The Schertz Planning and Zoning Commission convened on September 25, 2019 at 6:00
p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4,
Schertz, Texas.

The applicant is proposing to final plat approximately 1.3.5 acres of land establishing fifty -five (55) single
family residential lots. All fifty -five (55) of the lots in Unit 3B will be `SF 50' lots with a minimum size of
6,000 square feet as dictated by the Rhine Valley PDD (Ordinance 13- S -37).

The site is zoned Planned Development District (PDD). This final plat was reviewed using the Rhine
Valley PDD (Ordinance 13 -S -37) and the UDC, Ordinance 11 -S -15, as amended.
GENERAL LOCATION AND SITE DESCRIPTION:
The subject property is currently undeveloped and generally located 3,000 feet east of the intersection of
FM 1518 and Ray Corbett Drive, City of Schertz, Guadalupe County, Texas.
ACCESS AND CIRCULATION:
The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations
accessing existing public streets. This development is designed to have two (2) points of access via
Mulhouse Drive and Luneville Lane.
TREE MITIGATION AND PRESERVATION:
The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9
Tree Preservation and Mitigation. The applicant has submitted a tree affidavit which indicates that this
site has no protected or heritage trees.
PUBLIC SERVICES:
The site is serviced by Schertz water, CCMA, CPS, AT &T, and Spectrum.
PUBLIC IMPROVEMENTS:
All public improvements required for this subdivision are required to be installed prior to recording of the
final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement.
Parks: All parkland requirements have been completed, no fees are required. A five (5) acre public park
was dedicated with Unit 1 of this subdivision, which meets the parkland dedication requirements for this
subdivision. The parkland improvements were constructed in two (2) phases: phase I of the improvements
includes a parking lot, gazebo, BBQ pits, and playground, and phase II of the improvements includes
soccer fields, multi - purpose ball fields, a sports court, and a walking trail. The Parks and Recreation
Board made a recommendation of approval for the addition of a variable width drainage easement inside
Lot 1, Block 14 (public parkland dedicated with Rhine Valley Subdivision Unit 1) at the September 23,
2019 meeting; City Council will make the final decision to approve or deny the addition of this drainage
easement within public parkland at the October 22, 2019 meeting. The variable width drainage easement
is reflected in this final plat.
Water and Sewer: This site will be serviced through 8" water lines and 8" sewer lines that will be
extended throughout the subdivision and stubbed for future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for
compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the
City Engineer.
Sidewalks, Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout
the subdivision. All sidewalks will be designed to meet City of Schertz Specifications.
Road Improvements: All streets will be developed to City of Schertz specifications.
COMMISSIONERS CRITERIA FOR CONSIDERATION:
The Planning and Zoning Commission is the final approval authority of the proposed final plat. In
considering final action on a final plat, the Commission should consider the criteria within UDC,
Section 21.12.1O.D.

ITEM SUMMARY:
According to UDC Sec. 21.12.6.A.2.a, a subdivision master plan is required for any development in which
the property is undeveloped, is under one (1) ownership, and is greater than fifty (50) acres in size. An
original master development plan for the HGV Investments Subdivision was approved by the Planning
and Zoning Commission in 2009 in order to plat and develop Unit 1. The applicant is proposing to amend
the original HGV Investments master development plan in order to reduce the total number of units from
five (5) to three (3). The only portion of the property that is affected by this master development plan
amendment is the proposed Unit 2; the proposed Unit 2 is currently split into three different units (Units
2 -4), and through this amendment that land would all be combined into one unit (Unit 2). This master
development plan amendment is necessary because the applicant is currently proposing to preliminary
plat the proposed Unit 2 into two (2) commercial lots in order to develop a building materials and lumber
store on one of the lots. All plats must be in conformance with the master development plan on file for the
subdivision, and so Units 2 -4 are being reduced to just one unit to be able to plat the two (2) commercial
lots in the proposed Unit 2.

The HGV Investments Unit 2 Subdivision is an approximately 85 acre tract of land located at 21799 FM
2252. The current Lot 1, Block 1, Unit 1 is developed as Basic Industries Ltd, a general
manufacturing /industrial use business, whereas the rest of the property (proposed Units 2 and 3) is
currently undeveloped.
ACCESS AND CIRCULATION:
The HGV Investments Subdivision Units 1 and 2 have frontage onto FM 2252, which is identified as a
Secondary Arterial according to the Schertz Master Thoroughfare Plan, and HGV Investments Unit 3 has
access to FM 482, which is identified as a Principal Arterial according to the Schertz Master Thoroughfare
Plan.
TREE MITIGATION AND PRESERVATION:
The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9
Tree Preservation and Mitigation. The applicant has submitted a tree affidavit which indicates that the
development of this site will in no way cause the destruction of or damage to any Protected or Heritage
class tree(s).
PUBLIC SERVICES:
The site will be serviced by Green Valley Special Utility District (GVSUD), Cibolo Creek Municipal
Authority (CCMA), Charter Spectrum, AT &T, CPS, and Center Point Energy.
All public improvements required for this subdivision are required to be installed prior to recording of the
final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement.
Water: The site will be serviced by the Green Valley Special Utility District for water through a 20' Green
Valley SUD Water Easement to be recorded via separate instrument.
Sewer: The site is not currently serviced by a public wastewater system. The applicant is currently
requesting a waiver to allow both lots in Unit 2 to be served by on -site sewage facilities (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property and
compliance with the Storm Water regulations. A preliminary drainage report has been reviewed and
approved by the City Engineer.
Sidewalks, Hike and Bike Trails: A sidewalk is required to be constructed along FM 2252 and designed to
meet City of Schertz specifications.
Road Improvements: The subject property is located adjacent to FM 2252, a Principal. Arterial roadway
according to the Schertz Master Thoroughfare Plan (MTP) and a TxDOT roadway. TxDOT is requiring a
29.2' right -of -way dedication along the Unit 2's entire frontage on FM 2252 with the plat application
STAFF ANALYSIS AND RECOMMENDATION:
The proposed master plan is consistent with all applicable zoning requirements, ordinances and
regulations for the property; therefore, Staff recommends approval of the HGV Investments Subdivision

COMMISSIONERS CRITERIA FOR CONSIDERATION:
The Planning and Zoning Commission is the final approval authority of the proposed master development
plan. In considering final action on a master development plan, the Commission should consider the
criteria within UDC, Section 21.12.6 D.

GENERAL INFORMATION:

ITEM SUMMARY:
The applicant is proposing to preliminary plat approximately 20 acres of land into two (2) commercial
lots in order to develop a building materials and lumber store. The applicant is seeking approval of a
waiver to UDC Sec. 21.15.313 wastewater systems in order to have the ability to install privately owned
On -Site Sewage Facilities (OSSF) on site. The subject property is zoned Manufacturing Light District
(M -1).
GENERAL LOCATION AND SITE DESCRIPTION:
The subject property is currently vacant, undeveloped land located at 21799 FM 2252.
PUBLIC IMPROVEMENTS:
The applicant is seeking approval of a waiver to install privately owned On -Site Sewage Facilities (OSSF)
on the subject property. The OSSF systems would be regulated by Comal County. The subject property
has a dual Certificate of Convenience and Necessity (CCN) for sewer with the City of Schertz responsible
for collection and Cibolo Creek Municipal Authority (CCMA) responsible for treatment.
In accordance with UDC, Article 1.5 Easements and Utilities, Sec. 21.1.5.3.13, Wastewater System, all lots,
tracts and parcels on which the development is proposed shall be connected to a public wastewater
system. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided
or platted shall comply with the requirements of this UDC.
Based on the requirements defined in UDC Sec. 21.1.2.15 Waivers, forgoing a connection to a public
wastewater system and installing an OSSF requires a waiver to be granted by the Planning and Zoning
Commission. The UDC authorizes the Planning and Zoning Commission to grant waivers to the
provisions in Article 1.2 when undue hardship will result from requiring strict compliance.

The applicant is requesting a waiver to the required connection to a public waste water system to allow
the installation of privately owned on -site sewage facilities. The closest sewer connection is
approximately 5,700 to the northeast near the intersection of the Union Pacific Railroad and Abbey Road.
The added cost of the infrastructure required to comply with UDC Sec. 21.15.3.B., Wastewater Systems,
would pose a substantial financial burden to the property owner and developer.
The Engineering Department has reviewed this request and is in support of granting the waiver. They
have verified that the proposed preliminary plat associated with the waiver is laid out in a manner to
provide for connection to a public sanitary sewer system in the future. The granting of this waiver will not
have a negative impact on existing or proposed municipal infrastructure. Additionally, the granting of this
waiver will not be detrimental to the public health, safety, or welfare, or be injurious to other property in
the area. If approved, any new On Site Sewage Facilities needed to serve the proposed preliminary plat
will be reviewed and permitted through Comal County. This waiver request has been reviewed with no
objections by Public Works, Engineering, and Planning Departments; therefore, Staff is recommending
approval of this waiver to UDC Sec. 21.15.3.13, Wastewater Systems, as submitted.

COMMISSIONERS CRITERIA FOR CONSIDERATION:
In considering final action on waivers to the UDC, the Commission should consider the criteria within the
UDC:
Section 21.12.15 Waivers
A. General
The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in
its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning
and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public
interest. In making their findings, the Planning and Zoning Commission shall take into account the nature
of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons
who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic
conditions and upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not
be granted unless the Planning and Zoning Commission finds:
1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or
injurious to other property in the area; and
2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of other
land in the area in accordance with the provisions of this UDC. Such findings of the Planning and Zoning
Commission, together with the specified facts upon which such findings are based, shall be incorporated
into the official minutes of the Planning and Zoning Commission meeting at which such waiver is
granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC
so that the public health, safety, and welfare may be secured and justice done.
B. The Planning and Zoning Commission may establish a time period for execution of each granted
waiver.
C. Such findings together with the specific facts on which such findings are based shall be incorporated
into the official minutes of the Planning and Zoning Commission meeting at which such exception is
granted.
D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a
valid law, ordinance, code or regulation of the City.
E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this
Article may be appealed to the City Council. When considering an appeal, the City Council shall
consider the same standards as the Planning and Zoning Commission as outlined above.

This letter is provided on behalf of FP Hacienda Properties LLC, owner of the property at 21799 FM 2252
(Comal County ID # 383888) in Schertz, Texas, to request a waiver from the City of Schertz Code of
Ordinances Section 90 -78 (a) which requires owners of commercial buildings to connect to a public sanitary
sewer system if such public sanitary sewer system exists within 1,500 feet of the property boundary.
FP Hacienda Properties LLC wishes to amend the HGV Investments Master Development Plan and the
Unit 2 Preliminary Plat to allow for the construction of a retail outlet facility for their quarry products. An
on -site sewage facility is proposed for this development due to the distance to the nearest possible
connection point to a public wastewater system. According to the City of Schertz Sewer Master Plan the
nearest connection point is located at the intersection of Abbey Road and the Union Pacific Railroad,
approximately 5,725 feet from the site. We feel that this request for a waiver from Section 90 -78 (a) is
warranted due to the excessive distance to the public sanitary sewer from the property. Please see the
attached exhibit showing the property boundary and location of the nearest existing public wastewater
facility.

GENERAL LOCATION AND SITE DESCRIPTION:
The subject property is currently vacant, undeveloped land located at 21799 FM 2252.
ACCESS AND CIRCULATION:
Both of the lots within the proposed HGV Investments Subdivision Unit 2 will have frontage on FM
2252. The Texas Department of Transportation (TxDOT) has granted one shared access point for the two
lots on FM 2252, which is shown through the proposed 30' joint access easement. This joint access
easement will also allow for cross lot access between the lots for future commercial development.
The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9
Tree Preservation and Mitigation. The applicant has submitted a tree affidavit which indicates that the
development of this site will in no way cause the destruction of or damage to any Protected or Heritage
class tree(s).
PUBLIC SERVICES:
The site will be serviced by Green Valley Special Utility District (GVSUD), Cibolo Creek Municipal
Authority (COMA), Charter Spectrum, AT &T, CPS, and Center Point Energy.
PUBLIC IMPROVEMENTS:
All public improvements required for this subdivision are required to be installed prior to recording of the
final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement.
Water: The site will be serviced by the Green Valley Special Utility District for water through a 20' Green
Valley SUD Water Easement to be recorded via separate instrument.
Sewer: The site is not currently serviced by a public wastewater system. The applicant is requesting a
waiver to allow both lots to be served by on -site sewage facilities (OSSF).
Drainage: The applicant is responsible for all drainage associated with the subject property and
compliance with the Storm Water regulations. A preliminary drainage report has been reviewed and
approved by the City Engineer.
Sidewalks, Hike and Bike Trails: A sidewalk is required to be constructed along FM 2252 and designed to
meet City of Schertz specifications.
Road Improvements: The subject property is located adjacent to FM 2252, a Principal Arterial roadway
according to the Schertz Master Thoroughfare Plan (MTP) and a TxDOT roadway. TxDOT is requiring a
29.2' right -of.- -way dedication along the property's entire frontage on FM 2252.

The preliminary plat is consistent with applicable requirements, ordinances and regulations for the
