AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING THE SIG~ ORDINANCE NO. 86-
S-28, ARTICLE III, DEFINITIONS, ARTICLE IX,
PERMITS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT Sign Ordinance No. 86-S-28 of the City of Schertz,
Texas lS hereby amended in the following manner:
ARTICLE III DEFINITIONS
Add the following:
5. Variance - An exceptional condition which poses a practical
difficulty or particular hardship in such a way as to prevent an
owner from displaying his/her sign as intended by this Ordinance.
Such practical difficulty must be clearly exhibited and must be a
result of an external influence and not self-imposed.
Sa. Hardship - A condition that would result in the closing
or eliminating of any lawful business not created by
personal difficulties of the owner.
ARTICLE IX PERMITS
Add the following:
12. Variances. It is the intent of this Ordinance to use
variances only to modify the application of this Ordinance to
achieve a parity among signs similarly located and classified.
Specifically, variances are to be used to overcome so~e
exceptional conditions which pose practical difficulty ora
particular hardship in such a way as to prevent an owner from
displaying his/her sign as intended by this Ordinance. Such
practical difficul ty must be clearly exhibited and must be a
result of an external influence, it may not be self-imposed.
12a. Petition for Variance.
1. Filing. A variance request shall .be filed in writing
with the City Building Inspector and shall include .the
following information:

(a) The names~ addresses and telephone numbers of the
petitioner, the owner of the property on which the slgn
is to be erected or affixed, the owner bf the sign, and
the person to be erecting or -afflxing the sign.
(b) A description of tberequestedvariance.
(c) Justification of the -requested varian8e~
(d) The location of the building,. structure or lot on which
the sign is to be erected or affixed. .
(e) A site plan of the property involved, showing accurate
placement thereon of the proposed sign.
(f) A blueprint or ink drawing of the plans and
specifications of the sign to be erected or affixed and
method of construction and attachment to the building
or in the ground. Such plans and specifications shall
include details of dimensions, materials, color and
weight.
<g) The written consent of the owner of the building,
structure or property on which the slgn is to be
erected or affixed.
(h) Such other information as the City Building Inspector
may require to determine full compliance with this and
other applicable ordinances of the City.
2. Fees. (See Schedule of Fees)
12b. Action by Planning and Zoning Commission
1. Timing. The Planning and Zoning Commission shall act
upon a varlance request within thirty (30) days of it's
first appearance on the agenda.
2. Attendance. The petitioner and city Building Inspector
and/or their authorized representatives shall attend those
meetings of the Planning and Zoning Commission at which a
variance is to be heard.
12c. Standards for Variance. Planning and Zoning Commission may
grant a variance when it has been determined from evidence
presented that the variance will not:
1. Serve as a convenience to the petitioner.
2. Alleviate a hardship, or unusual practical difficul ty
created by owner.
3. Be inconsistent with the intent, purpose and objectives
of this Ordinance.
4. Adversely affect the public he~lth, safety or welfare of
the publ ic., and will not be contrary to PLlbl ic interest.
12d. Effect of Denial. No requested variance which has been
denied in accordance with the provisions established herein,
may be resubmitted for a period of one (1) year from the
date of said denial, except on grounds of new evidence or
proof of changed conditions found to be valid by the
Commission.

12e. Revocation of Approved Variance-. In any case where a
variance hasbeeri granted, and where no work p~rtinent
thereto has been initiated within six (6) months from the
date of approval; of the. requested variance,- then without
further action, said variance shall become null and void.
12f. Maintenance of Records. The City Planning Department shall
maintain complete records of. all findings of fact and
recommendations of the Planning and Zoning' Commission
relative to a requested variance. All such reco~ds shall be
op~n to the public for inspection.
