned Development District (PDD).
The Comprehensive Land Use Plan, along with the North Schertz Sector Plan amendment,
identifies this area as Commercial Campus, and the proposed rezone to Planned Development
District (PDD) would allow the property to better represent this land use.
The Comprehensive Land Use Plan recommends several character - defining elements for
properties adjacent to interstate highways so they can take advantage of their highway frontage,
including larger signage and a focus on the building's horizontal and vertical articulations. The
proposed rezone to Planned Development District (PDD) follows the intent of the Comprehensive
Land Use Plan by allowing the property to be flexible with signage and site design standards.
The North Schertz Sector Plan recommends that commercial properties with highway frontage
should have larger highway facing signs. The proposed Wiederstein Ranch PDD Development
Standards would allow the property to have five (5) total wall signs, increased maximum area for
each sign, and the ability for signs to extend above the roofline by no more than six (6) feet. The
current regulations defined in the Schertz UDC would allow this property to have one (1) sign per
wall with a maximum of three (3) signs, wall signs with a maximum area of 15% of the fagade
area or 250 square feet (whichever is less), and would prohibit wall signs from projecting above
the roofline or extend above the parapet wall if attached thereto.
This revision to the signage standards in Schertz UDC Article 9 would allow a building to properly
advertise its business. Increased signage is appropriate for this property due to the building's 1,069
foot distance from I -35 and the future commercial development planned in front of the building
along the highway. The current standards would not allow the property to take advantage of its
highway frontage and are not appropriate for a building of this scale. These revisions to the sign
regulations in Schertz UDC Article 11 allow traffic along I -35 to easily view the property, and
therefore follows the intent of the Comprehensive Land Use Plan by allowing the property to better
utilize the highway frontage through increased signage.
The North Schertz Sector Plan also recommends that commercial properties with highway frontage
should focus on minimizing the impact of the `big box' look by articulating the building mass
horizontally and vertically to provide aesthetically pleasing visual breaks. The Wiederstein Ranch.
PDD Development Standards would allow the property to use concrete tilt wall for up to 80% of
each facade, for a total of 50% of the total building fagade. The current regulations defined in the
Schertz UDC would allow this property to utilize concrete tilt wall for a total of 30% of each
fagade.
This revision to the site design standards in Schertz UDC Article 9 would allow a building to
provide appropriately sized visual breaks in the mass of the building via a pattern of vertical and
horizontal painting or a pattern of vertical and horizontal reveals that would create shadow lines.
The other approved materials such as brick, stone, faux brick and stone, tile, or stucco would not
allow for appropriately scaled visual breaks in the building due the building's scale and 1,069 foot
distance from 1 -35. The allowance of increased concrete tilt wall allows the property to create
visual breaks in the mass of the building that are appropriate to its scale, and therefore follow the
intent of the Comprehensive Land Use Plan by allowing the property to better utilize the highway
frontage through aesthetically pleasing visual breaks.

RECOMMENDATION
The Planning and Zoning Commission conducted the public hearing on November 14, 2018 and
offered a recommendation of approval by unanimous vote.
The proposed zoning of the Planned Development District (PDD) would uphold the intent of the
originally approved zoning by maintaining a base zoning of General Business District (GB) with
minor additions, and it would also allow the property to more closely represent the intended land
development characteristics from the Comprehensive Land Use Plan through the Future Land Use
Plan and the North Schertz Sector Plan. Staff recommends approval of the requested rezone to
Planned Development District (PDD).
Staff would like to provide a reminder that when considering final action on a zoning change, the
following criteria should be considered:
1. whether the proposed zoning change or zoning map amendment implements the policies
of the adopted Comprehensive Land Plan, including the land use classification of the
property on the Future Land Use Map;
2. whether the proposed zoning change or zoning map amendment promotes the health,
safety, or general welfare of the City and the safe, orderly, efficient and healthful
development of the City;
3. whether the uses permitted by the proposed change in zoning district classification and the
standards applicable to such uses will be appropriate in the immediate area of the land to
be reclassified;
4. whether the proposed change is in accord with any existing or proposed plans for providing
public schools, streets, water supply, sanitary sewers or other public services and utilities
to the area;
5. whether there have been environmental and /or economical changes which warrant the
requested change;
6. whether there is an error in the original zoning of the property for which a change is
requested;
7. whether all of the applicant's back taxed owed to the City have been paid in full (no
application will receive final approval until all back taxed are paid in full); and,
8. whether other criteria are met, which, at the discretion of the Planning and Zoning
Commission and the City Council, are deemed relevant and important in the consideration
of the amendment.

In 2014, . the City of Schertz and the City of Schertz Economic Development Corporation.
(SEDC) entered into a Development Agreement with GE Oil & Gas Inc. The initial
agreement was amended twice and was assigned to GE Oil & Gas LLC (GE Oil & Gas).
Under the agreement, GE Oil & Gas committed to an initial capital investment, the creation
and retention of jobs, and a minimum annual payroll amount. In return, the City of Schertz
agreed to fast -track GE Oil & Gas's permit review and the SEDC agreed to construct and
pay for a portion of David Lack Drive. The agreement included default and termination
provisions; however, it did not include a provision for a voluntary termination.
In June, 2018, . GE Oil & Gas notified staff that they would be closing its Schertz facility
by the end of the year. On October 22, 2018, GE Oil & Gas voluntarily repaid the SEDC
an amount equal to the default amount identified in the most recent amendment. To date,
GE Oil & Gas has remained compliant to the terms of the agreements. GE Oil & Gas's
repayment to the SEDC was made with the intention of terminating the Development
Agreement.
Unfortunately, the Agreement does not outline the terms for a voluntary termination. The
City of Schertz and SEDC have two options: (1) to return the money to GE Oil & Gas and
wait until a default occurs; or (2) accept the repayment and voluntarily terminate the
agreement.
COMMUNITY BENEFIT
The City of Schertz has received direct and indirect benefits from GE Oil & Gas's
operations in Schertz. Voluntarily terminating the agreement creates closure and allows
each party the ability to move forward.
FISCAL IMPACT
If this resolution is approved and the agreement is voluntarily terminated, the SEDC will
receive $1.96,002.80. If the resolution is not approved, GE will be forced into default. As
part of the agreement, the SEDC will be entitled to $196,002.80 plus legal fees.
SUMMARY OF RECOMMENDED ACTION
The City of Schertz Economic Development Corporation Board of Directors met on
November 29, 2018 and approved SEDC Resolution 2018 -1 that terminated the SEDC's
agreement with GE Oil and Gas. The SEDC Board of Directors also made a
recommendation for the City Council to terminate their agreement with GE Oil and Gas.
The City Council may terminate their agreement with GE Oil and Gas through the approval
of Resolution 1.8 -R -149.
Staff recommends voluntarily terminating the Development Agreement and associated
amendments through the approval of an SEDC resolution and further recommends the City
Council for the City of Schertz consider taking the same action.

WHEREAS, on February 4, 2014 the City of Schertz, Texas (the "City ") and the City of
Schertz Economic Development Corporation (the "SEDC ") entered into a Development
Agreement with GE Oil & Gas, Inc. (the "Developer ", and collectively with City and SEDC, the
"Parties "); and
WHEREAS, the Parties entered into Amendment No. 1 to the Development Agreement
effective as of April 25, 2016; . and
WHEREAS, the Parties entered into Amendment No. 2 to the Development Agreement
effective as of November 14, 2017 and assigned the Development Agreement to GE Oil & Gas
LLC. (GE Oil & Gas); and
WHEREAS, GE Oil & Gas has operated in accordance to the Amendment No. 2 and helped
to promote economic development within the City of Schertz through their job creation and capital
investment; and
WHEREAS, Amendment No. 2 outlined that in the event of a default, GE Oil & Gas'
exclusive obligation would be to repay ONE HUNDRED NINETY SIX THOUSAND TWO
DOLLARS AND EIGHTY CENTS ($1.96,002.80), plus any costs and expenses including
attorney's fee ( "default amount ") to the SEDC; and
WHEREAS, as of this day, GE Oil & Gas has not defaulted on the Development
Agreement but voluntarily repaid the SEDC on October 22, 2018 with the intention of terminating
the agreement; and
WHEREAS, the SEDC held a meeting on November 28, 2018, and the Board of Directors
found that it was in the best interest of the SEDC, City and GE Oil & Gas to terminate the
agreement; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS:
Section 1. The City Council hereby terminates the Development Agreement,
Amendment No. 1, and Amendment No. 2 with GE Oil & Gas LLC.
Section 2. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings of the City Council.

Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 4. This Resolution shall be construed and enforced in accordance with the laws
of the State of Texas and the United States of America.
Section 5. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application of
such provision to other persons and circumstances shall nevertheless be valid, and the City Council .
hereby declares that this Resolution would have been enacted without such invalid provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Government Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final passage,
and it is so resolved.

BACKGROUND
City Departments collect a wide variety of fees for permits, services, fines and other charges that
are all part of everyday operations of municipal government. Since September 2008, the fees
have been incorporated into a single fee schedule. Ordinance 08 -M -43 established the
consolidated fee schedule and allows for the modification of existing fees to be done by
resolution while new fees are established or added to the Fee Schedule by ordinance.
The Fee Schedule ordinance provides a single document with all City fees that directly affect the
users. The changes to the fees ensure the continued operation of public utilities, provides for
essential services to the community and to adequately maintain the investment in existing
infrastructure.
The Library schedule is Lowering the cost of replacing library cards from $5 to $1 and increasing
the fee to replace a DVD/Video cover from $1 to $3 to better line up with the cost of these items.
Replacing the library card at a lower fee also has the benefit of encouraging citizens to continue
to participate with the library by making it easier to replace a lost card.
As proposed as part of the recent Civic Center Operations worksession, the Event Facility
schedule updates will expand the Sunday fee rates to Friday for the rental options in the Civic
Center, including the Cut -Off Hall, the Conference Hall, and the Bluebonnet Hall. Unlike
Sundays, Fridays in the Grand Ballroom and Cut -Off Hall will only allow for full day rentals and
not half day. Fridays will still have half day rental options in the Conference Hall and the
Bluebonnet Hall.
New fees include a charge to use the approved uplighting expanded program. Each light can be
rented for $15 or as a package of 10 lights for $100 as a discount. Banquet Packages have
updated their fees to include the uplighting package in the Cut -Off Hall and Grand Ballroom and
include the portable bar in the Bluebonnet Hall.
Fee increases include the Audiovisual Access fee for the Conference hall is proposed to increase
from $25 to $50 to match the fee in the Bluebonnet Hall for a similar service and the Saturday
rental rate for the Bluebonnet hall that was presented to council during the Civic Center review
presentation on October 23, 2018.
The Events Facilities schedule also added clarification that the beverage service will provide for
up to 50 people. If additional beverages are needed, the fee could be charged multiple times.
Animal Services fee schedule changes will update and simplify the adoption rates to only one
rate per dog or cat regardless of weight or if it was spayed or neutered. The rate for a dog will
decrease to $60 and he rate for cats will decrease to $35 regardless of weight or if they were
fixed.

These new rates are comparable to neighboring cities. As noted in Assistant Chief Bane's recent
presentation on the Animal Adoption Center, the lower rates are designed to increase the speed at
which animals get adopted which is the primary goal of the Schertz Animal Adoption Shelter.
Staff has also included language to indicate rates could be decreased for special adoption events
or during a special promotion to further boost pet adoptions.
Finally, staff is proposing to not charge building permit fees to the Schertz Housing Authority.
The Schertz Housing Authority is traditional municipal housing authority established per City
statute. Additionally, the City provides $5,000 to the Housing Authority each year to support
their operations and it seems counterproductive to charge them building permit fees.

The uplighting revenue and expense was already programed into the budget for FY 2018 -19 so
this fee update will not cause a fiscal impact on the current budget.
The Friday rates being lowered to match the Sunday rates is anticipated to boost rentals on
Fridays and provide additional revenue for the City above what would be lost by having a lower
fee.
The other Event Facilities schedule changes are not anticipated to have a significant fiscal impact
on the budget but will provide cost recovery on services they provide and offer new services to
customers.
The Anima] Services fee changes are anticipated to reduce Adoption. Fee revenue by $9,000.
However, it is believed that animals will be adopted more quickly, thus reducing operating costs.
The Library fee changes are not anticipated to have a fiscal impact for FY 2018 -19.
RECOMMENDATION
Staff recommends the City Council approve Ordinance No. 18 -M -41 on first reading, amending
Appendix C of the Code of Ordinances.

WHEREAS, the City of Schertz (the "City ") has established by ordinances and

WHEREAS, the City Council has authorized a review and a consolidation of certain fees
for licenses, permits, and services provided by the City; and
WHEREAS, the Schedule of Fees attached as Exhibit A reflects revisions to certain fees,
a restatement of certain fees not revised, and a consolidation of all such fees; and
WHEREAS, due to the need for periodic modification of said fees and for the purposes
of efficiency, the City Council desires to adopt future fee changes by resolution rather
than by ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, TEXAS THAT:
SECTION 1.
All persons, firms, or corporations applying for licenses or permits or receiving other
City services described on Exhibit A that require the payment of a fee incident to such
application or service shall pay the fees as prescribed in the Fee Schedule attached hereto
as Exhibit A and made a part of hereof. It shall be a violation of this Ordinance to
conduct any activity or commence any use or receive any service for which payment of a
fee described herein is required until such fee has been paid (if required to be paid in
advance) or to fail to pay such fee when properly billed.
SECTION 2.
This Ordinance shall be cumulative of all provisions of ordinances and of the Code of
Ordinances of the City of Schertz, Texas as to the fees set forth on Exhibit A effect on the
effective date of this Ordinance, except where the provisions of this Ordinance are in
direct conflict with the provisions of such ordinances and such Code, in which event the
conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
The City Council may, from time to time, by ordinance add to the fees set forth on
Exhibit A, and the fees now or hereafter set forth on Exhibit A may be modified from
time to time by resolution of the City Council.
SECTION 4.
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase,
clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, and sections of this Ordinance, since the same would have been enacted by
the City Council without the incorporation in this Ordinance of any such unconstitutional
phrase, clause, sentence, paragraph, or section.
SECTION 5.
Subject to the last sentence of this Section, any person, firm, or corporation who violates,
disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of
any of provisions of this Ordinance shall be fined not more than Five Hundred Dollars
($500.00) for each offense. Each day that a violation is permitted to exist shall constitute
a separate offense. If any other ordinance, including the Code of Ordinances, establishes
a different penalty for the failure to pay any fee on Exhibit A, the provisions of such other
ordinance or the Code of Ordinances shall control with respect to such penalty.
SECTION 6.
All rights and remedies of the City are expressly saved as to any and all violations of the
provisions of the Code of Ordinances in effect on the effective date of this Ordinance and
modified by this Ordinance or any other ordinances in effect on the effective date of this
Ordinance and modified by this Ordinance and requiring the payment of fees for licenses,
permits, and other services provided by the City which have accrued on the effective date
of this Ordinance; and any and all accrued violations and all pending litigation, both civil
and criminal, whether pending in court or not, under such ordinances, shall not be
affected by this Ordinance but may be prosecuted until final disposition by the courts.
SECTION 7.
This Ordinance shall be in full force and effect from and after its final passage and any
publication required by law.

provided containers is required by this contract.

Subject: Parks Projects Update
Background
Prompted by the increased funding for park improvements and the need to better define work
projects for the coming year for the purpose of completing projects in a timely manner, Parks
Staff developed an overview of recent, ongoing and proposed projects to present to the Parks
Board at their October Meeting. Attached is an updated draft plan, modified based on Parks
Board input and subsequent discussions among staff. This is being provided to Council for
their review in advance of a worksession at a future meeting to ensure there is agreement that
the projects are priorities.

Subject: Update on major projects in
progress
Background
This is the monthly update on large capital projects that are in progress or in the planning
process. This update is being provided so Council will be up to date on the progress of these
large projects.
If Council desires this information to be presented in a different way or desires more
information on any project or on projects not on this list, please reach out to staff and that
information will be provided if possible.
Parks and Recreation:
1. Community Playscape Restroom: The Playscape restroom pad is complete and the utilities
installations are started. Water is installed and sewer and electric are due to be ran to the
building pad this week. The building delivery has been moved up to December 12, 2018.
The new estimated project completion date is expected to be early January depending on
weather.
Drainage Projects:
1. East Dietz Creek Desilting: C -3 Environmental was able to complete more work in the
month of November due to the dryer weather. C -3 Environmental continues to cut final
grades on the Dietz Road end of the project. Trucking operations to remove export material
began late in November. Due to the weather delays for the first two months of the project,
the work is now expected to be completed in the Spring of 2019.
2. Drainage Maintenance Projects (Concrete Rip -Rap Projects): City Staff and the design
engineer for the project (LAN) have decided to re- advertise the project with the Greenridge
and Hidden Grove projects in order to fit within the project budget. It is expected that the
project will be re- advertised in December with an award to follow in January.
3. Cameron River Drainage Box: Industrial Construction completed this project in
November. The project will no longer be updated as part of this list.
Facilities Projects:
1. Recreation Cenmer/YMCA Restrooms: The Project is due to be turned over to the YMCA
this week. The contractor is going thru final inspections and punch list items. Currently
there are no open items at this time.
2. Fire Station 3: The Site grading and site fill are ongoing. The building pad has been
excavated to nine feet and select fill is due to start being placed, weather permitting.
Temporary electric and a construction office are on site. The design team is working on
a plan to detain storm water runoff on site. Current substantial completion date is August
2019.
Engineering Projects:
1. 2018 Street Preservation and Maintenance/Rehabilitation Project: LAN is
approximately 80% complete with the design of all portions of the project. City Council
approved additional services for LAN on November 27th to finalize the last portion of the
design. City Staff is working to implement the new EJCDC contract documents into the
bid documents of the project. It is anticipated that the project will go out to bid in early
2019.
2. Corbett Elevated Water Storage Tank: The final plat and site plan were approved in
November. City Staff continues working with the final two property owners along Schaefer
Road to obtain waterline easements in order to relocate the existing waterline in Schaefer
Road. The Request for Proposal (RFP) for the project closed on November 30th and City
Staff is working to evaluate the responses. City Staff expects to award the project in January
with a notice to proceed to follow.
3. Woman Hollering Creek Wastewater Interceptor Main and Lift Station:
CobbFendley continues to work on making the final plan revisions and the bid documents.
City Staff and CobbFendley continue to negotiate with property owners to acquire
necessary easements for the project. It is anticipated that revised offer letters will be sent
out at the end of November or early December. CobbFendley is working to complete the
City's platting and site plan process for the lift station site. It is anticipated that bidding for
the project will take place in early 2019.
4. Pedestrian Routes and Bike Lanes Project: Ford Engineering is in the final stages of the
90% design. Ford Engineering is finalizing the sidewalk easement requirements for the E.
Live Oak portion of the project so that the easement acquisition process can begin. City
Staff is working with LCRA to finalize the purchase of property for the hike and bike trail.
TxDOT currently has the project scheduled to let in April of 2019.
5. FM 1103 Bridge Project: No change from November report: Construction continues with
the successful demolition of the old bridge structure. As new bridge structural elements
are added, lane closures will continue as necessary. TxDOT and its contractors keep City
Staff informed of detours and closures so that the City can assist in disseminating the
information to the public in a timely fashion. The currently anticipated completion date is
June 2019. .
6. FM 1103 Improvement Project: No change from November report: Utility relocations
are underway (including electric, communications, gas, water, and wastewater). Schertz
Public Works is working to acquire easements necessary to relocate some water and
wastewater lines that conflict with the planned roadway and drainage improvements. The
$2 million contribution to the project committed by the City of Schertz has been paid in
full to TxDOT. The target let date for a construction contract is October 2019.
7. FM 1518 Improvement Project: TxDOT has begun the process of acquiring property
needed for the expansion project. Parcels are being appraised at this time to determine
initial offers. Approximately 140 parcels are affected by right of way needs, including 850
square feet of land owned by the City of Schertz (across the front of the existing Sedona
Lift Station). TxDOT is also continuing to work on a value - engineering phase of the
project. Construction is currently expected to begin in 2022.
As projects are completed, they will be removed from the document moving forward. Again,
please advise if we can provide more, different or better information in this report.
