ITEM SUMMARY: The applicant is proposing to rezone approximately 0.24 acre of land from General Business
District (GB) to Main Street Mixed Use District (MSMU). The property is located at 802 Main Street. The site

GENERAL LOCATION AND SITE DESCRIPTION: The subject property is generally located at the intersection
of Main Street and Pfeil Street. The property currently has a residential structure.
PROPOSED ZONING: The request is to rezone approximately 0.24 acres of land from land from General
Business District (GB) to Main Street Mixed Use District (MSMU) in order to allow the property to be used
commercially, with the added benefits of the Main Street Mixed Use zoning district.
CONFORMANCE WITH THE COMPREHENSIVE PLAN: The Sector Plan amendment to the Comprehensive
Land Use Plan (CLOP) designates the subject property as part of Historic Downtown Schertz. The objectives
for Historic Downtown Schertz are to leverage Schertz's history and heritage to create a unique destination with
local independent businesses, encouraging the use of existing buildings. The Main Street Mixed -Use District
(MSMU) was created to help achieve these objectives. The Main Street Mixed -Use District (MSMU) is intended
to provide a base zoning district to the area along Main Street. In light of the history of the area and variety of
land uses that exist, this zoning district allows for both single - family residential uses and low intensity
commercial uses. Reduced setbacks and parking requirements are provided as part of this district due to
physical constraints.
• Comprehensive Plan Goals and Objectives: The proposed rezoning request is generally in
conformance with the goals and objectives of the Comprehensive Plan. In particular, the proposed
zone change will provide for either single family or low intensity commercial occupancy.
• Impact of Infrastructure: The proposed rezoning request should have a minimal impact on the existing
water and wastewater systems.
• Impact of Public Facilities /Services: The proposed rezoning request will have minimal impact on public
services, such as schools, fire, police, parks and sanitation services.
• Compatibility with Existing and Potential Adjacent Land Uses: The subject property is currently
surrounded by single family land use, right of way, a drainage channel, a railroad, and undeveloped
land. The Main Street Mixed -Use District (MSMU) will allow for either low intensity commercial or
single - family residential both, of which are compatible with the adjacent land uses. Additionally, the
proposed zoning is compatible with the Comprehensive Land Use Plan.
STAFF ANALYSIS AND RECOMMENDATION: The Comprehensive Land Use Plan identifies this area as
Historic Downtown Schertz which is intended to leverage Schertz's history and heritage to create a unique
destination with local independent businesses, encouraging the use of existing buildings. The rezoning request
appears to have a minimal impact on the public infrastructure, facilities or services and is consistent with the
Comprehensive Land Use Plan and compatible with the surrounding land uses.
The applicant is proposing to rezone the property for the current General Business District (GB)to Main Street
Mixed Use District (MSMU), to allow for low intensity commercial land uses that are permitted in the Main Street
Mixed Use District (MSMU).
Based on the Comprehensive Land Use Plan and surrounding land uses the Main Street Mixed Use District
(MSMU) is the most appropriate zoning district for this tract of land. Staff recommends approval of the rezoning
application as submitted.

CASE: WA2018 -009: Waiver — On -site Sewage Facility associated with PC2018 -032
ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 23 acres of land into one (1)
commercial lot in order to combine two non - platted tracts into one single property in order to construct a 4,800
square foot building (a lunch /break room for the existing UFP employees) in addition to the existing Universal
Forest Products buildings on the property. The subject property is currently zoned Manufacturing (Light) District
(M -1). The applicant is seeking approval of a waiver to UDC Sec. 21.15.313 wastewater systems in order to
have the ability to install privately owned On -Site Sewage Facilities (OSSF) on site. There is an existing OSSF
on the property that the current business utilizes.
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently developed with a
commercial business and is located at 21700 FM 2252.
PUBLIC IMPROVEMENTS:
The applicant is seeking approval of a waiver to install privately owned On -Site Sewage Facilities (OSSF) on
the subject property. The OSSF systems would be regulated by Comal County. The subject property has a dual
Certificate of Convenience and Necessity (CCN) for sewer with the City of Schertz responsible for collection
and Cibolo Creek Municipal Authority (CCMA) responsible for treatment.
In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts
and parcels on which the development is proposed shall be connected to a public wastewater system.
Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall
comply in full with the requirements of this UDC.
Based on the requirements defined in UDC Sec. 21.12.15 Waivers, forgoing a connection to a public
wastewater system and installing an OSSF requires a waiver to be granted by the Planning and Zoning
Commission. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in
Article 12 when undue hardship will result from requiring strict compliance.
STAFF ANALYSIS AND RECOMMENDATION:
The applicant is requesting a waiver to the required connection to a public waste water system to allow the
installation of privately -owned on -site sewage facilities. The closet sewer connection is approximately 9,800
feet from the subject property and located on the north side of IH 35. This would require an extension of
approximately 3,500 feet from the subject property down FM 2252 to IH 35 and then an extension adjacent to
IH 35 of approximately 6,100 feet. Due to the distance to the closest sewer connection and cost associated with
an extension of this distance, it is Staff's opinion that requiring the property to connect to the nearest public
waste water system would pose a substantial financial burden to the property owner and an indefinite delay for
development of the property. Additionally, since the existing Universal Forest Products utilizes an on -site
sewage facility and the reasoning behind the preliminary plat and this waiver request is in order to develop a
lunch /break room for their existing employees, the impact to the system will not be negative in terms of existing
or proposed infrastructure.
The Engineering Department has reviewed this request and indicated their support of granting the waiver based
on no sanitary sewer facilities existing in the area and noted that this waiver is similar to waivers granted
previously by the City. The Engineering Department also verified that the proposed platting is laid -out in a
manner to provide for future connection to a public sanitary sewer system. Additionally, once public
infrastructure has been extended to the area to provide sanitary sewer service, the UFP Schertz subdivision will
be required to connect. This waiver request has been reviewed with no objections by Public Works,
Engineering and Planning Departments.
Staff recommends approval of the waiver based on the distance to the nearest available sewer connection. The
granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure.
Additionally, granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious

COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its
opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and
Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest.
In making their findings, the Planning and Zoning Commission shall take into account the nature of the
proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will

reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and
upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the
Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of
other land in the area in accordance with the provisions of this UDC. Such findings of the
Planning and Zoning Commission, together with the specified facts upon which such findings
are based, shall be incorporated into the official minutes of the Planning and Zoning
Commission meeting at which such waiver is granted. Waivers may be granted only when in
harmony with the general purpose and intent of this UDC so that the public health, safety, and
welfare may be secured and justice done.
B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver.
C. Such findings together with the specific facts on which such findings are based shall be incorporated into the
official minutes of the Planning and Zoning Commission meeting at which such exception is granted.
D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law,
ordinance, code or regulation of the City.
E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may
be appealed to the City Council. When considering an appeal, the City Council shall consider the same
standards as the Planning and Zoning Commission as outlined above.

Universal Forestry Products —Schertz is requesting waiver for the Section 90'78 (a) and (b) of the Code of
Ordinances requirements to connect to the public wastewater system.
a) All owners oroccupants of buildings or agents for such owners, situated in any section of the city
where oanhon/ sewer facilities now existing, or where they may hereafter exist' and where the
property line of the land on which any such building is situated approaches or extends to within 500
feet of a residential structure or 1,500 feet of a commercial business of such sewerfacility, are hereby
required to construct or cause to be constructed suitable water closets on their property and connect
the same with the city sewer. It shall be the duty of any such property owner or occupant to keep and
maintain such water closets and connections thereof in good working condition and free from
obstruction.
b) It shall be unlawful for any person to build or use any permanent privy vault above or below the
ground in the city on any parcel of land, the property line of which, at any point extends to within a
distance of 500 feet for residential and 1,500 feet for commercial of a city sanitary sewer facility.
Universal Forest Products desires to add a freestanding lunch/break room upon their 10 acre tract, which adjoins
their developed 12 acre tract. The she is located at 21700 FM 2252, within the City uf8chertz The she is current
served with a municipal source of water —though currently utilizes an onsite sewage treatment facility (OSSF), a
septic system,
|n order to provide abuilding permit for the lunch/break facility nn the 10 acre tract, the City of Schertzrequi,es
that the property be platted. The two adjoining tracts are included in a preliminary plat "UFP Schertz", consisting
of 23.00 acres along FM 2252
The UFP Schertz tract, as it fronts on FM 2252, is not close to any existing public gravity sanitary sewer collection
system. The closest connection point would be any expansion of the system that serves commercial or residential
properties fronting on the north side of IH 35. The subject tract is over 3,700 feet from IH 35. The closest existing
gravity system on the north side of IH 35 is 9,800 feet away. See the attached map exhibit.
The UFP 5chertz tract currently has an onsite septic system that is to be expanded 0o serve the new project. The
current onsite system and expansion will be in compliance with City, County and TCEQ regulations.

ITEM SUMMARY: The applicant is proposing to develop approximately 23 acres of land into one (1)
commercial lot in order to combine two non - platted tracts into one single property in order to construct a 4,800
square foot building (a lunch /break room for the employees) in addition to the existing Universal Forest
Products buildings on the property. The subject property is zoned Manufacturing (Light) District (M -1).
GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 21700 FM 2252 and is
currently developed commercially for UFP Schertz, which is part of the Universal Forest Products company.
ACCESS AND CIRCULATION: The proposed lot has frontage on FM 2252.
TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified
Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a
Tree affidavit which indicates that the site does contain protected or heritage trees, but will no way cause
destruction or damage of said trees with the preliminary plat.
PUBLIC SERVICES: The site is serviced by Green Valley Special Utility District (GVSUD), CCMA, CPS, AT &T,
Charter- Spectrum, and CenterPoint Energy.
PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed
prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved
development agreement. The civil construction plans must be reviewed and approved by the Public Works and
Engineering Departments prior to approval of the final plat.
Water: This site is currently serviced through a 12" water line that runs adjacent to FM 2252.
Sewer: This site is not currently serviced by a public wastewater system. The applicant is requesting a waiver
to allow the lot to be served by on -site sewage facilities (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance
with the Storm Water regulations. The City Engineer has reviewed and approved the preliminary drainage
report.
Sidewalks Hike and Bike Trails: Sidewalks are required along FM 2252 for the length of the subdivision and
will be designed to meet the City of Schertz specifications. These sidewalks will be reviewed with the
development of the lot.
Road Improvements: The subject property is located adjacent to FM 2252. FM 2252 is a TXDOT maintained
roadway. TXDDT provided a letter of No Objection to the preliminary plat on December 12, 2018. As part of the
preliminary plat TXDOT requested an additional 15 feet of Right -Of -Way. The UFP Schertz plat is providing the
requested 15 feet of Right -Of -Way dedication adjacent to FM 2252 for the entirety of the frontage of the
property.
STAFF ANALYSIS AND RECOMMENDATION:
The proposed preliminary plat is consistent with applicable requirements for the property, ordinances and
regulations. Staff recommends approval of the preliminary plat.

December 19, 2018 Reports from Boards and Commissions — Since September 19, 2018
Board of Adjustment — September 24 (cancelled), October 22, November 26 (cancelled) and December 17 (cancelled)
BOA denied two variance requests, both were generally for additional signage beyond what the UDC allows.
Planning and Zoning Commission — September 26, October 10, October 24, November 14 and December 12
P &Z approved plats for additional phases of the Homestead and Crossvine residential developments as well as a few plats
for large lots in southern Schertz and plats for couple of commercial projects. They also approved plats for the City's water
storage tank off of Ray Corbett Drive, the southern Schertz sewer plant and the Fire Station #3 plat on Lower Seguin Road.
P &Z also approved a rezoning request to a PDD to modify development standards on the EVO site.
P &Z made recommendations to the UDC regarding floodplain management, Landmark Properties and Heritage
Neighborhoods and the placement of sheds.
TSAC — October 4, November 1(cancelled), and December 6
TSAC received presentations from TxDOT on school zones, the Alamo Area Metropolitan Planning Organization (AAMPO)
on bike lanes and the Alamo Area Council of Governments (AACOG) on the Alamo Regional Transit (ART) program.
Historical Preservation — October 25
The Historical Preservation Committee discussed the Fall 2018 Newsletter and Remembrances Special Edition Articles
which are available on the City's website. The also recommended adjustments to the Landmark Property and Heritage
Neighborhood program. They recommended disposing of some of the items they have been storing. Finally, they discussed
the SCUCISD Annual Art and Essay Contest.
Parks and Recreation Advisory Board — September 24, October 22
The Parks Board discussed amending their bylaws to meet every other month starting in 2019. They reviewed a proposal
by the Parks Staff to utilize increased funding for parks upgrades and repairs. This presentation was provided to City
Council as an information only item with the December 4 packet.
Library Board — October 1, November 5, December meeting not held
At both meetings, the Library Board received reports on the board's finances, library usage and the bookstore. The Library
Director also discussed how the additional materials budget is proposed to be spent.
Schertz Economic Development Corporation — September 27, November 29 and December 6
Over the last quarter, the SEDC participated in two recruitment events including a Team Texas Roadshow in Atlanta and
manufacturing trade show in Chicago. The Board held election of officers and Paul Macaluso was elected Board President,
Jesse Hamilton was elected Board Vice President, Daniel Ortega was elected Board Treasurer, and Sammi Morrill was
elected Board Secretary. In reviewing the SEDC Annual Report FY 2017 -18, an overview was given for all SEDC activities for
the previous fiscal year. During the year, the SEDC added four Projects. Each of the Projects involved adding infrastructure
which will help create space for new and expanded industrial, office and retail businesses. The annual report is available
on the SEDC's website. Lastly, the Board approved Resolution No. 2018 -1 voluntarily terminating the incentive agreement
with GE Oil & Gas LLC. The Board elected to voluntarily terminate the agreement because GE had planned to close its
operations in Schertz and had repaid the incentive. The voluntary termination made all parties whole and allows everyone
to move forward.
Committee of Committees Advisory Board Summary
CCAB Notes 12/19/18:
Brian James gave the City Manager report. As part of that he discussed Council's hiring of Mark Browne, currently
the City Manager of Alamo Heights, as the new City Manager. Mark will be starting on January 2. Dudley Wait,
Executive Director, is leaving to go work for STRAC (South Texas Regional Advisory Council) at the end of the year.
STRAC develops, implements and maintains the regional trauma and emergency healthcare system for the 22
counties. Dudley is going to keep working as an irregular part time paramedic with Schertz EMS.
Emily Delgado provided an overview of the new agenda software the City is purchasing. She reviewed the
benefits of the program for residents, board members and staff. The plan is to roll it out with the Planning and
Zoning Commission in February and then to Council and other boards and commissions.
Linda Klepper provided and overview of the Schertz Magazine, noting that she will be making a presentation to
City Council on the magazine in January or February. Linda went over the history of the magazine and its
evolution to what it is today.
