ORDINANCE ADOPTING AN ANNEXATION PLAN FOR THE CYI:Y OF SCHERTZ,
TEXAS AND DECLARING AN EMERGENCY
WHEREAS, the Seventy-Sixth Regular Session of the Texas Legislature enacted requirements
for municipalities to adopt annexation plans before December 31, 1999; and

WHEREAS, the annexation plan requirements stipulate that, except ~ts set forth in such
legislation, no property or area may be annexed by a municipality until after the third anniversary of
the date of adoption of a plan or plan amendment in which that particular property or area is designated
for annexation;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL O1~ THE CITY OF
SCHERTZ, TEXAS
Section 1. Annexation Plan. The City Council of'the City Schertz hereby tdopts the following
annexation plan:

It is the current intention of the City of Schertz, Texas not to annex any pro >erty or area
which is not excepted from the annexation plan requirements of 'I'exas Local
Government Code Section 43.052, as amendec[
Section 2. Waiver of Separate Readings. By vote of not less than two-thirds of the
members of the City Council present at the meeting at which this Ordinance was :onsidered, the City
Council has determined that an emergency exists which requires immediate action and this Ordinance
is hereby adopted on a single reading. This Ordinance shall be in force and effe, :t from and after its
final passage, and it is so ordained.

Meetings Act, Texas Government Code Chapter 551, as amended, at which a quorum was present.

On October 26, 1999 at the regular meeting of the Planning & Zoning
following was passed.
That given the passage of Senate Bill 89, by the 76th Texas Legislature, it x
that the City of Schertz City Council adopt an annexation plan on or before
1999. This annexation plan is to include property in the City's E~
developmem. Additional, certain in fill properties located principally to t
which do not need to be included in the annexation plan, the Commission r
areas are set up for immediate annexation with procedures to begin prior
1999.
Explanation: The City Council is well aware of the passage of Senate B!
Texas Legislature, but may be aware of some of the options and long ra
comained therein.
The first is the issue is a newly required City Annexation Plan that mu~
December 31, 1999. Since Planning & Zoning will be involved in the de~
plan (for future annexation) we believe that it is important that Planning &
Council share information related to municipal expansion. We also ~
imperative that we involve the City Attorney in the development of this plax
the recem APA Conference by Dorothy G. Palermbo, Assistant Genera
Municipal League and Analeslie Muncy, City Attorney for several Texas (
this task will be very difficult and requires detailed work. As of the t
Conference no city had completed nor had in place an annexation pl~
requirements of the law.
The second issue involves the ability of the City of Schertz to annex portk
the old laws (prior to September 1, 1999). Briefing the discussions at
personnel identified above provided information that it strongly benefits th
to complete certain annexations at this time. "The City of Schertz betwe~
2002, may continue to annex any nonexempt area that is not included in th{
under the former law". This could prove to be a very important point for p~
of certain land areas after the 3 years have elapsed.
