89-M-23 Competitive Bids ORDINANCE NO. ?7- /)1- (}3 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, BE AMENDED BY REVISING SECTION 2-8 OF SAID CODE, PROVIDING FOR COMPETITIVE BIDS FOR PURCHASES AND SALES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I THAT Section 2-8 of the Code of Ordinances of the City of Schertz, Texas be amended so that Section 2-8 be amended to t~ead as follows: "Section 2-8. Competitive bids fot~ purchases and sales; bidders' sec ur it y. (a) It shall be the duty of the pUt~chasing agent to give opportunity for competition on purchases and sales, except when the nature of the purchase or sale is such that competition is impossible or impracticable and except as provided in section 2-9. All purchases in excess of five thousand dollars ($5,000.00), except of real estate or rights or easements therein, shall be by contract to the lowest responsible bidder and all sales in excess of five thousand dollars ($5,000.00), except of real estate or rights or easements therein, shall be made to the highest bidder, after public notice and the receipt of sealed bids. unless the city council, by ordinance. determines that it is impossible or impracticable to purchase or sell in such manner. All sealed bids received shall be opened in public and thereafter shall be subject to public inspection. The purchasing agent may, at the direction of the city council. reject all bids and readvertise for new bids. (b) Exempt from the competitive bidding re9uirement personal property bought at an auction; bought at a going-out-of- business sale; or bought from another political subdivision, the state. or the federal government. II THAT all ordinances or parts of ordinances in conflict with this ordinance are repealed. Passed on first reading the I~ day of Q~ /S day of , 1989.
