AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, CALLING AN ELECTION TO BE HELD ON MAY
2, 1992, FOR THE PURPOSE OF ELECTING A MAYOR
AND TWO (2) COUNCILMEMBERS FOR SAID CITY,
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
I
THAT an election be held in and throughout the City of
Schertz, Texas (the "City"), for the purpose of electing a
Mayor and two (2) Councilmembers for Places 1 and 2,
respectively, to serve for a term of two (2) years.
II
THAT at said election the candidate recelvlng the
highest number of votes for Mayor shall be declared elected;
and the candidates receiving the highest number of votes for
Place 1 and Place 2, respectively, shall be declared elected
for a term of two (2) years. Any candidate desiring to have
his or her name on the official ballot for said election,
shall at least forty-five days prior to said election day,
file with the City Secretary application in writing in the
form prescribed by the Secretary of State requesting that
his or her name be placed on the official ballot and
designated whether he or she is running as a candidate for
Mayor or councilmember, and if for councilmember, such
person shall declare as candidate for Place 1 or Place 2.
That any person failing to file said written application for
candidacy by the time aforesaid, shall not be entitled to
have his or her name printed on the official ballot.
THAT the name of all eligible candidates whose
applications have been duly and timely filed shall be placed
on the ballot pursuant to a drawing as provided by law.
III
THAT all qualified voters of said city shall be
entitled to vote in said election.
IV
THAT the poling place for the holding of said election
shall be at the Community Center, 1400 Schertz Parkway,
Schertz, Texas, 78154; and the entire City of Schertz for
the purpose of holding said election, shall be and
constitute one municipal election precinct.

V
THAT the Presiding Judge of said election shall
appoint as many resident qualified electors of the City to
serve as clerks in said election as shall be reasonably
necessary to conduct said election, with the appointment of
such clerks to include the Alternate Presiding Judge if
present for the holding of said election. The Presiding
Judge shall appoint a person fluent in the Spanish language
to serve as a clerk of said election to render oral aid in
the Spanish language to any voter desiring such aid at the
polls on the day of the election. In the absence of the
Presiding Judge above named, the Alternate Presiding Judge
shall perform the duties of the Presiding Judge of said
election.
VI
THAT Early Voting in said election shall be conducted
at the Office of the City Secretary, Municipal Complex, 1400
Schertz Parkway, Schertz, Texas 78154, and the City
Secretary is hereby charged with the duty of conducting
Early voting in said election as required by law. The City
Secretary shall appoint a Deputy Early Voting Clerk who is
fluent in the Spanish language to render oral aid to any
voter desiring to vote early in said election who requests
such aid.

THAT the Presiding Judge of said election

THAT the ballots to be used in said election shall be
prepared in conformity with the Texas Election Code, as
amended. That in holding and conducting said election,
voter forms, instructions and other materials required
therefor, including the ballots, shall be in both the
English and Spanish languages.

THAT notice of said election shall be give in
accordance with the provisions of Title 1, Chapter 4, Texas
Election Code.
XI
THAT the City Secretary is hereby authorized to post
notice of said election, in both English and Spanish
languages, on a public bulletin board at the municipal
complex of said City, at the polling place for the holding
of the election, and at one other public place within said
City, all of which notices shall be posted at least twenty
(20) days prior to the date set for said election.
XII
THAT the City Secretary is further authorized and
directed to cause notice of said election to be published
one time not more than twenty-five (25) nor less than ten
(10) days prior to the date set for said election in a
newspaper published and of general circulation in the City.
XIII
THAT the public importance of this measure and the
necessity for calling the election prior to the date for
making application for a place on the official ballot
creates an emergency and an urgent public necessity
requiring the suspension of the charter provision that no
ordinance be passed on the day it is introduced, and such
Charter provision is accordingly suspended and this
Ordinance is declared to be an emergency measure, and shall
take effect and be in full force immediately from and after
its passage on the date shown below.
