AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
PROVIDING THAT THE CODE OF ORDINANCES CITY OF
SCHERTZ, TEXAS, BE AMENDED BY DELETING CHAPTER 5,
BUILDINGS AND BUILDING REGULATIONS AND REPLACING
SAME WITH A REVISED CHAPTER 5, BUILDINGS AND
BUILDING REGULATIONS, PROVIDING AN EFFECTIVE DATE;
AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT.
WHEREAS, there have been numerous changes to state laws
and city ordinances governing the buildings and building
regulations of the city,

ARTICLE I. IN GENERAL*
Sec. 5 -1. Office of Building Official Created. Appointed and
General Powers and Duties.
There is hereby established the office to be know as the
Building Department and the person in charge shall be known as
the Building Official. Such building official shall be appointed
by the city manager and shall have the powers and perform the
duties prescribed by the Building, Housing, Plumbing, gas,
electrical, swimming pool, mechanical, unsafe building abatement,
one and two family dwelling and amusement codes and other
ordinances of the city and by the city council and the city
manager.

Sec. 5 -2. Fire Limits.
The fire limits of the city shall be as established, from
time to time, by the city council. Nothing in the code or the
ordinance adopting the code shall affect the validity of any
ordinance establishing the fire limits and all such ordinances
are hereby recognized as continuing in full force and effect.
Sec. 5 -3. Violations and Penalties.

(a) Where work for which a permit is required by this chapter
is started or proceeded prior to obtaining said permit, the fees
herein specified shall be doubled, but payment of such double fee
shall not relieve any persons from any other penalties prescribed
herein.
(b) Any person, firm, corporation or agent who shall violate
a provision of this chapter, or fail to comply therewith, or with
any of the requirements thereof, or who shall erect, construct,
alter, install, demolish or move any structure, electrical, gas,
mechanical or plumbing system, or has erected, constructed,
altered, repaired, moved or demolished a building, structure,
electrical, gas, mechanical or plumbing system, in violation of a
detailed statement or drawing submitted and permitted thereunder,
shall be guilty of a misdemeanor. Each such person shall be
considered guilty of a separate offense for each and every day or
portion thereof during which any violation of any of the
provisions of this chapter is committed or continued, and upon
conviction of any such violation such person shall be punished by
fine of not more than one thousand dollars ($1,000.00) for each
offense.
Sec. 5 -4. Definitions.
Whenever the term "Board of Adjustments and Appeals" is
referenced within any code adopted under this chapter, shall mean
the City Council of the City of Schertz, who shall rule on all
appeals filed under this chapter.
Whenever the term "Applicable Governing Body" is referenced
within any code adopted under this chapter, shall mean the City
Council of the City of Schertz.

ARTICLE II. BUILDING CODE*
Sec. 5 -15. Adopted.
The Standard Building Code, 1994 Edition, as amended, revised
and corrected, to include all future editions, revisions,
amendments and corrections, published by the Southern Standard
Building Code Congress International, Inc. (S.B.C.C.I.), one (1)
copy of which is on file with the city secretary, is hereby
adopted and incorporated by reference as the building code of the
City of Schertz, Texas, subject to and including by reference
such amendments as herein shall appear.
Sec. 5 -16. Amendments.
The building code adopted by section 5 -15 is hereby amended
as set out in the following paragraphs of this section.
Section 102.2.1 - -- Building Officials Qualifications - - -is
hereby amended as follows:
The building official shall have one or all of the following
qualifications:
(a) Certified or accepted as a building inspector by /for a
State or Federal Agency.
(b) Five years experience as a building inspector, builder,
engineer, architect, or as a superintendent, foreman, or
competent mechanic in charge of construction, or any combination
of these.
Section 102.2.3 - -- Inspectors Qualifications - - -is hereby
amended as follows:
The building official with the approval of the city manager
may appoint such number officers, inspectors, assistants and
other employees as shall be authorized from time to time. A
person or inspection service shall not be appointed as inspector
of construction unless one of the following qualifications are
met.
(a) Certified or accepted as a building inspector by /for a
State or Federal Agency.
(b) Five years experience as a building inspector, builder,
engineer, architect, or as a superintendent, foreman, or
competent mechanic in charge of construction, or any combination
of these.

(c) One year experience as a building inspector, builder,
engineer, architect, or as a superintendent, foreman, or
competent mechanic in charge of construction, or any combination
of these. Performance of duties as inspector must be under
supervision of persons qualified under sub - paragraph (a or b).
Section 104.2.3 - -- Design Professional - - -is hereby amended as
follows:
The design professional shall be an architect or engineer
legally registered under the laws of this state regulating the
practice of architecture or engineering and shall affix his
official seal to said drawings, specifications and accompanying
data, for the following:
(a) All group A, E and I occupancies.
(b) Buildings and structures three stories or more in height.
(c) Buildings and structures 5000 sq. ft. or more in area.
(d) All group R occupancies regardless of size.
For all other buildings and structures, the submittal shall
bear the certification of the applicant that some specific state
law exception permits its preparation by a person not so
registered.
Section 104.5 - -- Contractor's responsibilities - - -is hereby
amended as follows:
(a) It shall be the duty of all contractors who practice
their craft within the City of Schertz, Texas to give good and
sufficient bond in the amount of five thousand dollars
($5,000.00) conditioned to conform to the building code and other
ordinances or laws of the applicable governing body in reference
to building. Bond shall run a concurrent term with contractors
license.
(b) A written application for a contractors license will be
submitted to the building official on a form prescribed by the
city along with the required initial fee and evidence of
qualifications as follows:

The building official, within thirty (30) days from the
receipt of the completed application, will issue the license or
give a written refusal setting out the reasons for refusal.
(c) Renewal - All renewals shall be due January 1, of each
year. Failure to renew within thirty (30) days after the renewal
date will require the applicant to reapply for licensing at the
initial fee rate.
(d) Revocation - An applicant whose application for a license
has been denied may apply to the Board of Adjustments and Appeals
within thirty (30) days in writing along with an established
filling fee.
Section 105 - -- Inspections - - -is hereby amended as follows:
Subsection 105.6 -- Inspections Required, in addition to the
inspections listed in this section there shall be an insulation
inspection to be made after wall insulation is completed.
Section 1005.5 --- Smokeproof Enclosures - - -is hereby amended as
follows:
Subsection 1005.5.2 - -Where required, structures of three
stories or higher must have a smokeproof enclosure as required by
this section.
Subsection 1005.5.3 - -Group B and R buildings exceeding
fifteen thousand (15,000) sq. ft. per floor and complying with
the area of refuge (compartmentalization) option described in
section 506.9 are exempt from the smokeproof enclosure
requirements.
Section 1509 -- -Roof Coverings - - -is hereby amended as follows:
Subsection 1509.8 - -Wood Shingles and Shakes - -Wood shingles
and shakes are prohibited on roof and /or siding of any building
within the city limits. Only minor repairs to the existing wood
shingles and shakes surfaces can be made with the same materials.
If fifty percent (50 %) or more of any surface needs to be
repaired or replaced with new materials, it shall be completely
replaced with an authorized material.

Section 1804 - -- Footings and foundations - - -is hereby amended
as follows:
Subsection 1804.1.3 - -The bottom of foundations shall extend
below the frost penetration shown in figure 1302.1, but no less
than 12 inches (305mm) below natural grade.
Section 3313 - -- Moving of buildings - - -is hereby amended in the
following respects:
Subsection 3313.5 -- Notice of Permit - -Upon the issuance of
said moving permit, the person desiring to move a building shall
give notice to the chief of police, chief of the fire department,
electric and telephone companies, or whose property may be
affected by such removal. Informing such entities of the route
to be taken, time started, and approximate time of completion.
Such person desiring to move a building shall move the same along
such routes as may be designated in the permit and at the times
specified therein and only when accompanied by a escort service.

B105 Plan- Checking Fee
When the valuation of the proposed construction exceeds
$25,000. and a plan is required to be submitted by 103.2, a
plan- checking fee shall be paid to the Building Official at the
time of submitting plans and specifications for checking. Said
fee shall be 25 percent of the building permit fee or $150.00
which ever is less. Such plan - checking fee is in addition to the
building permit fee.

adopted and incorporated by reference as the housing code of the
City of Schertz, Texas, subject to and including by reference

adopted and incorporated as the Backflow and Cross - Connection
Code of the City of Schertz, Texas.
Sec. 5 -46. Indoor Plumbing Fixtures and Insulation of Exposed
Hot Water Piping
(a) Findings
(1) Design improvements of indoor plumbing fixtures have
substantially reduced the volume of water required to operate
such fixtures effectively.

(2) Increasing demand throughout the Edward's Aquifer region
requires implementation of water conservation programs and
policies by municipalities throughout the region to safeguard the
availability of water for all beneficial purposes.
Indoor Plumbing Fixtures and Insulation
of Exposed Hot Water Piping
(3) Effecting measures that incorporate higher efficiency
standards in water - intensive plumbing applications are an
integral part of ensuring the economic and ecologic vitality of
communities in the Edward's Aquifer region.
(b) Purpose
This article establishes maximum water flow or discharge
rates for indoor plumbing fixtures and requires insulation of
exposed hot water piping in order to promote water conservation
and greater efficiency in these fixtures.
(c) Certification
Indoor plumbing fixtures required to be installed pursuant to
this article shall comply with all applicable standards
promulgated by the American Society of Mechanical Engineers and
the American National Standards Institute.
(d) Applicability
(1) New Construction
(2) Any renovation of plumbing facilities in an existing
building.
(e) Performance Requirements
All new and /or replacement water closets, urinals, faucets,
and showerheads shall meet the following standards for water flow
or discharge rate.
(1) Faucets (lavatory) - All lavatory faucets and replacement
aerators shall be designed, manufactured, installed or equipped
with a flow control device or aerator which will not allow a
water flow rate in excess of 2.2 gallons per minute.
(2) Faucets (other) - All kitchen, bar and other commercial
sink faucets and replacements aerators shall be designed,
manufactured, installed or equipped with a flow control device or
aerator which will not allow a water flow rate in excess of 2.5
gallons per minute, when tested at 60 psi (flowing) in accordance
with ASME/AMSI A112.18.1.

(3) Faucets (public restrooms) - All lavatory faucets located
in restrooms in any public building shall be of hands -free
metering, or self - closing type and shall not allow a water flow
rate in excess of 0.5 gallons per minute when tested at 60 psi
(flowing) in accordance with ASME/ANSI A112.18.1.
(4) Showerheads - All showerheads shall be designed,
manufactured, and installed with a flow limitation device which
will not allow a water flow rate in excess of 2.75 gallons per
minute, when tested at 60 psi (flowing) in accordance with
ASME/ANSI A112.18.1. The flow limitation device must be
permanent and integral part of the showerhead and must not be
removable to allow flow rates in excess of 2.75 gallons per
minute.
(5) Urinals - Urinals shall be designed, manufactured and
installed so the average maximum flush will not exceed 1.0
gallons of water and otherwise perform in accordance with
ASME /ANSI A112.19.2 and A112.19.6. Adjustable type flushometer
valves may be used provided they are adjusted so the maximum
flush will not exceed 1.0 gallons of water.
(6) Water Closet - The maximum volume of water per flush from
a toilet shall not exceed an average of 1.60 gallons when tested
in accordance with ANSI testing procedures.
(7) Water Closet (wall mount) - The maximum volume of water
per flush from a wall mounted toilet that employs a flushometer
valve shall not exceed an average of 2.00 gallons when tested in
accordance with ANSI testing procedures.
(8) Drinking Fountains - All drinking water fountains shall
be operated by a self closing valve.
(f) Marking Requirements
All faucets, showerheads and their packaging shall be clearly
marked by the manufacturer in accordance with the provisions of
ASME /ASNI A112.18.1. Water closets and urinals and their
packaging shall be marked in accordance with the provisions
contained in ASME/ANSI A112.19.2.
(g) Exposed Hot Water Piping
All exposed hot water piping shall be thermally insulated in
every new building, or addition or renovation of an existing
building for which a building permit has been issued after the
effective date of this article, and when a replacement hot water
heater or hot water piping is required in any building.

(h) Exceptions
The provisions of this ordinance shall remain in effect for
all applications cited in section (d) with the following
exceptions:
(1) In replacement applications, ultra -low flow water closets
shall not be required if engineering calculations show that the
reduced waste flow could cause the building drainage systems to
function improperly. These calculations must be performed by,
and carry the seal of, a registered professional engineer and be
approved by the Plumbing Inspector.
(2) Special purpose safety showers, aspirators faucets, and
clinical sinks in a hospital or medical offices, wherein such
fixtures are not required to comply with maximum flow rate
requirements prescribed by this ordinance.

ARTICLE V. GAS CODE*
Sec. 5 -57. Adopted.
The Standard Gas Code, 1994 Edition with all future editions,
revisions, amendments and corrections, published by the Southern
Standard Building Code Congress International, Inc.
(S.B.C.C.I.), one (1) copy of which is on file with the City
Secretary, is hereby adopted and incorporated as the Gas Code of
the City of Schertz, Texas, subject to and including by reference
such amendments as herein shall appear.
Sec. 5- 58- -5 -66.
ARTICLE VI. ELECTRICAL*
Sec. 5 -67. Adoption.
The National Electric Code, 1993 Edition to include all
future editions, revisions, amendments and corrections, published
by the National Fire Protection Association (N.F.P.A.), one (1)
copy of which is on file with the City Secretary, is hereby
adopted by reference as the Electrical Code of the City of
Schertz, Texas, subject to and including by reference such
amendments as herein shall appear.
Sec. 5 -68. Utility Electric Cooperatives.
This Code in no way alters or repeals any additional
requirements established by any other utility companies and /or
cooperative for its members and /or consumers.

Sec. 5 -69. Inspector.
The City Building Official shall be the Electrical Official
for the City. In the event that the city shall not have anyone
serving the capacity of Building Official, the City Manager may
elect another officer, inspection, or inspection service to
perform said duties and functions.
Sec.5-70. Licenses and Bonds.
(a) No person shall install, repair or remove electrical
wiring or devices unless he is licensed as a master electrician
by the City or unless he is supervised by a licensed master
electrician and holds a journeyman license by the City. Work
done by an apprentice must be directly supervised by a licensed
master or journeyman electrician.
Exception
(1) A license and bond is not required of a homeowner who is
doing electrical work on his own home. The homeowner may receive
help from others to do such work, provided that no consideration
of any kind be given for such help and provided that the
principal occupation of the person giving help is not that of an
electrical contractor or electrician.
(2) A license is not required of a person who is hired as a
full -time employee to perform normal maintenance excluding
alterations and additions of electrical systems in commercial
establishments, provided that the person does not work as an
electrician or electrical contractor for the general public.
(b) Classifications of licenses - There shall be three
classification of electrician licenses:
(1) Master - A master license will be issued to an applicant
when he /she has held a journeyman license for two (2) consecutive
years and has passed an open book test to determine his /her
familiarity with the National Electrical Code. There is a test
fee of twenty five dollars ($25.00) and the applicant must
achieve a score of eighty percent (80 %).
(2) Journeyman - An applicant will be issued a journeyman
license when he /she has held a apprentice license for two (2)
consecutive years and has passed the journeyman examination with
a score of eighty percent (80 %). There is a test fee of twenty
five dollars ($25.00).

(3) Apprentice - An applicant will be issued an apprentice
license when he /she is employed by a licensed master and is
undergoing training to learn the craft of a skilled electrician.
The license will be valid only while employed by a licensed
master electrician.
(c) License Fee - The fees for electrician's licenses under
this article shall be as follows:
(1) Initial issuance fees:
Master $40.00
Journeyman 20.00
Apprentice 5.00
(2) Annual renewal fees:
Master $20.00
Journeyman 10.00
Apprentice 5.00
(d) The terms and conditions of the license are as follows:
(1) Renewal - All renewals shall be due January 1 of each
year. Failure to renew within thirty (30) days after the renewal
date will require the applicant to reapply for licensing at the
initial fee rate.
(2) Revocation - Any license issued under this article may be
revoked by the Building Official for failure to remedy
unsatisfactory work, violation of the electrical code, failure to
obtain a permit or failure to obtain proper inspections.
(3) Appeal - An applicant, whose license has been denied or
revoked may appeal to the Board of Adjustment within 30 days in
writing along with an established filling fee.
(4) Bond Required - It shall be the duty of all electrical
contractors who practice their craft within the City of Schertz,
Texas to give good and sufficient bond in the amount of one
thousand dollars ($1,000.00) conditioned to conform to the
electrical code and other ordinances or laws of the applicable
governing body in reference to building. The bond shall run for
a concurrent term with the license.

Sec. 5 -71. Permits.
(a) Required - Except as hereafter provided, it shall be
unlawful for anyone to install or permit to be installed any
electrical system, or part of such systems, or to make
alterations, additions, changes or major repairs to an electrical
system without having obtained a permit to do such work.
(b) Exceptions - No permits shall be required for the
following electric work:
(1) Normal maintenance work, such as replacement of lamps,
sockets, fuses, drop cords, snap switches or other similar minor
repairs as may be permitted by the Building Official.
(2) Connection of portable electrical equipment to suitable
existing permanently installed receptacles.
(3) Replacement of a motor by another motor of the same
horsepower and rating, and installation of pressure devices and
similar controls, when the electrical supply for the same has
been properly installed by a licensed electrician.
Sec. 5 -72. Fees.
An electrician wishing to conduct business within the City,
shall first submit an application for permit to the Building
Official on a form prescribed by the City.
The following fee schedule shall apply to permits issued
under this code. Where work for which a permit is required by
this code is started prior to obtaining the required permit, the
permit fee shall be doubled.

(a) The Building Official shall inspect or cause to be
inspected all electrical work done for which a permit is
required. The inspector may make as many inspections as deemed
necessary to insure an adequate system. It will be the
responsibility of the permit holder to notify the inspector when
an inspection is needed, in accordance with this schedule:
(1) Rough Inspectio;

forty -eight (48) hours after the inspection is requested
excluding Saturdays, Sundays and holidays. If the inspection is
not made within the required time, the contractor may cover his
work or energize the system. This in no way will release the
contractor from making corrections if deficiencies are found at a
later time.

Sec. 5 -74. Appeals.
(a) Whenever the Building Official or inspector shall reject
or refuse to approve the mode or manner of construction or
materials to be used in an electric system, or when it is claimed
that the provisions of this code do not apply, or that an equally
good or more desirable form of electric fabrication can be
employed in any specific case, or any of the regulations
thereunder have been misconstrued or wrongly interpreted, the
permit holder or applicant may appeal the decision of the
Building Official or inspector to the Board of Adjustments and
Appeals. Notice of appeal shall be in writing and filed within
thirty (30) days after the decision is rendered by the Building
Official.
(b) If in the opinion of the Building Official an electric
system or device threatens the safety or welfare of others, he
may limit the time for such appeal to a shorter period.

ARTICLE VII. SWIMMING POOL CODE*
Sec. 5 -86. Adopted.
The Standard Swimming Pool Code, 1991 Edition, as amended,
revised and corrected, to include all future editions, revisions,
amendments and corrections, published by the Southern Standard
Building Code Congress International, Inc. (S.B.C.C.I.), one (1)
copy of which is on file with the City Secretary, is hereby
adopted and incorporated by reference ad the swimming pool code
of the City of Schertz, Texas, subject to and including by
reference such amendments as herein shall appear.
Sec. 5 -87. Amendments
The Swimming Pool Code adopted by section 5 -76 is hereby
amended as set out in the following paragraphs of this section.
Section 105.6 --- Scedule of Permit fees - - -is hereby amended as
follows:

Section 106.1 - -- Inspections Required - - -is hereby amended as
follows:
Upon final inspection all swimming pool installations must be
completed. The pool shall be completely filled with water and in
operation before final inspection. Pools shall be completely
enclosed as required in section 315.

ARTICLE VIII. MECHANICAL CODE
Sec. 5 -99. Adoption.
The Standard Mechanical Code 1994 edition to include all
future editions, revisions, amendments and corrections, published
by the Southern Standard Building Code Congress International,
Inc. (S.B.C.C.I.), one (1) copy of which are on file with the
City Secretary, is hereby adopted by reference as the Mechanical
Code of the City of Schertz, Texas, Subject t and including by
reference such amendments as herein shall appear.
This code in no way alters or repeals any additional
requirements established by other utility company and /or
cooperative for its members and /or consumers.
Sec. 5 -100. Amendments
Section 103.5 - -- Contractors Responsibilities - - -is hereby
amended as follows:
(a) It shall be the duty of all mechanical contractors who
practice their craft within the City of Schertz, Texas to show
proof of State license and insurance as required by the
Department of Licensing and Regulation, as referenced in State
Law, Article 8861, TDLR -ACR -75.1 1 /v. 1/93.

reference as the One and Two Family Dwelling Code of the City of
Schertz, Texas, subject to and including by reference such

ARTICLE XI. AMUSEMENT DEVICE CODE
Sec. 5 -135. Adopted.

adopted and incorporated by reference as the Amusement Device
Code of the City of Schertz, Texas, subject to and including by
reference such amendments as herein shall appear.

II
All ordinances, resolutions, or parts thereof, which are in
conflict or inconsistent with any provision of this Ordinance
are hereby repealed to the extent of such conflict.
III
This Ordinance shall be construed and enforced in accordance
with the laws of the State of Texas and the United States of
America.
IV
If any provision of this Ordinance or the application thereof
to any person or circumstance shall be held invalid or
unconstitutional by any court of competent jurisdiction, the
remainder of this Ordinance and the application of such
provision to the other persons and circumstances shall
nevertheless be valid, and this City Council hereby declares
that this Ordinance would have been enacted without such
invalid provision.
EFFECTIVE DATE: The provisions of this ordinance shall be in
force and effective from date of final approval.

Re: Requested Ordinance Change - Chapter 5, Building Code.
Mr. Sweatt,
In review of chapter 5, Buildings and Building Regulations, I
would like to submit the following ordinance that will bring us
up to date and remove areas of repetition. As you will note
Chapter 5 is a complete re -write so I will try to point out the
major changes.
* The following articles have been added, which are supplements
to the Southern Standard Building Code and are necessary in the
enforcement of our duties
IX. Unsafe Building Abatement Code
X. One and Two Family Dwelling
XI. Amusement Device Code
* Fee Changes:
Article II. Building Code., Section 5 -16 Amendments, Appendix B
Permit Fees, B105 Plan - Checking fees - will now be enforced due
to the increased plan load. Instead of it being one half the
building permit fee for anything over 1,000.00 as outlined by
SBCCI., I recommended the lay out as shown to assist our
citizens with remodeling and back yard projects. Also please
note that most of our contractors already pay this fee in our
sister cities.
Article VI. Electrical. Section 5 -70 Licenses and Bonds -
under sub - section b, 1 and 2 we are recommending an increase
from $10.00 to $25.00 for test fees to help compensate having
someone proctor the test.
Also under Section 5 -70 Licenses and Bonds, sub - section c - we
will now start charging an apprentice license fee of five
dollars ($5.00). The City Code has always required such
license, but was not enforced. The fee will be charged to
compensate office paper work.
Section 5 -72 permit fees - we are recommending an itemized fee
schedule which will provide us with better information at the
permitting stage. With most of our electrical contractors being
from or working in San Antonio they are already familiar with
the itemized system. A copy of the application can be found on
the last page of the pamphlet.
Article VII. Swimming Pool Code., Section 5 -87 Amendment -
Shows that the building permit fees found in Article II shall be
used to permit swimming pools, which are currently being used.
Other Changes:
Article I. In General., Section 5 -1 Office of Building Official
Created - this section was re- worded to be consistent with the
Southern Standard Building Code and the City Charter.
Article I. Sections 5 -3 Violations and Penalties, Section 5 -4
Definitions - have been added to avoid repetition in other parts
of this chapter.
