AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
AMENDING THE CODE OF ORDINANCES CITY OF
SCHERTZ, CHAPTER 10 BY ADDING ARTICLE VI
GARAGE SALES; BY AMENDING ORDINANCE 86-S-28
SIGN ORDINANCE, ARTICLE V SIGNS PERMITTED IN
RESIDENTIAL DISTRICTS BY ADDING SECTION 8
GARAGE SALE SIGNS AND ARTICLE VI SIGNS
PERMITTED IN ALL BUSINESS, c:<H4ERCIAL AND
MANUFACTURING DISTRICTS BY ADDING SECTION 8
GARAGE SALE SIGNS; PROVIDING FOR A ~TY;
REPEALING ALL ORDINANCES IN CONFLICT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
THAT the Code of Ordinances City of Schertz Texas be
amended by adding the foIl owing:
"CHAPTER 10
MISCELLANEOUS OFFENSES AND PROVISIONS
ARTICLE VI. GARAGE SALES
Sec. 10-100. Definitions
a. Garage Sal e: Shall incl ude but not be 1 imi ted to garage
sales, yard sales, auctions and rummage sales which are conducted
for the sal e of new or used merchandise.
b. Officially Authorized Garage Sale Sign: A posterboard
sign, issued by the City of Schertz, yellow in color with blue
lettering stating the sign is a City of Schertz Garage Sale
Permit.
Sec. 10-101. Permit Required.
A permit issued by the City of Schertz(City) shall be required
for each garage sale held within the City limits.

Sec. 10-102. Application for a Permit.
a. An application for a garage sale operator's permit shall
be nade upon fonns provided by the City.
b. The application shall contain all information necessary
to fully advise the City of the date(s), location(street
address), hours of operation of the garage sale, whether the sale
is a combined sale (list names and addresses of other
participants) and any other information that may be reasonably
required by the City.
c. Only the owner or lessee of the property, upon which the
garage sal e is being conducted , nay obtain such permit.
d. Before such permit shall be issued, the applicant shall
provide proof of address (driver's license, utility bills or
other identification) and any other pertinent information as may
be reasonably required by the City. Upon verification and
compliance with provisions of this Section and payment of the
proper fee, the appl icant shall be issued a permit for a garage
sale by the City.
e. By making application for such garage sale permit,
accepting said permit and conducting such sal e, the owner or
lessee of the property to whan the permit is granted authorizes
any Code Enforcement Officer or Police Officer of the City to
enter upon the property for the purpose of determining that such
sal e is being conducted in accordance with the provisions of this
Ordinance, and to reroove any signs not in compliance here with.
Sec. 10-103. Permit Cost.
Cost for a permit to operate a garage sale is $5.00 per sale. A
numbered permit and two official signs shall be provided to the
applicant.
Sec. 10-104. Placement of Garage Sale Signs.
A maximum of two (2) officially authorized garage sale signs may
be placed on any private property with permission of the property
owner. Additional signs advertising the garage sale are
expressly prohibited.
Sec. 10-105. Posting Signs on Certain Property Prohibited.
It is expressly prohibited for any person, firm or corporation
to post a garage sale sign on any public property including but
not limited to traffic control devices, utility poles, and any
city right-of-way or easement.
Sec. 10-106. Number of Garage Sales Limited
It shall be unlawful for any person, firm or corporation to hold
more than two (2) garage sal es per cal endar year.
Sec. 10-107. Time Limit for Each Garage Sale.
It shall be unlawful for any person, company or corporation to
hold a garage sale for a period of time longer than 48 hours
without a special waiver by the City Manager.
Sec. 10-108. Permit Non-Transferable.
No permit issued under the provisions of this ordinance shall be
transferable, nor shall a permit holder allow his name to be used
by any other party for the purposes of operating a garage sale."

THAT Ordinance 86-S-28 Sign Ordinance, Article V Signs
Permitted in Residential Districts by adding Section 8 Garage
Sale Signs.
"ARTICLE V SIGNS PERMITTED IN RESIDENTIAL DISTRICT
Section 8. Garage Sale Signs.
Officially authorized garage sale permit signs showing the
address, date and times when said sale will take place."

THAT Ordinance 86-S-28 Sign Ordinance, Article VI Signs
Permitted in All Business, Commercial and Manufacturing Districts
by adding Section 8. Garage Sale Signs.
"ARTICLE VI SIGNS PERMITTED IN ALL BUSINESS, c:<H4ERCIAL AND
MANUFACTURING DISTRICTS
Section 8. Garage Sale Signs.
Officially authorized garage sale permit signs showing the
address, date and times when said sale will take place."
IV
THAT violation of any part of this ordinance is a
Class C Misdemeanor and upon conviction punishable by a fine not
to exceed $200.00 per day for each day the violation remains in
effect.
V
THAT all ordinances or parts of ordinances in conflict
are hereby repealed.
VI
THAT this ordinance shall be in force and effective
from and after September 1, 1990.
