AN ORDINANCE
ESTABLISHING RULES AND REGULATIONS GOVERNING
THE BORROWING. RETENTION AND CARE OF LIBRARY
MATERIALS AND REGULATING CONDUCT WHILE ON
LIBRARY PROPERTY AND PROVIDING PENALTIES FOR
VIOLATIONS OF THE SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ. TEXAS:
SECTION I. It shall be unlawful for any person to fail to return
to the Schertz Public Library any book. videocassette, magazine.
or article in the custody of or belonging to the Schertz Public
Library after a lapse of fifteen (15) days from the date of
posting by regular United States mail of a notice addressed t.:.
such person at the last address furnished the Schertz Public
Library, which notice may be given at any time after the date cn
which such person should have returned the property in accordance
with the rules of the Schertz Public Library: provided, however.
that no penalty shall be imposed hereunder in any case where
restitution shall have been made prior to the expiration of such
fifteen (15) day period.
SECTION II. It shall be unlawful to give a fictitious or
incorrect name or address at the Schertz Public Library in order
to obtain possession or use of any property in the custody of or
belonging to the Schertz Public Library.
SECTION III. The Librarian of the Schertz Public Library or any
person authorized by the Librarian may file a complaint in the
Schertz Municipal Court against any person violating the
provisions of this ordinance.
SECTION IV. It shall be unlawful for any person to damage.
deface. cut, tear, disfigure or destroy any book8.
videocassettes, articles or other library materials or any part
thereof which belong to or were borrowed from the Schertz Public
Library.
SECTION V. No person shall loiter on the Schertz Public Library
lands or in its buildings in such manner as to create or cause to
be created a danger or a breach of the peace or whereby a breach
of the peace may be occasioned.
SECTION VI. It shall be unla\-Jful for any person or persons to
willfully or maliciously commit any vandalism or iniury or damaQe
to or upon the lands or buildings of the Schertz Public Library
or any of its real or personal property lncluding but jy no \-Jay
of limitation, any furniture. fixtures, shelving, equipment,
books, v ideocasset tes , articl es , and a 11 other mater ia: s
belonging to or in the possession of the Schertz Public Library.
SECTION VII. Any person found guilty of violating any ~rovision
of this ordinance shall upon conviction be tined not in excess of
fifty dollars ($50.00) plus the cost of materials damaged or not
returned.
SECTION VIII. The prOVisions of this ordinance are declared to
be severable and if any section, subsection, clause or phrase
shall, for any reason, be held invalid, such determinati'Jn shall
not effect the validity of the remaining portions of this
ordinance.

AN ORDINANCE ESTABLISHING RULES AND REGULATIONS GOVERNING THE
BORROWING, RETENTION, AND CARE OF LIBRARY MATERIALS AND
REGULATING CONDUCT WHILE ON LIBRARY PROPERTY AND PROVIDING
PENALTIES FOR VIOLATIONS OF THE SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ
THAT:
