BE IT ORDAINED BY litE CITY COUNCIL OF TilE CITY OF SCHERTZ, TEXAS:
THAT, UDC Ordinance No. 96-S-28 of the City of Schertz, Texas is hereby amended in the
following manner.
SECTION I
"Rezoning 89.298:1: acres being situated out of the Rafael Garza Survey Number 98, Abstract
175, Comal County, Schertz Texas, more particularly described in the Field Notes and Map, as
attached hereto as Exhibit A, from General Business District (GB) and Pre-Development (PD) to
General Business District - 2 (GB2)."
SECTION II
THAT, The Zoning District Map described and referred to in Article III, of the UDC, Ordinance
96-S-28 shall be changed to reflect the above amendments.

SECTION III
THAT this Ordinance shall be effective from and after its final passage and any publication
required by the City of Schertz.
SECTION IV
THA T all ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed.

Being 3.50 acres of land situated within the Rafael Garza Survey Number 98, Abstract 175, Comal
County, Texas and being located within the city limits of the City of Schertz. Said 3.50 acres of land
being out of that certain 28.793 acre tract ofland as described in General Warranty Deed dated February
4, 2004, Grantor: Schlather Enterprises, LTD., Grantee: Schertz Bank and Trust and recorded in
document number 200406004333. The bearings recited herein are based on the hereinabove 28.793 acre
tract of land recorded in document number 200406004333 of the Deed Records of Comal County, Texas.
Said 3.50 acres of land being more particularly described as follows:
COMMENCING at a found Texas Department of Transportation (TxDot) concrete right-of-way
monument on the northwest right-of-way of Interstate Highway Number 35 and being a
cutback corner at the northwest corner of Hubertus Road and Interstate Highway Number 35.
THENCE with the northwest right-of-way of Interstate Highway Number 35, South 59021 '16" West.
225.61 feet to a found iron pin;
THENCE South 53040'13" West, 162.50 feet to a found TxDot concrete right-of-way monument;
THENCE South 53046'39" West, 40.79 feet to a set iron pin, with red plastic cap stamped #4777, being
the PLACE OF BEGINNING. Said set iron pin being the southeast comer of this herein
described 3.50 acre tract ofland;
THENCE with the northwest"right-of-\vay of Interstate Highway 35, South 53046'39" West, 250.00 feet
to a found iron pin being the southwest corner of this herein described 3.50 acre tract of land
and the southwest comer of the hereinabove 28.793 acre tract afland. Said found iron pin also
being the southeast corner of that ccrtain remainder of a 61.86 acre tract of land as described in
Warranty Deed dated Janua.ry 24, 1946, Grantor: Jack Alesci, et ux., Grantee: Herman J.

THENCE leaving the northwest right-of-way of Interstate Highway 35 and ,vith the common line of the

of land being a combination of a 25.236 acre tract of land as described in Warranty Deed with Vendor"s
Lien dated May 9, 2006, Grantor: Schert]: Bank and Trust, Grantee: IH-35 Hubertus Investments, LTD.
and recorded in document number 200606019414 and a 60.562 acre tract of land described in General
Warranty Deed with Vendor's Lien dated May 8, 2006, Grantor: Evelyn Friesenhahn, et aI., Grantee: IH-
35 Hubertus Investments, LTD. and recorded in document number 200606018877. Both documents
being located in the Deed Records of Comal County, Texas. A plat of survey has been prepared to
accompany these field notes. The bearings recited herein are based on the hereinabove 25.236 acre tract
ofland recorded in document number 200606019414. Said 85.798 acres ofland being more particularly
described as follows:
BEGINNING at a found Texas Department of Transportation (TxDot) concrete right-of-way monument
on the northwest right-of-way of Interstate Highway Number 35 and being a cutback corner at
the northwest corner of Hubertus Road and Interstate Highway Number 35. Said found
monument being the southeast corner of the hereinabove 25.236 acre tract of land and the
southeast corner of this herein described 85.798 acre tract ofland:
