APPLICATION SUBMITTAL DATE: November 8, 2018 (Original Application)

ITEM SUMMARY: The applicant is proposing to final plat approximately 134 acres into one (1) lot. The subject
property is zoned Public Use District, PUB. The property is currently undeveloped, the majority being used as
agricultural. The applicant has submitted the plat application in order to develop the new wastewater treatment
facility.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 7424 Trainer Hale Road,
City of Schertz, Bexar County.
ACCESS AND CIRCULATION: The proposed lot 1 has frontage onto Trainer Hale Road.
TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
Tree affidavit which indicates that the site does contain protected and heritage trees but will in no way cause
the destruction of or damage to said trees with this final plat.
PUBLIC SERVICES: The site is serviced by Green Valley Special Utility District (GVSUD), CCMA, with the
development of the treatment facility, CPS, AT &T, and Spectrum.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement.
Water: Lot 1 will be serviced through an existing Green Valley Special Utility District (GVSUD) water line
adjacent to Trainer Hale Road.
Sewer: Lot 1 will be serviced by the proposed wastewater treatment facility that is to be developed on this site.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. The City Engineer has reviewed and approved the drainage report.
Sidewalks Hike and Bike Trails: Sidewalks will be required adjacent to Trainer Hale Road for the entirety of the
frontage. These sidewalks will be reviewed with the Site Plan and will be installed with development of the
property.
Road Improvements: The subject property is located off Trainer Hale Road, which is identified on the Master
Thoroughfare Plan as a Principal Arterial with a right -of -way width of 130 feet. Currently this portion of Trainer
Hale Road has a right -of -way width of 60 feet. The applicant is dedicating approximately 1.4 acres of land
adjacent to the right -of -way for roadway expansions. The dedication has a variable width for the property
frontage.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed final plat is consistent with applicable requirements for the property, ordinances and regulations.
Staff recommends approval of the final plat.

SUBJECT: Consider and act upon a request for approval of a final plat of the Cantu Ranch
Subdivision, an approximately 39 acre tract of land located approximately 2,000 feet
east of the intersection of Ware Seguin Road and Boenig Drive, more specifically
described as 11330 Ware Seguin Road, City of Schertz, Bexar County.

ITEM SUMMARY: The applicant is proposing to develop approximately 39 acres of land into four (4) residential
lots, Lot 1 being 21.30acres, Lot 2 being 1.50acres, Lot 3 being 13.02acres, and Lot 4 being 2.98acres. The
subject property is zoned Single — Family Residential / Agricultural, R -A.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 11330 Ware Seguin
Road and is currently developed with one single - family residential home and multiple barns, which will all be
included in Lot 3 of the proposed final plat.
ACCESS AND CIRCULATION: All four of the proposed lots have frontage on Ware Seguin Road.
TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
Tree affidavit which indicates that the site does not contain protected or heritage trees.
PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community
Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1,000 per
dwelling unit will be paid by the Developer prior to recording of the final plat.
PUBLIC SERVICES: The site is serviced by City of Schertz Water, CCMA, SARA, CPS, AT &T, and Spectrum.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement.
Water: This site is currently serviced through a City of Schertz 12" water line.
Sewer: This site is not currently serviced by a public wastewater system. A waiver request to not connect to a
public wastewater system and to allow each of the four lots to be serviced by individual on -site sewage facilities
was review and approved by the Planning & Zoning Commission on September 26, 2018.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. The City Engineer has reviewed and approved the drainage report.
Sidewalks Hike and Bike Trails: Sidewalks are required along Ware Seguin Road for the length of the
subdivision and will be designed to meet the City of Schertz specifications.
Road Improvements: The subject property is located adjacent to the bend in Ware Seguin Road. The portion of
Ware Seguin Road in which the subject property and proposed lots front is identified on the Master
Thoroughfare Plan as a Residential Collector roadway consisting of 70' ROW. The portion of Ware Seguin
Road adjacent to the frontage of the lots is approximately 60 -feet wide. The proposed final plat is dedicating 5
feet of Right -Of -Way in order to provide their portion of the desired 70' of ROW.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed final plat is consistent with applicable requirements for the property, ordinances and regulations.
Staff recommends approval of the final plat.

GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is

development of the lot. Any tree mitigation fees due will be accessed with the development of the lot.
PUBLIC SERVICES: The site is serviced by City of Schertz water, Cibolo Creek Municipal Authority (CCMA),
Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15, unless otherwise specified in an approved
development agreement.
Water and Sewer: The site will be serviced through a City of Schertz 12" water lines adjacent to FM 3009 and a
proposed 8" sanitary sewer line extension that will be extended adjacent to FM 3009 to the adjacent property to
the north.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer.
Sidewalks Hike and Bike Trails: Sidewalks along FM 3009 are required and were installed with the sidewalk
project for FM 3009. The sidewalks will be required to be maintained with the development of the newly created
lot.
Road Improvements: The subject property is located adjacent to FM 3009, a TXDOT roadway. On August 29,
2018 TXDOT provided a no object to the proposed final plat letter. Currently FM 3009 is a 120' ROW. No
dedication is proposed or required along FM 3009.
STAFF ANALYSIS AND RECOMMENDATION:
The final plat is consistent with applicable requirements, ordinances and regulations for the property. It has
been reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, and Fire. Staff
recommends approval.

GENERAL INFORMATION:
As stated in the Unified Development Code (UDC), City Council from time to time, on its own motion, or at the
recommendation of City Staff make amendments, change or modify text to any portion of the UDC to establish
and maintain sound stable and desirable development. It is generally considered good practice to periodically
review and update the development regulations due to changing conditions, community goals and State and
Federal regulations. Based on the update to the Comprehensive Land Use Plan and changes in development it
has becomes necessary to update the UDC.
PROPOSED AMENDMENTS:
Designation of Landmark Properties and Heritage Neighborhoods
Staff is proposing to eliminate UDC Sec. 21.4.9 from Article 4 Procedures and Applications. This section
established the process for properties to be designated as Landmark Properties or Heritage Neighborhoods.
These are intended as honorary designations. As staff was working with the Schertz Historical Preservation
Committee on changes, it was deemed more appropriate to not include this in the UDC. As such, staff is going
to seek Council approval of a resolution adopting the modified standards, but just not as part of the UDC.
Floodplain
Staff is proposing to amend UDC Sec.21.13.3 Definitions for the definition of Substantial Improvement. The
Federal Government establishes minimum standards for floodplain management if their residents are to receive
a subsidy for flood insurance; however, they may adopt higher standards. Currently the City has adopted a
higher standard for Substantial Improvement for structures in the floodplain. This has proven problematic and
an obstacle for redevelopment along Main Street. As such staff is making a recommendation to amend the
UDC to adopt the minimum standard.
The current standard requires structures to be elevated or floodproofed if the cumulative value of the
improvements exceeds 50% of the value of the structure as it existed from the adoption date of the ordinance
(2013). As one may imagine, many structures had a lower appraised value in 2013 than today or than they will
in the future. Given how broad the definition of improvements is (replacing a broken AC or water heater,
reroofing a structure, etc.), the current standard is proving to be problematic.
Staff is proposing to amend the UDC to adopt the minimum standard — the value of the improvements over one
year cannot exceed 50% or the structure must be floodproofed or elevated

Staff recommends approval of the amendments to the Unified Development Code (UDC), Sec. 21.4.9
Designation of Landmark Properties and Heritage Neighborhoods and Section 21.13.3 Definitions Substantial
Improvement to mirror the minimum federal standard.

Staff is proposing to eliminate the following:
Sec. 21.4.9. - Designation of landmark properties and heritage neighborhoods.
A. Purpose and applicability. The purpose of this section is to recognize and encourage the
preservation of those areas or specific buildings or structures of significance to the City. More
specifically, this Article is designed to achieve the following goals:
To preserve, protect and enhance significant sites and structures that represent unique
elements of the City landscape either by their aesthetic, architectural, nostalgic, or symbolic
attributes in relation to persons, place and /or time.
2. To strengthen civic pride through neighborhood preservation and recognition.
To provide application submission and review guidance relating to the designation of properties
and /or sites.
4. The provision for designation of Landmark Properties shall also apply within the extraterritorial
jurisdiction of the City of Schertz.
B. Application Requirements. Any request for the designation of a landmark property or heritage
neighborhoods shall be initiated by completion of an application form as set forth in Appendix A of
the Schertz Historical Preservation Committee's (SHPC) By -laws.
C. Processing of Application and Decision.
Submittal. All applications under this section shall be submitted to the SHPC. The SHPC shall
review the application for completeness and notify the applicant of items requiring correction or
attention before providing a written recommendation on the application. Any interested citizen,
to include SHPC members, may initiate an application.
Approval Procedures. Applications for landmark properties and heritage neighborhoods shall be
considered and voted upon at the SHPC's next quarterly meeting following application
submission. Approval will require a two - thirds positive vote by members present. The SHPC
may disapprove the nomination for reasons of incomplete and /or unsupportable data. If
disapproved, the nominator will be notified in writing by SHPC as to the reason(s) for
disapproval and given thirty (30) days to resubmit the nomination form with corrected or
supplemental data. If no reply is received by the thirty (30) day deadline the nomination is
considered closed without further action required. The approved SHPC nominations will be
forwarded to the City Manager for placement on a City Council agenda within thirty (30) days of
receipt. Written notice shall be provided to the owner of the property before the tenth (10th) day
before the hearing date of City Council. The City Council shall vote on all designation
nominations and will require a majority of Council members to approve the nomination. The
nominator will be notified in writing by the SHPC of City Council approval /disapproval.

SUBJECT: Consider and act upon a request for approval of a waiver regarding on -site sewage
facilities for Mark Roberts Subdivision IV, an approximately 3 acre tract of land located
at 5710 FM 1103, City of Schertz, Guadalupe County, Texas.
GENERAL INFORMATION:

ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 3 acres of land into two (2)
commercial lots in order to develop an automobile repair business. The subject property is zoned General
Business District (GB). The applicant is seeking approval of a waiver to UDC Sec. 21.15.38 wastewater
systems in order to have the ability to install privately owned On -Site Sewage Facilities (OSSF) on site. There is
already existing OSSF on the proposed Lot 2. The subject property is currently zoned General Business District
(GB).
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently developed with a
commercial business and is located at 5710 FM 1103.
PUBLIC IMPROVEMENTS:
The applicant is seeking approval of a waiver to install privately owned On -Site Sewage Facilities (OSSF) on
the subject property. The OSSF systems would be regulated by Guadalupe County. The subject property has a
dual Certificate of Convenience and Necessity (CCN) for sewer with the City of Schertz responsible for
collection and Cibolo Creek Municipal Authority (CCMA) responsible for treatment.
In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts
and parcels on which the development is proposed shall be connected to a public wastewater system.
Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall
comply in full with the requirements of this UDC.
Based on the requirements defined in UDC Sec. 21.12.15 Waivers, forgoing a connection to a public
wastewater system and installing an OSSF requires a waiver to be granted by the Planning and Zoning
Commission. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in
Article 12 when undue hardship will result from requiring strict compliance.
STAFF ANALYSIS AND RECOMMENDATION:
The applicant is requesting a waiver to the required connection to a public waste water system to allow the
installation of privately owned on -site sewage facilities. The closet sewer connection is approximately 1,090 feet
to the northwest near the intersection of 1 -35 and FM 1103. However, due to the City's sewer utility installation
practices, the sanitary sewer line can't be placed in the FM 1103 right -of -way and must be placed in a public
sanitary sewer easement. In order for the applicant to connect to sewer at the intersection of 1 -35 and FM 1103,
the applicant would have to acquire approximately 1,090 linear feet of 16 -foot wide public sanitary sewer
easement across three separately owned, private properties along FM 1103 at an unknown cost. The applicant
has been unable to acquire sewer easement from the other private property owners in order to connect to the
sewer line, and therefore is unable to develop his property due to circumstances that could not be avoided.
Without City assistance for easement acquisition, it is possible that the property owner will not be able to
construct the sewer extension. The city is currently working through negotiations on a portion of the needed
sewer easement, however negotiation of the remainder of the needed easement is not currently an established
or funded project. Due to the unknown easement acquisition timeline and cost, it is Staff's opinion that requiring
the property to connect to the nearest public waste water system would pose a substantial financial burden to
the property owner and an indefinite delay for development of the property.
The Engineering Department has reviewed this request and is in support of granting the waiver. This waiver
request has been reviewed with no objections by Public Works, Engineering and Planning Departments.
Staff recommends approval of the waiver due to the hardship of acquiring 1,090 feet of public sanitary sewer
easements across three separately owned, private properties along FM 1103 and the related costs. The
granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure.
Additionally, granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious
to other property in the area. If approved, any new On Site Sewage Facilities needed to serve the proposed
preliminary plat will be reviewed and permitted through Guadalupe County.

COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its
opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and
Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest.
In making their findings, the Planning and Zoning Commission shall take into account the nature of the
proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will
reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and

upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the
Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of
other land in the area in accordance with the provisions of this UDC. Such findings of the
Planning and Zoning Commission, together with the specified facts upon which such findings
are based, shall be incorporated into the official minutes of the Planning and Zoning
Commission meeting at which such waiver is granted. Waivers may be granted only when in
harmony with the general purpose and intent of this UDC so that the public health, safety, and
welfare may be secured and justice done.
B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver.
C. Such findings together with the specific facts on which such findings are based shall be incorporated into the
official minutes of the Planning and Zoning Commission meeting at which such exception is granted.
D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law,
ordinance, code or regulation of the City.
E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may
be appealed to the City Council. When considering an appeal, the City Council shall consider the same
standards as the Planning and Zoning Commission as outlined above.

We are requesting a waiver regarding Section 90 -78 (a) and (b) of the City of Schertz Code of
Ordinances:
(a) All owners or occupants of buildings or agents for such owners, situated in any section of the
city where sanitary sewer facilities now exist, or where they may hereafter exist, and where
the property line of the land on which any such building is situated approaches or extends to
within 500 feet of a residential structure or 1,500 feet of a commercial business of such sewer
facility, are hereby required to construct or cause to be constructed suitable water closets on
their property, and connect the same with the city sewer. It shall be the duty of any such
property owner or occupant to keep and maintain such water closets and connections thereof
in good working condition and free from any obstruction.
(b) It shall be unlawful for any person to build or use any permanent privy vault above or below
the ground in the city on any lot parcel of land, the property line of which, at any point
extends to within a distance of 500 feet for residential and 1,500 feet for commercial of a city
sanitary sewer facility.
D. & K. Properties, Ltd. owns a 2.944 acre tract of land located along the southwest side of F.M.
1103, approximately 1,650 feet southeast of I.H. 35. Mr. David Bradshaw, President of D. & K.
Properties, Ltd., is in the process of platting this property into two lots. Mr. Bradshaw will retain the
existing commercial improvements on one lot (Lot 2) and develop the second lot (Lot 1) with an
automotive repair facility. Lot 2 is currently served by septic and municipal water. The development for
Lot 1 will also be served by municipal water. Per the above ordinance citation, and as a condition of this
plat, Mr. Bradshaw would be required to extend the existing municipal sanitary sewer to serve both lots.
Per the attached aerial exhibit, the nearest sanitary sewer main is approximately 1,090 feet
northwest of the property and it is located in the F.M. 1103 right -of -way. Connecting to the existing
sewer main and extending the sewer across Mr. Bradshaw's frontage would be a total of approximately
1,330 feet. Per the attached Preliminary Quantities & Cost Estimate, the probable cost for the sewer
extension would be approximately $156,713. Due to sewer utility placement practices by the City of

Schertz, the sanitary sewer line cannot be placed in TxDOT right -of -way and must be placed in a public
sanitary sewer easement across the front of the lots adjacent to F.M. 1103. Approximately 1,090
linear feet of 16 -foot wide public sanitary sewer easement across three separate privately owned
properties would need to be acquired at an unknown cost. Based on the estimated construction costs, the
unknown easement costs, and the inability for Mr. Bradshaw to compel the other private property owners
to grant or sell an easement, it is our opinion that this would be a substantial financial burden to Mr.
Bradshaw. Additionally, it is possible that this connection could not ever be made by Mr. Bradshaw
without City assistance in acquisition of the needed easements.
Based on the above, we are requesting that Mr. Bradshaw be granted a waiver from having to
extend sanitary sewer to his property. If this waiver is granted, it is expected that the existing septic
system on Lot 2 and the future septic on Lot 1 will continue to remain in operation until such time as the
sewer is extended to his property by the City of Schertz.

The request for a waiver to the requirement to extend public sanitary sewer to serve
the proposed Mark Roberts Subdivision IV is recommended for approval. The request
for the waiver has been reviewed and found to be reasonable. The extension of
sanitary sewer facilities to the subject subdivision property crosses several properties
and requires the acquisition of three public easements across private property. The City
is currently in negotiations with two of the property owners regarding easement
acquisition and construction of a line across those properties. It is unpredictable at this
time how long the negotiations will take and the subdivision development may be
unduly delayed with no available recourse. Additionally, there is neither funding nor an
established project to assist the subdivision developer with the remainder of the
easements. Therefore, Engineering supports the granting of the waiver.
Staff has verified that the proposed platting is laid -out in a manner to provide for future
connection to a public sanitary sewer system. Once public infrastructure has been
extended to the subdivision property, the subdivision will be required to connect to the
sewer system, in accordance with Section 90 -78 of the Code of Ordinances.
Any new OSSF needed to serve the proposed lots in the proposed Plat will be reviewed
and permitted through Guadalupe County. A building permit will not be issued without
either a Guadalupe County OSSF approved permit or extension of and connection to the
public system.

ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 3 acres of land into two (2)

GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is
located at 5710 FM 1103.
ACCESS AND CIRCULATION: The proposed lots have frontage onto FM 1103. The property will have a
shared access point onto FM 1103 between the two lots.
TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified
Development Code (UDC) Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
Tree Affidavit which indicates that the development of the site will in no way cause the destruction of or
damage to ant Protected or Heritage tree(s).
PUBLIC SERVICES: The site is serviced by City of Schertz water, Cibolo Creek Municipal Authority
(CCMA), Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be
installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an
approved development agreement. The civil construction plans must be reviewed and approved by the
Public Works and Engineering Departments prior to approval of the final plat.
Water: This site will be serviced through a City of Schertz 12" water line.
Sewer: This site is not currently serviced by a public wastewater system. The applicant is requesting a waiver
to allow the property to be served by on -site sewage facilities (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property, and for
compliance with the Storm Water regulations. The City Engineer has reviewed and approved the preliminary
drainage report.
Sidewalks Hike and Bike Trails: Sidewalks are required along FM 1103. They will be designed to meet the
City of Schertz specifications and must be approved by TxDOT prior construction.
Road Improvements: The subject property is located adjacent to the TxDOT roadway FM 1103. On August
30, 2018 TxDOT provided a letter of no objection to the proposed preliminary plat. TxDOT has already
acquired the necessary right -of -way for the expansion of FM1103; therefore, there is no right -of -way
dedication or roadway improvements required for the property.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and
regulations. Staff recommends approval of the preliminary plat.
